Appeal No.�L1$4��fi_ Page -2_ of _3____ On ____EP_b m;;r.,v.�2; 19 $?k.::.__, The Board of Appeals found Attorney Philip Boudreau represented the petitioner who has appealed to the Zoning Board of Appeals and petitions for a Variance from setback requirements - (50 foot) 4 located at Lakeside Drive, Lake Wequaquet in an RD-1 zoned district. Section J (d) which .provides for a 50 foot setback from any great pond. This by-law does not prevent ,! building of a boat house, per se. A _floor plan has been submitted to the Board - the house has 1450 square feet of. living space on the first floor and 1619 on the second floor,exclusive of garages - the triangular shape of the lot in question is largely the hardship that the petitioner is . claiming - the locus , lot 19 contains 28,000 square feet - almost three quarters of an acre in size. Most of the houses in the area are on j lots of about one half acre. Norman Grossman, the engineer, exhibits "the originals subdivision plan for review by the Board. The locus is about 125 feet in depth from f Lakeside Drive,. triangular in. shape, and that presents the problem .in so far- as locating 4 any respectable dwelling upon this lot, comensurate with the quality of the land. I � The petitioner has been paying taxes on this land for many years - it is believed to be currently assessed for $35,000 -- worth double that as a buildable lot. The engineer has attempted to triangulate a dwelling upon this Lot, based on a 50 foot setback which the zoning requires - this would make a small , rectangular lot, some several hundred square feet in total area - which would not be as large as a good boat house. An over- view of Lake Wequaquet is exhibited so that the Board might see how developed the area has become. The petitioner owns another piece of land, however, he is not asking any relief for that parcel . There are other homes built in the same proximity as the one the petitioner is requesting. The petitioner requesgs that the 50 foot setback be varied on the site to allow construction of the home with a corner within 36 feet of the Lake, a difference pf 14 feet. The petitioner. has met withthe Board of Health and has been granted permission to locate a septic system 77- feet from mean high water,. the State law only requires 75 - the Town By-law requires 100 feet - this appears as .Exhibit D-1. The submitted plan was reviewed by an engineer from the DEQE - he found that such a variances was not in conflict with the intent of Title V of the State Environmental Code - the letter to be Exhibit D-2. A hearing has been held and the Conservation Commission, who -has control over environmental problems, has denied this # ' petition - has been appealed with the D-EQE in Boston. The petitioner met with the Conservation Commission on January 17, 1984 to discuss a compromise proposal . Appeal No 1984-06 !_ �_ Page 3 of 4 On _ Feb rua ry t.2, _, __� 19 84^ The Board of Appeals found The petitioner would create additional vegetated buffer on the site if the Commission would allow a portion to extend into the 50 foot buffer zone required under zoning. The amount of buffer which would be created is more than that which would be taken up by the house, as .shown on the revised plan submitted* to the Commission on January 17. The Commission voted unanimously to accept this compromise and allow a portion of the house to encroach into the 50 foot buffer strip .but not to include the deck. Therefore, the Commission would recommend that a Variance be granted to allow for that portion of the house which would extend into the buffer strip, E provided it is no closer than 36 feet from the Lake. The Board voted unanimously to grant the Var.[aRce subject to the conditions as set forth by the Town of Barnstable Conservation Commission (letter from I .E.P. , dated January .17, 1984, with the listing of three actions the petitioner will take, to protect said Lake) . 1. The applicant will use hay bale erosion and sediment checks placed between the construction activity and the Lake to prevent sediment from reaching the Lake. Any other erosion and sediment controls required by the Town of Barnstable would be implemented. A limi-t of construction will be set in the field by use of a staked snow fence, to insure that during construction no intrusion which may harm the vegetation and soils between the limit of construction and the Lake will occur. The limit of constkr-tion will be the 36' contour interval . This limit of construc- tion shall be installed prior to any site.work. Hay bales shall be, placed on the landward side of the snow fence. FollowinQ construction of the dwelling all disturbed land will be. graded, covered with 6" of topsoil , and sodded or seeded to create an erosion controlling lawn. All runoff from the roof will be directed into dry wells to prevent runoff that may produce erosion. The veqetation beyond the limit of construction shall be in no way altered, except to remove dead trees and introduce more coniferous trees. 2. The disturbed areas of the buffer zone shall be graded, covered wtih 6 inches of topsoil , seeded with a permanent erosion and sediment control seed mixture and planted with shrubs indigenous to the lot, such as sweet pepper bush, high bush blueberry and sweet fern. To the extent that the following conditions modify or differ from the plans, specifications or other proposals submitted with the Notice of Intent, the conditions shall control. GENERAL CONDITIONS 1. Failure to comply with all conditions stated herein, and with all related statutes and other regulatory measures, shall be deemed cause to revoke or modify this Order. 2. This Order does not grant any property rights or any exclusive privileges; it does not authorize any injury to private property or invasion of private rights. 3. This Order does not relieve the permittee or any other person of the necessity of complying with all other applicable federal, state or local statutes, ordinances, by-laws or regulations. 4. The work authorized hereunder shall be completed within three years from the date of this Order unless elther of the following apply: (a) the work is a maintenance dredging project as provided for in the Act; or (b) the time for completion has been extended to a specified date more than three years, but less than five years,from the date of issuance and both that date and the special circumstances warranting the extended time period are set forth in this Order. 5. This Order may be extended by the issuing authority for one or more periods of up to three years each upon application to the issuing authority at least 30 days prior to the expiration date of the Order. 6. Any fill used in connection with this project shall be clean fill, containing no trash, refuse, rubbish or debris, including but not limited to lumber,bricks,plaster,wire,lath,paper,cardboard,pipe,tires,ashes,refrigerators, motor vehicles or parts of any of the foregoing. 7. No work shall be undertaken until all administrative appeal periods from this Order have elapsed or, if such an appeal has been filed, until all proceedings before the Department have been completed. 8. No work shall be undertaken until the Final Order has been recorded in the Registry of Deeds or the Land Court for the district in which the land is located, within the chain of title of the affected property. In the case of recorded land, the Final Order shall also be noted in the Registry's Grantor Index under the name of the owner of the land upon which the proposed work is to be done. In the case of registered land, the Final Order shall also be noted on the Land Court Certificate of Title of the owner of the land upon which the proposed work is to be done. The recording information shall be submitted to the Barnstable Conservation Commission on the form at the end of this Order prior to commencement of the work. 9. A sign shall be displayed at the site not less than two square feet or more than three square feet in size bear- ing the words, "Massachusetts Department of Environmental Quality Engineering. File Number SE 3-1065 10. Where the Department of Environmental Quality Engineering is requested to make a.determination and to issue a Superseding Order, the Conservation Commission shall be a party to all agency proceedings and hear- ings before the Department. 11. Immediately following completion, the project shall be certified to be as per these conditions and plans, in writing, to the Barnstable Conservation Commission by the project Engineer who shall be registered in the state of Mass. 12. Upon certification by the project Engineer the applicant shall forthwith request, in writing, that a Certificate of Compliance be issued stating that the work has been satisfactorily completed. 13. Prior to any work being done at the site, all legal advertising bills incurred by the petitioner in relation to the Wetlands Hearing held on this project shall be paid. 14. This Order is issued under Article XXVII of the Town of Barnstable By-Laws as well as under Mass. G.L. - Ch. 131, sec. 40.The Barnstable Conservation Commission or Conservation Officer shall be notified no more than two weeks nor less than two days prior to the commencement of work, and have the authority to issue. an Enforcement Order if the terms or intent.of this Order are not complied with. 15. It is the applicant's responsibility to provide all contractors with a copy of this Order and to ensure that all workers are informed of the conditions of this Order before they begin work at the site. Additional red pines shall be planted to provide a line of trees along the water's edge. 5. All roof runoff shall be directed into dry-wells. 6. The driveway shall be of pervious surface such as gravel. - 7. No deck shall be constructed onto the dwelling permitted ber6M.
