RE: BARNSTABLE--OIR/ERB-5E-88-611 777 Dedham Street Release of Petroleum Product, Canton, Massachusetts 02021 Centerville Texaco-1456 Rt. 28 NOTICE OF RESPONSIBILITY, ATTENTION: Donald Beck, Manager M.G.L. , Chapter 21E and 310 Environmental Affairs 40.000 (Massachusetts Contingency Plan) Gentlemen: The Department of Environmental Quality Engineering, on September 16, 1988 , received notification from Mr. Gifford, Centerville Fire Department that a release of petroleum product had occurred at the above referenced .facility. During September 1988, IEP, Inc. , provided environmental guidance in the removal of three (3) abandoned underground storage tanks discovered beneath a pump island. Approximately one-hundred (100) cubic yards of gasoline contaminated soil was excavated, 'and photoionization detector levels in the stockpiled contaminated soil measured one-hundred (100) ppm. The excavation depth was approximately ten (10) feet below grade, and ground water was not encountered. According to information available 'at this time, it is believed that additional gasoline contaminated soil still remains in the excavated area. These conditions constitute a release of oil or hazardous material at or fro,u t;a site. Ulna prevention and/or mitigation of such a release is governed by M.G.L. , Chapter 21E, the "Massachusetts Oil and Hazardous Material Release, Prevention and Response Act, " and 310 CMR 40.000, "Massachusetts, Contingency Plan" (MCP) . On February 7, .1989, at approximately 2:00 P.M. , a Department representative verbally notified Donald Beck of Cumberland Farms, Inc. 's, responsibility for the release. He accepted responsibility on behalf •of Cumberland Farms at that time. 2 This letter is to inform you that: 1. Based on information available to the Department of Environmental Quality Engineering, the Department has reason to believe that Cumberland Farms, Inc. , is a responsible party with liability under M.G.L. , Chapter 21E, Section 5 (a) (1) . The nature of this liability is joint and several without regard to fault; and 2. The Department is authorized, pursuant to M.G.L. , Chapter 21E, Section 4, and 310 CMR 40.171, MCP, to arrange for or to take actions which it deems necessary to respond to the release should you fail to perform response actions in an appropriate and timely manner. Your liability noted in one (1) above may include: a. Administrative costs incurred by the Department in handling this matter (in simple spill cases , administrative costs incurred by the Department prior to formal legal action are at least $1,000) ; b. Interest charges on the total liability at the statutory rate of 12% compounded annually; c. Treble costs (i.e. , three (3) times the total amount of response costs the Department incurs) ; and d. All damages for the injury, destruction or loss of natural resources due to the release. The liability constitutes a debt to the Commonwealth. The debt, together with interest, creates a lien on all of your property in the Commonwealth. In addition to the foreclosure .remedy provided by the lien, the Attorney General of the Commonwealth may recover that debt or any part of it in an action against you. You may also be liable under M.G.L. , Chapter 21E, Section 11, for up to $100,000 in fines or penalties for each violation of Chapter 21E as well as for additional penalties or damages pursuant to other statutes or common law. The Department requires a written response within fourteen (14) days of your receipt of this letter indicating whether you intend to take the necessary response actions in lieu of the Department. The Department also requires that you contract with a consultant knowledgeable in the area of hydrogeological investigation and uncontrolled hazardous waste site assessment and abatement. The consultant must submit to the Department a Phase I Limited Site Investigation Report and a Preliminary Assessment Report form (copy attached) which must be completed and returned with the Phase I site investigation report within sixty (60) days of your receipt of this letter. Please refer to 310 CMR 40.000, MCP for guidance on the ' `purpose and scope. of Phase I activities, a synopsis of which is attached for immediate reference. 3 - If the Department does not hear from you within the times specified above, or if persons acting in your behalf fail to act within the prescribed times, the Department will commence response actions and expect to recover from you to the extent of liability set forth above. In your letter dated September 5, 1989 you requested that a Notice of Reponsibility be sent to you regarding this site. C.K. Smith and Company, Inc: 's liability for the release of oil and/or hazardous materials is as follows: The prevention and mitigation of such release and threats of release is governed by M.G.L. , Chapter 21E, the Massachusetts Oil and Hazardous Material Release, Prevention and Response Act (hereinafter, M.G.L. , C. 21E) . The site is also subject to 310 CMR 40.000, the Massachusetts Contingency Plan (hereinafter, MCP) , promulgated pursuant to M.G.L. , C. 21E. The MCP defines the purpose, scope, and required activities in successive phases of investigation and remedial act}o.q at a site. Copies of the MCP can be obtained from the State House Bookstore, State House,. Room 116, Boston, MA 02133. Based upon available information, the Department has reason to believe that C.K. Smith and Company, Inc. as a former owner and operator of 1456 Falmouth Road, Barnstable, is a potentially responsible party (PRP) liable under M.G.L. , C. 21E, Section 5. The nature of this liability is joint and several and without regard to fault. The Department is authorized pursuant to M.G.L. , C. 21E, Sections 3A (j ) and 4 to take such response actions at the site as it deems necessary should C.K. Smith and Company, Inc. fail to respond to this release in an appropriate and timely manner. Any response actions taken by the Department will be dictated by the individual characteristics of the site and by the timetable set out in M.G.L. , C. 21E, Section 3A and the MCP. Regardless of who performs the necessary work at the site, you may be liable for all of the Department's response action costs. Response action costs include the cost- of direct hours for work performed by Department employees in overseeing or arranging for response actions, any expenses incurred by the Department in support of those direct hours, as well as payments to the Department's contractors. For more detail see the cost recovery regulations at 310 CMR 40. 600 et sea. Under M.G.L. . C. 21E, C.K. Smith and Company, Inc. may be liable for up to three times the cost of any and all response actions conducted by the Department due to the release, including all contract and administrative costs. If you fail to reimburse the Department for its response actions, the Department may place a lien on all of your property in the Commonwealth. The Commonwealth ,may choose to foreclose on that property in order to satisfy the lien or it may choose to instruct the Attorney General of the Commonwealth to recover the debt or any part thereof in a court action against C.K. Smith and Company, Inc. . C.K. Smith and Company, Inc. may be liable for damages for any injury to or for destruction or loss of natural resources and for all interest on the total outstanding liability at the rate of 12% compounded annually resulting from the release. Additional liability may be imposed under M.G.L. , C. 21E, Section 11 in the form of fines or penalties for each violation of Chapter 21E. At this time, the Department does not require that any response actions - be undertaken by C. K. Smith and Company, Inc. Please be advised that on February 22, 1989, the Department issued a Notice of Responsibility to Cumberland Farms, Inc. , current owner and operator of the site and Cumberland Farms, Inc. accepted responsibility for the required site response actions. a 3 - Be further advised the Cumberland Farms, Inc. has prepared the required preliminary assessment, site classification and Phase I reports and has submitted a waiver application, dated June 14, 1989, to the Department. The waiver application is presently under the Department's review.
