Rear of building had 10 drums,unsheltered, filled and partially filled with used oil, used antifreeze and water. 2. The ground around the drums and other areas in the rear of the building appeared to be saturated with a oil product 3.Two ,unsheltered,275 home heating oil tanks are at the re a f the building.The one nearest to the ten dru s( i on diagram) contains antifreeze - the other tank contains kerosene. 4. Rear parking lot has a catch basin.The catch basin had two electrical cords running ito it coming from the main building.The catch basin also had two plasitc,two inche dia,Yxxx±xgx piping running from the catch basin up the bank along the adjacent building,Child.s Moving,to Bearses Way. Speculation:when the storm driin was filled with,whatever, it was pumped out to Bearses Way. 5. There are three monitoring wells on the property ( see diagram) for a 21 E. Bruce said he heard one 40' of the wells was contaminated.He did not see an official report on the water quality. r ^ History: Harvey Kesten owns the building and ran the business for years.Harry Bridges leased the business.two years ago,with an option to buy.Bad blood developed between the two. Bruce Orcutt steped in to protect his interest. His company supplied Harry Iridges new radiators and other services and Harry built up a large account which he could not pay so he was going to close the door and walk away.Bruce thought they might run the business and possible buy the rea estate b t he presently pIYO ,1 k 4 has strong reservations he /ill take his merchandise and go some other place. HYANNIS, MASS.02601 April 26, 1990 Harvey Keston 87 Silver Leaf Land West Yarmouth MA 02673 SECOND NOTICE TO ABATE VIOLATIONS OF TOWN OF BARNSTABLE ARTICLE XXXIX BYLAW: CONTROL OF TOXIC AND HAZARDOUS MATERIALS The property owned by you located at 528 Bearse.' s Way, Hyannis was reinspected on April 25, 1990 by Edward Barry, Health Inspector for the Town of Barnstable, to follow-up on the complaint investigated March 24, 1990 and March 26, 1990. The following violations of the Article XXIX Bylaw: Control of Toxic and Hazardous Materials were observed: Section 4. Prohibitions: a. Eviden ce of oil and anti-freeze on ground located adjacent to the barrels and within the large puddles of water in the parking lot behind the building. b. Ten ( 10 ) 55-gallon drums containing used oil and used anti-freeze outside behind building on ground. Board of Health Notice (dated July 5, 1988) : Tow ( 2 ) above ground 275-gallon fuel tanks containing alleged kerosene and anti-freeze do not appear to be pro- tected from the elements. On March 28, 1990, you were directed to correct these violations within twenty-four ( 24 ) hours of receipt of the notice letter. However, as of this date, the conditions remain. You again directed to correct these violations within twenty-four ( 24 ) of receipt of this notice. You may request a hearing if written petition requesting same is received by the Board of Health within seven ( 7) days after the date order is received. However, these violations must be corrected regardless of any request for a hearing. Please be advised that failure to comply with an order could result in a fine of not more than $200. McKean Director of Public Health cc: Hyannis Fire Department Attorney Charles Sabatt Among the items that constitute household hazardous wastes are oven cleaners,toilet cleaners,drain cleaners._ disinfectants,rug/upholstery cleaners, floor/furniture polish,mothballs,silver polish,oil based paints and stains, turpentine,and wood preservatives. In addition to these such materials used around the house as insecticides, fungicides,weed killers,roach and ant killers,rat and mouse poisons,and flea collars and sprays are also classified as household hazardous wastes. For the most part all of these materials will be accepted at the household hazardous waste collection. Also, PLEASE USE ORIGINAL CONTAINERS. Bring all waste,including paints,thinners,and solvents,in their original containers. Do not co-mingle substances if you are uncertain whether they are compatible. Make sure containers are covered and not leaking before placing them securely in your vehicle. However,the following materials will R!A be accepted at the household hazardous waste collection: - Hazardous Waste from Business- It is outside the scope of this collection. - Waste Oil -It is now accepted at the waste oil facility at the Barnstable landfill. - Tire -These are now accepted at the Barnstable landfill. - Batteries-A means of dealing with batteries.is now being developed. - Explosives - Including Dynamite and Picric Acid. - Radioactive Materials-They are outside the scope of this collection. - Pathological and Etiological Wastes- Medical wastes are outside the scope of this collection. Gas Cylinders-They are outside the scope of this collection. Sodium Pentachlorophenate: These are found in some herbicides and 2.4.5 TrichlorophenoxyCompounds wood preservatives and are prohibited from and Silvex, and Cholorphenols this collection by EPA due to possible dioxin contamination.
