Please note the problems and the related orders or recommendations identified at your property during the inspection: PROBLEM: • The employees of your tenant, Executive Sunoco, have complained about a failed septic system. These workers state that the system backs up after 2 to 3 flushes of the toilet and therefore have no option but to relieve themselves outdoors behind the garage. ORDER: • You ate directed to hire a DEP certified septic system inspector to perform a full inspection of your septic system located at 1617 Falmouth Rd, Centerville. You must submit a copy of the completed inspection report to the Health Division Office by October 15, 2016. This complaint provides reason to believe that if water is leaking into the lift, then,hydraulic fluid may also potentially be leaking out of the lift into the ground and groundwater. As the property owner, you are responsible for any oil or hazardous materials releases on site as well as any future response actions. RECOMMENDATION: • As a potentially responsible party for future remediation efforts, it is in your best interest to have the hydraulic lift serviced by an authorized lift repair technician. Again,you are directed to have a septic inspector submit a fully completed Septic System Inspection Report to this office on or before October 15, 2016. A Method 1 and Method 3 approach was used to compare soil and/or groundwater EPCs to applicable standards. The Method 1/3 Risk Characterization, dated March 4, 2021, is attached as Appendix C. A summary of pertinent findings is provided below: • EPCs for soil do not exceeded the applicable MCP Method 1 S-1, S-2 and S-3 / GW-1 and GW-3 soil standards. • EPCs for groundwater were below the applicable Method 1 GW-1 and GW-3 standards. • There are no surface water bodies located within the Disposal Site Boundary. The nearest surface water body is Long Pond, located approximately 1,600 feet southeast and approximately 30 feet lower in grade than the subject property. The subject property is located greater than 500 feet from areas designated as areas of critical environmental concern, wetlands, certified vernal pools or rare wetland wildlife habitats. Groundwater concentrations at the Disposal Site do not exceed MCP Method 1 GW-3 groundwater standards, therefore, a condition of No Significant Risk is considered to exist for the environment. • A condition of No Significant Risk of harm to safety and public welfare has been achieved. • Based on site conditions, an Imminent Hazard does not exist. • Under current and future site conditions, a condition of No Significant Risk has been achieved for site soil. • Under current and future site conditions, a condition of No Significant Risk has been achieved for site groundwater. In conclusion, a Condition of No Significant Risk, as defined by the MCP, has been achieved for the subject Disposal Site with respect to risk of harm to health, public welfare, safety, and the environment for current Disposal Site based on available Disposal Site data and exposures evaluated for current and foreseeable future Site activities and uses. A Condition of No Significant Risk exists for Disposal Site use and a Permanent Solution With No Conditions is applicable. 8 Feasibility Analysis_ on Restoration to Background An evaluation of the feasibility of reducing the concentrations of OHM in the environment to levels that achieve or approach background must be performed in support of a Permanent Solution filing. In this section, GES examined the feasibility of restoring the Disposal Site to background conditions in accordance with MCP 310 CMR 40.0860 and the MassDEP policy entitled "Conducting Feasibility Evaluations Under the MCP" (Feasibility Policy), promulgated on July 16, 2004. I RTN 4-13380 The Feasibility Policy is based on the classification of Disposal Site contaminants as degradable (non-persistent) or persistent contaminants. Compounds detected a minimum of once during soil or groundwater sampling, and classified by Table 9-1 of the Feasibility Policy as non-persistent, include the VPH and EPH fractions, ethylbenzene, naphthalene, toluene, xylenes. In accordance with the Feasibility Policy, the benefits of additional remedial actions to achieve or approach background for non-persistent contaminants at concentrations that do not represent a condition of Significant Risk are insufficient to justify the costs of those actions. Based on the results of the Method 1/3 Risk Characterization, none of these non-persistent compounds are present at the Disposal Site at levels that represent a condition of Significant Risk and they are not required to be considered further. Persistent contaminants (Table 9-2 of the Feasibility Policy) detected at the Disposal Site include beryllium, chromium, lead, zinc, and MTBE. Beryllium, chromium, lead, and zinc was not selected as a soil constituents of concern (COCs) as being consistent with Natural Background (MCP 310 CMR 40.0006) and would not require notification under the MCP (310 CMR 40.0317(22)). Additionally, MTBE concentrations in groundwater have been reduced to background (non- detect) concentrations at the Disposal Site. 9 Permanent Solution Statement Pursuant to Section 310 CMR 40.1056 of the MCP, the following statements are provided: • The Former Sunoco Station property, located at 1617 Falmouth Road in Centerville, Massachusetts is currently owned and operated as "Garrett's Family Market" by MPG Corporation (formerly known as "Volta Oil"). • This Permanent Solution With No Conditions applies to the Disposal Site identified by the MassDEP as RTN 4-13380 and linked RTNs 4-14632 and 4-17000. • As depicted in Figure 6, the Disposal Site for RTN 4-13380 includes the subject property, a portion of the Bayberry Square Commercial Condominiums and Office Park property located at 1645 Falmouth Road, a portion of Beechwood Cemetery, a portion of Old Post Road, and portions of properties on the cul-de-sac of Joyce Anne Road. Several properties located between Old Post Road and the cul-de-sac of Joyce Anne Road are also included in the Disposal Site Boundary. • The residual soil and/or groundwater impacts remaining at the Disposal Site do not exceed applicable MCP Method 1 soil or groundwater standards. • A REDUA was performed, and the results indicated that the data used is scientifically valid and defensible and of sufficient precision, accuracy, representativeness, completeness, comparability, and sensitivity required by the MassDEP. Therefore, the data is considered to be sufficient to support this Permanent Solution With No Conditions. The certification required by the MCP 310 CMR 40.0009 is provided on the BWSC-104 transmittal form accompanying this submittal. Page 20 Permanent Solution—March 2021 Q Former Sunoco Station Centerville(Barnstable), Massachusetts RTN 4-13380 • The LSP Opinion required by the Section 310 CMR 40.1056(1)(g) of the MCP is provided below in Section 11.0. 10 Public Involvement In accordance with 310 CMR 40.1403, notice of the availability of this Permanent Solution Statement, including a copy of the Disposal Site map and a summary of the findings was submitted to the Chief Municipal Officer and Board of Health of the Town of Barnstable. Additionally, pursuant to 310 CMR 40.1406, notices to the owners of properties within the Disposal Site were submitted using form BWSC-122. Copies of these public involvement notifications are included in Appendix D. 11 Licensed Site Professional Opinion This Permanent Solution with No Conditions was based on investigations by GES and OTO, and on information provided by Sunoco, Handex, CEA, Kleinfelder, RAM and SGS. This report was prepared in accordance with the applicable requirements specified in the MCP 310 CMR 40.1000. Based on the findings of the Permanent Solution investigation, and the current knowledge of Site-specific and surrounding conditions, it is the opinion of the LSP of record that no additional response actions are necessary at the Disposal Site to maintain a level of No Significant Risk and that the conditions of a Permanent Solution With No Conditions have been achieved. Sunoco owns the property located at 16171 Falmouth Road, Barnstable, Massachusetts. Sunoco operates an automobile fueling facility at the property. II. STATEMENT OF FACTS 3. For purposes of this Notice of Intent to Assess Civil Administrative Penalty (hereinafter, "Penalty Assessment Notice"),- the Site includes: (1) those portions of the automobile fueling facility located-at 1617-Falmouth-Road in Barnstable,-Massachusetts where oil . and/or hazardous materials have been released, deposited, stored, disposed of or placed, or otherwise come to be located, and (2) any other place. or area adjacent to or downgradient from the 1617 Falmouth Road, Barnstable, Massachusetts facility where-oil and/or hazardous material have been released, deposited, stored, disposed of or placed, or have otherwise come to be located. The Site is abutted to the north by Falmouth Road and across the road by the Bell.Tower Mall, to the east by a vacant lot containing a foundation, to the south by an undeveloped parcel of land and to the. west by a retail/office condominium complex. 4. On September 11, 1997, the Department received an Oil and Hazardous Material Release Notification Form which indicated that benzene was detected in the groundwater beneath the Site at a concentration above the applicable RCGW-1 Standard. The Department PAN-FINAL Page 1 2/27/2003 issued a Notice of Responsibility ("NOR") to Sunoco pursuant to the Massachusetts Oil and Hazardous Material Release Prevention and Response Act, M.G.L. c. 21E, as amended, ("M.G.L. c. 21E") and the regulations promulgated thereunder as the Massachusetts Contingency Plan (the "MCP") at 310 CMR. 40.0000 et. sec. and assigned Release Tracking Number 4-13380 to the release. The NOR informed' Sunoco of its .liability under M.G.L. c. 21E and the MCP for the cleanup of the Site. 5. On March 30, 1998, the Department received a Tier Classification Submittal Package, a Tier I Permit Application and a Phase I Limited Site Investigation Report all of which were prepared on behalf of Sunoco by Handex of New England, Incorporated ("Handex"). The Site scored as a Tier .IC Disposal site pursuant to 310 CMR 40.0520(3)(e) due to the presence of separate phase product and its location in a high yield aquifer. 6.. On August 5, 1998, the Department issued the Tier IC Permit to Sunoco. Mr. William Morse, an engineer in Sunoco's New England Regional Office located at 4 Bellows Road, Westborough, Massachusetts, signed and accepted the Permit on Sunoco's behalf. By signing and accepting the Permit, Sunoco agreed to conduct response actions at the Site in accordance with the MCP and the terms, deadlines and conditions stated in the Permit. 7. On September 2, 1998, Sunoco's Tier IC Permit for the Site became effective pursuant to 310 CMR 40.0759(1). Pursuant to 310 CMR 40.0751, Sunoco's Tier IC Permit expires September 2,2003 8. On-March 31; 1999, Handex, on behalf of Sunoco, notified the Department, via phone, that 0.16 feet of separate phase product was identified at the Site in monitoring well MW- 3. The Department assigned Release Tracking Number 4-14632 to this release condition and issued an NOR to Sunoco. 9. On.March 3, 2000,'the Department received a Tier I Permit Modification dated March 2, 2000, prepared by Handex, on behalf of Sunoco. The Permit Modification was submitted to link RTN 4-14632 to the Tier IC Permit issued by the Department for RTN 4-13380. 10. On April 4, 2000, the Department received a letter titled Phase II Report Extension, Sunoco Service Station, 1617 Falmouth Road (State Route 28), Barnstable (Centerville), Massachusetts 02632 RTNs 4-14632 &4-13380 Tier IC Permit#123456 SUN DUNS ## 0006-0467, dated April 3, 2000 and prepared by Handex, on behalf of Sunoco. The letter stated that the Phase II Comprehensive Site Assessment.Report (the "Phase II Report") would not be submitted to the. Department by the deadline set forth in 310 CMR 40.0550(2)(a) because additional time was needed to "generate a thorough Comprehensive Site Assessment" for the Site. The letter also stated that additional borings and monitoring wells would be installed at the Site by March 31, 2000. The letter further stated that the Phase II Report would be submitted to the Department by May 31, 2000. PAN-FINAL Page 2 2/27/2003 A 11. On September 2, 2000, Sunoco failed to submit to the Department a Phase II Report and a Phase III Remedial Action Plan ("Phase III Plan '), if applicable, in violation of the provisions of 310 CMR 40.0550(2)(a), 12. On February 26, 2001, the_ Department received a report titled Phase II-Comprehensive Site Assessment Report, Sunoco Service Station, 1617 Falmouth Road (State Route 28) Barnstable (Centerville), MA, RTN 4-13380 & 4-14632 Tier IC Permit #123456 SUN DUNS# 0006-0467, dated February 23, 2001 and prepared by Handex, on behalf of Sunoco. The Phase II Report stated that the extent of soil contamination at the Site is limited to a depth ranging between 15 and 35 feet below grade in the area of the gasoline underground gasoline storage tanks. The Phase II Report also stated that the horizontal extent of groundwater contamination at the Site is limited to the area of the underground gasoline storage tanks and that the vertical extent of groundwater contamination was not delineated because the installation of a deep monitoring well in the source area may create a migratory pathway for contaminants. The Report further stated that separate phase product was observed on November 15, 2000 in MW-3 and MW-6 at a thickness of 0.20 feet and 0.96 feet, respectively. Based on this information, Handex concluded that additional comprehensive response actions were necessary at the Site to achieve a permanent solution pursuant to 310 CMR 40.1000. 13. On September 19, 2001, the Department received a report titled Phase III Identification, Evaluation and Selection of Comprehensive Remedial Action Alternatives and Remedial Action Plan, Sunoco Service Station, 1617 Falmouth Road Barnstable (Centerville)" Massachusetts 02632 SUN DUNS #0006-0467 RTNs 4-14632 & 4-13380 Tier IC Permit #123456 (the "Phase III Plan"), dated August 2001 and prepared by Handex, on behalf of Sunoco. The Phase III Plan identified soil vapor extraction (SVE), separate phase product recovery, natural attenuation and monitoring as the remedial alternatives for use at the Site. The Phase III Plan also stated that the SVE system would be modified to include air sparging once separate phase product is no longer observed at the Site and oxygen-enhanced bioremediation may be used to supplement the selected remedial alternative. In addition, the Remedial Action Plan stated.that the Phase IV Remedy Implementation Plan would be submitted to the Department in the "near future." .14. On April 9, 2002, Sunoco notified the Department of a threat of release that constituted a 2-hour Reportable Condition pursuant to 310 CMR 40.0312. The threat of release resulted from the failure of an 8,000-gallon gasoline UST to pass a vacuum test. The Department assigned Release Tracking Number 4-17000 to this threat of release. 15. On April 11, 2002, the Department received a letter titled Notice of Field Work, Sunoco Service Station, 1617 Falmouth Road (State Route 28) Barnstable (Centerville) Massachusetts 02632, RTNs 4-13380 & 4-14632, Tier IC Permit 4123456 SUN DUNS# 0006-0467 (the "Notice of Field Work") dated April 8, 2002 and prepared by Handex, on behalf of Sunoco. The Notice of Field Work was submitted to the Department pursuant to 3 M 10 CMR 40.0550 and stated that the groundwater plume had migrated off the 1617 Falmouth Road property and was no longer delineated by the existing monitoring wells. The Notice of Field Work also stated that three (3) transects of groundwater monitoring PAN-FINAL Page 3 2/27/200') wells would be installed downgradient of the Site, the assessment activities would be completed by April.21, 2002 and a Phase II-Addendum Report would be submitted to the _- bepartment�y June 30, 2002. T 16. On June 11, 2002, the Department received a report titled Minor Permit Modification, Sunoco Service Station, 1617 Falmouth Road (State Route 28) Barnstable (Centerville), Massachusetts 02632, RTNs 4-14632 & 4-1.3380, Tier IC Permit #123456, SUN DUNS #0006-0467, dated June 10, 2002 and prepared by Handex, on behalf of.Sunoco: The Permit Modification was submitted to link RTN 4-17000 to the Tier IC Permit issued by the Department for RTN 4-13380. 17. On June 17, 2002, the Department issued-a Notice of Noncompliance (the "NON") to Sunoco for failure to submit a Phase II Report prepared pursuant to 310 CMR 40.0835.(4)(f) which defines the source(s), nature and full extent of contamination at the Site within two (2) years of the Permit effective date pursuant to 310 CMR 40.0550(2)(a). The NON also stated that Sunoco failed to submit a Phase IV-Remedy Implementation Plan within three (3) years of the Permit effective date pursuant to 310 CMR 40.0550(2)(b). The NON required Sunoco to submit a Phase II Report complying with the provisions-of 310 CMR 40.0835(4)(f)to the Department by July 1, 2002. 18. Sunoco has violated 310 CMR 40.0550(2)(a) by not submitting a complete Phase II Report prepared pursuant to 310 CMR 40.0835(4)(f) to the Department by the July 1, 2002 deadline set forth in the June 17, 2002 NON. III. STATEMENTS OF LAW 19. The Department is charged with the implementation and enforcement of M.G.L. c. 2 1 E and the MCP. 20. The Department is authorized to assess civil administrative.penalties pursuant to M.G.L. c. 21A, § 16 and the regulations promulgated thereunder at 31-0 CMR 5.00 et. seq. 21. Pursuant to M.G.L."c'. 21E, § 1 l' and 310 CMR 40.0013, any violation of M.G.L. c. 21E, or any order issued thereunder, shall be presumed to constitute irreparable harm to the public health, safety, welfare or the environment. Such presumption may be rebutted by a preponderance of the evidence. 22. Pursuant to M.G.L. c. 21E, § 11, in addition to costs incurred by the Commonwealth for the investigation, as containment and removal of a release or threat of release of oil or hazardous material, any person who violates any provision of M.G.L. c. 21 E, or any order or regulation issued or adopted thereunder: (a) shall be subject to a civil penalty not to exceed twenty-five thousand dollars for each such violation;or(b) shall be punished by a fine of not more-than twenty-five thousand dollars, or by imprisonment for not more than two years in a house of correction,'or both,for each such violation. PAN-FINAL Page 4 2/27/2003 I 23. All terms contained herein are defined in M.G.L. c. 21E and/or the MCP and shall have the meaning given to them in M.G.L. c. 2 1 E and/or the MCP. 24. Pertinent provision(s) of the Massachusetts Contingency Plan are as follows: 310 CMR 40.0550(2) Response Action Deadlines and Requirements for Tier I Disposal Sites (2) Deadlines for Submittals: Except as provided in 310 CMR 40.0550(3), or as expressly provided by 310 CMR 40.0000, or as otherwise ordered or agreed to in writing by the Department, any person undertaking response actions at a Tier I disposal site pursuant to a Tier I Permit shall submit the following,documents to the Department by the following deadlines: (a) a Phase II Report, and, if applicable, a Phase III Remedial Action Plan within two years of the effective date of such permit. 310 CMR 40.0835(1) Phase II Report (1)A Phase lI Report shall be submitted to the Department at the conclusion of Comprehensive Site Assessment activities. pursuant to the applicable deadlines set forth in 310 CMR 40.0550 or 40.0560 or at Interim Deadlines specified by the Department. 310 CMR 40.0835 (4)(f) (4) The information and assessment findings outlined in 310 CMR 40.0835(4) shall be provided in the Phase II Report. Depending upon specific site and release conditions, it may be necessary to provide additional information to.adequately characterize the disposal site, consistent with the Response Action Performance Standard described in 310 CMR . _ . '40.0191, or 'it may be appropriate to. forgo particular assessment or information gathering elements and provide technical justification as described in 310 CMR 40.0193. (f) Nature and 'Extent of Contamination, including a characterization of the source(s), nature, and vertical and horizontal extent of contamination at the 'disposal site, presence and distribution of any non-aqueous phase liquids, tabulation of analytical testing results, and, where appropriate, a characterization of background concentrations of oil and/or hazardous material at the disposal site 25. Based on the facts presented in Section II above, the Department has determined that Sunoco has violated 310 CMR 40.0550(2)(a) by not sub-mitting a complete Phase II PAN-FINAL Page 5 2/27/2003 1 Report prepared pursuant to 310 CMR 40.0835(4)(f) to the Department by the July 1, 2002 deadline set forth in the June 17, 2002 NON. IV. DISPOSITION 26. For the violations set forth in Section II and III above, the Department herewith assesses a civil administrative penalty to Sunoco in the amount of$43,000.00 The Department considered the following factors in determining the amount of the penalty: a. actual and potential impact on public health, safety, welfare and the environment; b. actual and potential damages-suffered and actual or potential costs incurred by the Commonwealth or by any other person; C. whether Sunoco took steps to prevent the failure to comply; d. whether Sunoco took steps to promptly come into compliance after the occurrence of the failure to comply; e. whether Sunoco took steps to remedy and mitigate whatever harm occurred as a result of the failure to comply; f. whether Sunoco had previously failed to comply with any regulation; order, license, or approval issued or adopted by the Department, or any law which the Department has the authority or responsibility to enforce; g. making compliance less costly than the failure to comply; h. deterring future noncompliance by both Sunoco and others; i.
