This work is to be conducted in accordance with the provisions of310 CMR 80.00 and as consistent with the MA DEP Policy WSC-402-96 UST Closure Assessment Manual for the vessel adjacent to the residential dwelling at the above location. The following Scope of Work is anticipated to complete such work. SITE INSPECTION/PE CERTIFICATION: Site inspection to identify location of abandoned vessel relative to locations of building(s)in consideration of feasibility of removal without endangerment to structure. Prepare letter on findings pursuant to the provisions of 310 CMR 80.43,as certified by professional engineer,stating that the vessel cannot be removed without damage to the overlying structure. Provide 30-day advance notification to the MA DEP UST Program of intended in-place abandonment with photographs,sketches and/or plans with engineer's description of why UST should be abandoned in-place rather than removed. He said he went over to house on appointed day. Owner was not home. He said the tank is not exposed. The owner had apparently tried to dig it up; however, it was not located. He said he was not able to locate it - down 3-4 feet and it must be lower than that. In order to get to the tank to empty any moisture/oil, he has to bring in excavating equipment and so the bid he is working on is expected to be costly whether he's emptying it, excavating it, or filling it.. The large cost is in bringing the equipment there. He hopes to get back there this week with a metal detector. Costs would be $3.1K and up. EXCERPT FROM THE BOARD OF HEALTH MEETING MINUTES ON 05/10/16: A. Charles Whitcomb representing Linda, Marie,,Cara and Donna Whitcomb, owners — 88 Greenwood Avenue, Hyannis. No one was present. Mr. McKean said the owners were working with Health Inspector Tim Lavelle in September and April. They did come in during February looking for as-built records. Mr. McKean said that we have not received any other response since February 2016. Upon a motion duly made and seconded, the Board determined to have a sheriff serve notice requesting attendance at the July 12, 2016 meeting and an account of the situation. Hearing — Underground Storage Tanks: Linda Whitcomb, Trustee— 88 Greenwood Avenue, Hyannis, failure to remove an underground storage tank, constable served notice. Linda Whitcomb was present. She said they finally found the tank location. They had been looking on the wrong side of house. They received a quote for the work and for removing the gas line running across it. She has obtained paperwork to apply for a loan to cover the cost and asked for an extension. (They also have a loan to connect to the sewer.) Upon a motion duly made and seconded, the Board granted an extension to remove the underground storage tank until February 15, 2017. (Unanimously, voted in favor.) Hearing Show Cause — Underground Storage Tank: Linda Whitcomb representing Linda, Marie, Cara, and Donna Whitcomb, owners — 88 Greenwood Avenue, Hyannis, Map/Parcel 289-140, extended deadline for removal of underground storage tank expired February 15, 2017, constable served in hand. Linda Whitcomb was present. She said that they had hired a company to remove the oil tank in the ground. Dig Safe came out and did their work. The company had dug the hole around the tank and did not go any further. The hole remains in the yard. She was told the tank is a 275 gallon tank. She said they tried two other companies but it was the busy season and received no further action. She acknowledged her part in not being diligent and mentioned they are part of Stewart Creek and had tied into sewer as required. The Board noted that if it is only 275 gallons, it is relatively small and not likely to have been built to withstand being buried underground. Upon a motion duly made by Mr. Sawayanagi, seconded by Dr. Guadagnoli, the Board determined the underground storage tank must be removed by July 30, 2017. (Unanimously, voted in favor.) Applicant must keep the Health Division informed of the progress. EXCERPT FROM THE BOARD OF HEALTH MEETING MINUTES ON 12/18/18: IV. Hearing — Underground Storage Tank Linda Whitcomb, Charles, Marie, Cara, Donna, owner(s) — 88 Greenwood Avenue, Hyannis, have not complied with Board of Health orders to remove underground storage tank over 30 years old. I Linda Whitcomb told the Board that the fuel tank is 500 gallons and had already been pumped and dugout for removal. She had bids in 2016 and 2017 for removal and cannot afford it. Mr. Norman asked Ms. Whitcomb to have the soil tested right around the tank and to obtain a current quote for the removal of the tank or to have it filled. He believes the flow-able fill will be the least expensive. Upon a motion duly made by John Norman, seconded by Dr. Guadagnoli, the Board voted to continue to February 26, 2019 to allow her time to obtain (1) prices for testing the soil around tank and (2) obtain prices for filling tank to abandon. The option of fillable would be subject to the Fire Department's approval to leave tank in place. (Unanimously, voted in favor.) EXCERPT FROM THE BOARD OF HEALTH MEETING MINUTES ON 2/26/19: V. Hearing — Underground Storage Tank: Linda Whitcomb, Charles, Marie, Cara, Donna, owner(s) — 88 Greenwood Avenue, Hyannis, underground storage tank over 30 years old, continued from December 18, 2018 meeting where applicant was to get quotes for both the soil test and quotes to fill tank. Linda Whitcomb was present and had sent in an email with quote just before meeting. Test $1,470, Lab Test $ 500. The quote to remove the liquid in the tank was $400 and Linda Whitcomb said she would be able to pay for this. Mr. Norman said if liquid is still in the tank, it would be a good sign, the tank is still holding on but it needs to be pumped out immediately before the tank leaks. Bennett had told her that they would hire a subcontractor to abandon it in place for $4,000. The bid she received to remove the tank was only $3,000. She reiterated that she was turned down for the County Loan and thought her husband might be able to qualify for the loan as he is not part of the Chapter 13 filing. Upon a motion duly made by John Norman, seconded by Dr. Guadagnoli, the Board voted to have the moisture and oil removed from the tank within 10 days and then to come back to the Board in 60 days (April 23, 2019 meeting) and every 60 days until the issue has been resolved. Moved to May 28, 2019 agenda. Owner is out of town and asked to move item to the May 28, 2019 meeting. Ms. Whitcomb set up an appointment with Rick at Tank Removal Services in Hyannis for May 9, 2019. (Staff spoke to Rick who said he received her call on 4/22/19, and made appointment for May 9 to see what is in tank and hopes to empty it if only small amount of heating fuel. Otherwise, he will have to coordinate with a larger company. If it is a mixture of water and oil, it would be more involved, to determine tank stability, etc. He has never seen inside of tank yet.)
