Dear Mr. Morrison,
You are granted, a six month extension, until May 16, 20131 to remove the
underground fuel storage tank located at 55 Scudder Bay Circle, Centerville with
the following conditions:
• All fuel oil must be removed from the tank within 30 days of the date
of this letter, if the dwelling is unoccupied. If the dwelling is occupied,
please contact us immediately to inform us as to how this dwelling is
heated and how this issue will be addressed.
Please be advised that you might have the option to permanently abandon this
tank if it is located immediately adjacent to or up against the dwelling. You may
seek approval from the Centerville-Osterville-Marstons Mills Fire Department to
permanently abandon the tank in place. The tank would have to be filled with
slurry. Also, a soil vapor,analysis test must be performed to determine whether
or not any contamination exists.
This six month extension is granted because the applicant indicated that he and
his family' have undergone financial hardship since the economic meltdown in
2008. Also, this property is currently in foreclosure and the applicant is working
with the lender to restructure the remaining mortgage payments. -

I have been sent a Notice to remove the underground oil tank at my property located at 55
Scudder Bay Circle in Centerville since 1984. Due to the many economic hardships that
have affected my family since the economic meltdown in 2008, I have not been in a
position to comply with this Notice.
Currently, this property is in foreclosure and I am trying to deal with the lender on a
restructuring of the remaining mortgage payments. Hopefully, this negotiation will be
completed by December 31,2012.
Due to my continued economic hardship, I would respectfully request an extension on
complying with this Notice until sometime after April 1, 2013. Please advise as to a
revised date for compliance with the Notice. Thank you. N . .

The Public Health Division(PHD)records indicate that a two-hundred and fifty gallon
underground storage tank was installed at 55 Scudder Bay Circle, Centerville in 1978. (Enclosed
for your review is a copy of the original Underground Fuel Storage System registration.) The
PHD does not have records verifying the removal of this tank. This tank exceeds thirty years in
,age and shall be removed as required by the Town of Barnstable Code Chapter 326, Section 3,
Fuel and Chemical Storage Tanks.
Therefore, you are ordered to remove this tank within sixty (60) days from the date of this
Notice.
Upon completion of the tank removal and within ninety (90) days of receipt of this notice,
please submit to this office a copy of the permit for storage tank removal issued by your local
Fire Department. This permit is required to be obtained prior to the tank removal. This copy of
the removal permit serves as documentation that the underground storage tank was properly
removed and disposed of.
Should you be unaware of the existence of the above mentioned tank or its possible previous
removal, an independent third party (i.e. oil company, tank removal company, or environmental
services) company may be able to assist you in physically locating and/or verifying the current
existence of the tank. You can also contact your local Fire Department to obtain a possible
historical record of the storage tank removal permit.
