1.0 OVERVIEW
1.1 Introduction
CAPE & ISLANDS ENGINEERING, INC. has submitted this Notice of Intent (NOI) Application, on
behalf of the applicant, Stephanie J. Gaskill, Trustee. There are a couple of activities being proposed
as part of this Notice of Intent filing for property located at 540 Old Falmouth Road, Marstons Mills,
MA. The proposed activities are listed below (please reference attached project plans).
The proposed project includes the construction and maintenance of a garage with an enclosed
breezeway. Remove existing post & rail fence, stone retaining wall, remove a portion of the existing
paved driveway, mitigation plantings with the associated grading, utilities and landscaping. All
proposed work is located outside the 50’ Buffer Zone and within previously, legally disturbed areas,
with the exception of the mitigation plantings. (See section 5.1 for detailed description)
1.2 Applicable Regulations
This application has been filed jointly with the Department of Environmental Protection, pursuant to the
Commonwealth of Massachusetts Wetlands Protection Act (MWPA, M.G.L. Chapter 131, Section 40)
in accordance with its implementing regulations (310 CMR 10.00); and pursuant to Town of Barnstable
Regulations - Chapter 704 and Chapter 237, Wetlands Protection Ordinance of the Code of the Town
of Barnstable, as revised and approved of October 25, 2011.
2.0 BACKGROUND
2.1 Existing Conditions
The project site is located at 540 Old Falmouth Road, Marstons Mills, MA, a private residential
property with frontage on Round Pond. The property is currently occupied by an existing single family
dwelling, decks, porch, stairs, steps to lower level, retaining walls, stone steps, chimney, flagstone
walks, stone and paved driveways, a.c. and generator units with manicured lawn and plantings.
2.2 Property History
The property at 540 Old Falmouth Road and is shown on the Town of Barnstable Assessors as
Map 124-005, comprised of 34,010 (+/-) square feet. The property has been a lot on record since on
or about August, 1959, and built on or before 2018, per the Town Assessors records.
2.3 Site Characteristics
The residential single family lot is situated atop a naturally occurring land form, affording views to the
north across Round Pond, a freshwater Pond. The topography for this site slopes from Old Falmouth
Road to the northeast. Bordering the property to the east is a residential property.

3.0 PROPOSED PROJECT
3.1 Scope of Work
The project site located at 540 Old Falmouth Road, Marstons Mills, MA, adjacent Round Pond, a fresh
water Pond. The proposed construction within the 100’ buffer consists of the construction of the
garage, attached enclosed breezeway, removal of a section of the existing paved driveway, stone
retaining wall and post and rail fence with installation of gutters, downspouts and drywells and
mitigation plantings with the associated clearing, grading and landscaping. All of the proposed work is
within previously, legally disturbed areas and located outside the 50’ buffer.
The proposed work outside of the 50’ buffer includes the construction and maintenance of the garage,
enclosed breezeway, and associated appurtenances.
A limit of work consisting of compost socks (rolls) and silt fencing is proposed to keep activities within
the work zone and protect the Wetlands. The proposed limit of work is within maintained lawn areas,
located along the North, South and East sides of the property. A temporary staging area that will be
designated for material storage and woodcutting will be located in the upland outside of the buffer
zone.
Work being performed is in accordance with the standards under the Massachusetts Wetlands
Protection Act (MGL Ch. 131, Sec. 40), (310 CMR) Chapter 704 and Chapter 237 Wetlands Protection
Ordinance of the Code of the Town of Barnstable.
3.2 Resource Areas
The resource areas on or within 100 feet of the site include Land Under Waterbodies and Waterways
(under any Creek, River, Stream, Pond or Lake) and Inland Bank.
The resource areas were delineated and located by an on the ground instrument survey. The
resource area boundaries are marked onsite and are shown on the project plan.
See Section 5.0 for a performance standard analysis of each resource area.
3.3 Construction Methodology
The Order of Conditions and signage will be posted at the site, and area staged for construction.
Efforts will be coordinated to minimize construction time and disturbance within and around the subject
resource areas.
The proposed garage and enclosed breezeway will be built using common construction practices. The
limit of work will be maintained throughout the construction phase. After construction the silt fencing
will be removed, the lawn areas will be restored with loam and seed and landscaping (where
applicable) to restore the area to pre-development conditions.
Other work included as part of this application includes mitigation plantings, removal of a section of
existing paved driveway, removal of existing stone wall and fence. The installation of gutters,
downspouts and drywells will be installed with the associated grading, utilities and landscaping.

After all work has been completed a site inspection will be performed by the engineer and request for
a Certificate of Compliance submitted to the Commission once all applicable conditions have been
satisfied.
3.4 Anticipated Impacts
All disturbances will be kept to the minimum necessary to complete the construction and installation(s)
of the various activities. There will be no disturbance of naturally vegetated areas. All proposed work
areas are within previous legally altered areas. The project has been designed to incorporate
construction methodologies to the maximum extent feasible. No adverse impacts associated with this
project are anticipated.
4.0 MINIMIZATION AND MITIGATING MEASURES
4.1 Mitigation Measures
Prior to the commencement of any construction activities, the contractor shall inspect the limits of work
and make any corrections and repairs to the sediment stops and silt fence to serve as erosion and
sedimentation controls as shown on the construction drawing. The erosion and sedimentation controls
will function to keep sediment within the limits of work and will also serve to define the limit of
construction to site workers. Erosion and sedimentation controls will be maintained in good condition,
at the site until all disturbed areas have been restored and stabilized. The site shall be cleaned daily,
and debris shall be properly disposed inside construction trash containers. The site shall be routinely
cleaned from trash and debris to prevent these from reaching the wetlands. All ground disturbances
will be kept to the minimum necessary to complete the construction and installation(s), and the site will
be restored upon completion.
Mitigation measures have been provided as part of this project to balance the use and enjoyment of
the property owner’s rights with the responsible management of the surrounding resource areas and
protection of said resource area values. Also, the project proposes to install drywells to capture and
infiltrate roof runoff, minimizing the offsite effect of surface runoff and install mitigation plantings. All
work is within previously legally altered buffer zone areas. The following mitigation measures are being
proposed:
4.2 Mitigation Plantings
A total of 761 sq. ft. of mitigation plans to be installed according to the mitigation planting notes. The
proposed mitigation plants are to be planted landward of the proposed limit of work in two areas of the
property. Mitigation Area #1 will contain 509 +/- sq. ft. of plantings and Mitigation Area #2 will contain
252+/- square feet of plantings. Plantings to be two (2) gallon containers or larger, staggered in
formation and planted three (3) feet on center or as necessary to adequately re-vegetate areas.
Proposed plantings to be a combination of Bayberry (Myrica pensylvanica), 3 & 5 Gallon size;
Arrowwood (Viburnum dentatum) 3 gallon size; Wild raisin (Viburnum Nudum Cassinoides) 3 gallon
size; Sweet pepperbush (Clethra alnifolia) 2 gallon size and Inkberry (Ilex glabra compacta) 5 gallon
size. (Alternate acceptable native shrubs: Black chokeberry (Aronia melanoparpa) and Winterberry
(Ilex verticillate)
Mitigation planting areas are shown on the project plan. Proposed plantings shall be maintained in
good health and replaced as necessary.
The proposed project has included mitigation measures to improve the natural capacity of the adjacent
Resource Areas and provide long term protection of adjacent wetlands. The application conforms to
the required performance standards by proposing buffer mitigation plantings.

5.0 APPLICABLE PERFORMANCE STANDARDS
5.1 Buffer Zone
The area known as “Buffer Zone” is located 100’from the edge of the Inland Bank, the
landward-most Wetland Resource and has been located and shown on the plan of reference.
As defined in the Chapter 704 Regulation governing activity in the 100 ft. Buffer Zone under Notice of
Intent application.
704-2 DEFINITIONS
A. A 50 FT UNDISTURBED BUFFER ZONE - is that area of land extending 50 ft
horizontally outward from the boundary of resource areas. A 50 ft undisturbed buffer zone
consists entirely of unmanaged/unmaintained vegetation or long-established meadow. All
of the following are absent from a 50 ft undisturbed buffer zone: hardscape (except for
permitted access paths and/or bank access stairs), lawns, ornamental plants and shrubs,
gardens of any kind. This zone may be referred to herein as the “50 foot undisturbed
buffer.”
B. A 50 FT BUFFER ZONE - is that area of land extending 50 ft horizontally outward from
the boundary of resources areas, whether or not said buffer is in a disturbed or
undisturbed/natural state.
C. A 50 TO 100 FT BUFFER ZONE - is that area of land extending 50 ft horizontally
outward from the boundary of the 50 ft buffer zone and terminating at the outer edge of
the Commission’s 100 ft jurisdictional zone.
D. A 100 FT BUFFER ZONE - is that area of land extending 100 ft horizontally outward
from the boundary of resource areas. The 100 ft buffer zone is comprised of the 50 ft
buffer zone and the 50 to 100 ft buffer zone and constitutes the Conservation
Commission’s 100 ft jurisdictional zone.
704-3 Performance Standards for Projects Requiring A Notice Of Intent
A. A 50 ft undisturbed buffer zone shall be retained between the landward-most wetland
resource areas and the limit of proposed site disturbance.
B. WHERE A 50 FT UNDISTURBED BUFFER ZONE, as measured in accordance with
704-2A, EXISTS prior to the proposed work and is proposed to remain intact, proposed
work within the 50 to 100 ft. buffer zone shall not require further buffer zone
enhancement.
D. CALCULATION OF MITIGATION FOR WORK PROPOSED WITHIN THE 50 TO 100 FT
BUFFER – The amount of mitigation planting required for work proposed within the 50
to100 ft. buffer zone shall be determined by the following method:
a. Calculate area of proposed hardscape within the 50 to100 ft. buffer zone;
b. Multiply the area found in 704-3D (a) by 3 to obtain the area of required mitigation
at a 3:1 planting to disturbance ratio.
c. In no case shall the total area of mitigation plantings required be greater than that
which is necessary to restore a 50 ft. undisturbed buffer in its entirety.
E. LOCATION OF MITIGATION PLANTING - Mitigation planting location(s) shall clearly be
shown on the site plan. The plan shall also provide area calculations for the amount of

mitigation planting herein required, and the amount of mitigation planting proposed.
F. BEST PRACTICES
(1) The Conservation Commission shall exercise a preference for pervious surface types
of hardscape.
(2) Where possible and practical, proposed hardscape within the 50 to 100 ft. buffer
zone shall be located no closer than 10 ft from the landward limit of the 50 ft buffer zone,
so that attendant construction, landscaping and maintenance activities may proceed
without impact to the 50 ft buffer zone.
Currently, development on the property does not render a naturally vegetated 100’ buffer to the Inland
Bank. The existing 50-foot buffer currently has 761 square feet of existing disturbed area. Per
regulation 704-3 D. c. listed above, the regulations stated that “in no case shall the total area of
mitigation plantings required be greater than that which is necessary to restore a 50-foot undisturbed
buffer in its entirety. Since there is 761 square feet of disturbed area, that amount is used as the
required mitigation for the proposed work in the 50–100-foot buffer. The proposed mitigation includes
761 square feet of plantings, as shown on the plans which will enhance the 0–50-foot buffer and the
natural buffer around the property. This natural buffer enhancement plus the development not moving
closer to the resource area creates an overall environmental benefit in this inland environment.
The proposed work has been minimized to the maximum extent possible. The proposed project will
not impair the wetland’s ability to protect critical values such as wildlife habitat, public or private water
supply, ground water supply, flood control, storm damage prevention, prevention of pollution and
recreation values.
5.2 Land Under Waterbodies and Waterways (under any Creek, River, Stream, Pond or Lake)
The resource area referred to as “Land Under Waterbodies” is the area of land below the Observed
Water Line mark and under the body of water known as Round Pond, as shown on attached site plan.
As defined in 310 CMR 10.56 (2)(a)(b)(c) – Definition, Critical Characteristics and Boundary
Definition:
(a) Land under Water Bodies and Waterways is the land beneath any creek, river, stream, pond
or lake. Said land may be composed of organic muck or peat, fine sediments, rocks or bedrock.
(b) The physical characteristics and location of Land under Water Bodies and Waterways
specified in 310 CMR 10.56(2)(a) are critical to the protection of the interests specified in 310
CMR 10.56(1).
(c) The boundary of Land under Water Bodies and Waterways is the mean annual low water
level.
There is no proposed work on or within Land Under Waterbodies and Waterways (under any Creek,
River, Stream, Pond or Lake).
5.3 Bank (Naturally Occurring Banks and Beaches)
The resource area known as “Inland Bank” is located and shown on the plan of reference

Definition:
(a) A Bank is the portion of the land surface which normally abuts and confines a water body. It
occurs between a water body and a vegetated bordering wetland and adjacent flood plain, or, in
the absence of these, it occurs between a water body and an upland. A Bank may be partially or
totally vegetated, or it may be comprised of exposed soil, gravel or stone.
(b) The physical characteristics of a Bank, as well as its location, as described in 310 CMR
10.54(2)(a), are critical to the protection of the interests specified in 310 CMR 10.54(1).
(c) The upper boundary of a Bank is the first observable break in the slope or the mean annual
flood level, whichever is lower. The lower boundary of a Bank is the mean annual low flow level.
Performance Standards
(a) Where the presumption set forth in 310 CMR 10.54(3) is not overcome, any proposed work on
a Bank shall not impair the following:
1. the physical stability of the Bank;
2. the water carrying capacity of the existing channel within the Bank;
3. ground water and surface water quality;
4. the capacity of the Bank to provide breeding habitat, escape cover and food for
fisheries;
5. the capacity of the Bank to provide important wildlife habitat functions. A project or
projects on a single lot, for which Notice(s) of Intent is filed on or after November 1,
Effective 10/24/2014 310 CMR: DEPARTMENT OF ENVIRONMENTAL PROTECTION
1987, that (cumulatively) alter(s) up to 10% or 50 feet (whichever is less) of the length
of the bank found to be significant to the protection of wildlife habitat, shall not be
deemed to impair its capacity to provide important wildlife habitat functions. In the case of
a bank of a river or an intermittent stream, the impact shall be measured on each side of
the stream or river. Additional alterations beyond the above threshold may be permitted if
they will have no adverse effects on wildlife habitat, as determined by procedures
contained in 310 CMR 10.60.
(b) Notwithstanding the provisions of 310 CMR 10.54(4)(a), structures may be permitted in or on
a Bank when required to prevent flood damage to facilities, buildings and roads constructed prior
to the effective date of 310 CMR 10.51 through 10.60 or constructed pursuant to a Notice of
Intent filed prior to the effective date of 310 CMR 10.51 through 10.60 (April 1, 1983), including
the renovation or reconstruction (but not substantial enlargement) of such facilities, buildings and
roads, provided that the following requirements are met:
1. The proposed protective structure, renovation or reconstruction is designed and
constructed using best practical measures so as to minimize adverse effects on the
characteristics and functions of the resource area;
2. The applicant demonstrates that there is no reasonable method of protecting,
renovating or rebuilding the facility in question other than the one proposed.
(c) Notwithstanding the provisions of 310 CMR 10.54(4)(a) or (b), no project may be permitted
which will have any adverse effect on specified habitat sites of Rare Species, as identified by
procedures established under 310 CMR 10.59.
There is no proposed work on, within or along the Inland Bank.
The proposed project meets or exceeds these performance standards. The proposed project activities
will not induce any cumulative impairment of the resource area’s functional characteristics.

5.4 Estimated Habitat and Protected Species
The Massachusetts Natural Heritage Atlas of Estimated Habitats of Rare Wetland Wildlife, Certified
Vernal Pools and High Priority Sites of Rare Species dated, August 1, 2021, indicates that there are
protected species or rare communities at the project site.

The proposed project meets or exceeds these performance standards because there will be no
measureable impact to Rare Species Wildlife Habitat.
5.5 Area of Critical Environmental Concern (ACEC)
As per the Department of Environmental Managements ACEC program, the site is not located within
an Area of Critical Environmental Concern, Waquoit Bay.
There is no proposed work on or within Area of Critical Environmental Concern (ACEC).
6.0 SUMMARY
6.1 Performance Standard Metrics
The existing wetland resources, anticipated project impacts and the proposed mitigation measures
associated with this project have been fully documented within this Notice of Intent application. Based
on the information provided in this application it is asserted that the following project features would
result in a benefit to the associated resource area will not induce cumulative impairment of the subject
resource area(s) values and functional characteristics. The project should be approved for the
following reasons:
• The limit of work and sedimentation (erosion control measures) will be established prior to any
construction activity and provide adequate protection during the construction stage. Also, the site
will be cleaned daily of any loose debris.
• The project within the jurisdiction will not cause unacceptable significant or cumulative effect upon
the resource area values or endangered species and has been designed to reduce the probability
of requiring future filings for maintenance.
• All work is contained within legally disturbed areas and the proposed redevelopment does not
move closer to the wetland resources than existing conditions.
The project meets the performance standards of 310 CMR 10.00 and pursuant to Town of Barnstable
Regulations - Chapter 704 and Chapter 237, Wetlands Protection Ordinance of the Code of the Town
of Barnstable, as revised and approved of October 25, 2011 8.2 Request for Order of Conditions.
The Applicant has demonstrated and documented evidence that this project meets or exceeds all the
relevant performance standards set forth in the governing regulations and respectfully request this
project be approved and that an Order of Conditions be issued to the Applicant through its
representative.
