A person who constructs more than one home in a two-year period shall not be considered a homeowner. Such "homeowner"chall submit to the Building Official on a form acceptable to the Building Official,that he/she shall be responsible for all such work performed under the building permit. Approval of Building Official Note: Three-family dwellings containing 35,000 cubic feet or larger will be required to comply with the State Building Code Section 127.0 Construction Control. HOMEOWNER'S EXEMPTION The Code states that: "Any homeowner performing work for which a building permit is required shall be exempt from the.provisions of this section(Section 109.1.1-Licensing of construction Supervisors); provided that if the homeowner engages a person(s)for hire to do such work,that such Homeowner shall act as supervisor." Many homeowners who use this exemption are unaware that they are assuming the responsibilities of a supervisor(see Appendix Q,Rules&Regulations for Licensing Construction Supervisors,Section 2.15) This lack of awareness often results in serious problems,particularly when the homeowner hires unlicensed persons. In this case,our Board cannot proceed against the unlicensed person as it would with a licensed Supervisor. The homeowner acting as Supervisor is ultimately responsible. To ensure that the homeowner is fully aware of his/her responsibilities,many communities require, as part of the permit application,that the homeowner certify that he/she understands the responsibilities of a Supervisor. The house was constructed in the mid-1970s. Over the years differential settlements along the right side full depth garage foundation and across the immediate rear of the walkout portion that connects the.garage to the house:have resulted in severe cracks. The garage foundation, acting as a soil bin, has cracks at several points. : • and is putting pressure on the gas line conduit. The floor--slab has set- s: tied in the corners. The settlement has extended across the basement bath• room floor and underneath the right rear bedroom. See the attached noted SKs sheets. : This type of occrurence is not unusual where construction is • dug into the side of a steep' hill - referred to as a 'side hill cut' , and : given the 40+ year age, the overall settlements have probably run their • course. These types of foundations usually have no reinforcement and are incapable of-:resisting any major shear or distortion loads and in turn do '- not provide-:good lateral tension ties at the corners. These settlements have created the broken (cracked) floors. Settlements run into the rear of the garage, across the bathroom/bedroom basement floors and also affect the 1st floor den room floor (right rear of the main house) : Needs: Remove the broken garage, bathroom and bedroom floor slabs. Stabilize the foundation walls and install reinforcement piers, steel straps and rebar slab grids. Release any piping and conduit runs, grade and compact sub- grade soils and place new concrete slabs. Trim and finish the interiors. • Reinforcing piers are recommended as. there is no other way to guarantee a secure repair:and the technology may allow for a partial reclaiming of the main foundation :wall settlementSH Either way, -with the walls locked in-place new slabs can pin to them creating tension ties while they in turn can be:secured from uneven settlement.
