GROUNDWATER NITROGEN LEVELS MEASURED
IN LITTLE POND (FALMOUTH)
•106 single family homes within 400 feet from the
shores of Cotuit Bay
•Discharge more than 47,000 gallons of wastewater
per day; approximately 12 million gallons per year (1)
4,500 pounds (2.5 tons) of
nitrogen going into Cotuit Bay annually
•I/As performing at 4 mg/L could eliminate 3,600
pounds

(3) Presumption Concerning 310 CMR 15.000: Subsurface Disposal of Sanitary Seward (Title 5)
A subsurface sewage disposal system that is to be constructed in compliance with the requirements of 310
CMR 15.000 (Title 5), or more stringent local board of health requirements, shall be presumed to protect
eight interests in M.G.L. c 131, sec. 40, but only if none of the components of said system is located within
the following resource areas: Coastal Bank, Coastal Beach, Coastal Dune, Salt Marsh, and Wet Meadows,
Marsh, Swamp and/or Bog bordering on any creek, river, stream, pond and lake.
-This infers that the regulations only cover the area from 100 feet or closer to a waterbody.
-However it states “… a greater distance (than 100 feet) may be required by more stringent local
ordinance, by-law or regulation”.
-Further… “the presumption” regarding the 100 feet plus siting “may be overcome only by credible
evidence from a competent source that compliance… will not protect” the receiving water bodies.
