NOTICE TO ABATE VIOLATIONS OF 105 CNA 410.00, STATE SANITARY
CODE II MINIMUM STANDARDS FOR HUMAN HABITATION AND THE TOWN
OF BARNSTABLE BOARD OF HEALTH'S NUISANCE CONTROL REGULATION
NUMBER ONE
The property owned by you located at 66 Shell Lane Cotuit
was inspected on December 15, 1993 by Stetson Hall, " Hea
Officer for the County of Barnstable, because of a
complaint. The following violations of the Nuisance
Control Regulation Number One Regulation and the Sanitary
Code II were observed:
Insulation, which contains asbestos, is located in the
basement above the washer and dryer surrounding pipes and
located on the boiler. The asbestos insulation show "signs
of deterioration" at the edges with the potential for
asbestos fibers to be released into the air.
You are directed to remedy this violation within seven (7)
days of receipt of this notice by hiring a licensed asbestos
removal contractor.
You may request a hearing if written petition requesting
same is received by the Board of Health within seven (7)
days after the date order is received. However, this
violation must be corrected regardless of any request for a
hearing.
Please be advised that failure to comply with an order could
result in a fine of not more than $500. Each separate day's
failure to comply with an order shall constitute a separate
violation.

You are also subject to non criminal citation of $40.00 for
the first violation NS $15.00 for each additional violation.
Tickets will be issued daily until the violations are
corrected.

Dear Mr. Mckean,
At the suggestion of the Barnstable Board of Health, Michelle
Gunnery, a tenant at 66 Shell Lane, Cotuit, requested that I
inspect pipe insulation material at the above address which she
suspected might contain asbestos. Ms. Gunnery informed me that the
owner of this dwelling is Mr. Andrew Messing, 21 Milow Peck Lane,
Windsor, CT 06095. I have inspected and obtained samples of pipe
and boiler insulation materials located in the basement of 66 Shell
Lane and have forwarded said samples to the Division of
Occupational Hygiene for asbestos analysis. Both samples were
found to contain Chrysotile asbestos as the enclosed sample report
indicates.
The condition of the pipe insulation was found to be deteriorating
at the edges with the potential for asbestos fibers to be released.
The boiler insulation shows signs of deterioration in some places
and also needs to be repaired to prevent release of asbestos
fibers. The washer and dryer are located in the basement directly
under the deteriorating pipe insulation. There is the potential
for human exposure to asbestos particularly when the basement door
is open to the outside.
It is therefore my recommendation that the above condition be
remedied by a licensed asbestos removal contractor as soon as
possible to avoid potential human exposure to asbestos. Please,
call if I can provide additional information on this matter.

As you requested the samples you delivered to this office from 66
Shell Lane, Cotuit, MA. have been examined for asbestos content.
These samples were - analyzed using the, ,. EPA.,approved method of
polarized light microscopy with dispersion., ,staining. The
analytical results are as follows:
