However, I will point out that it is imperative that the grease trap be properly maintained in compliance with Town Code, which requires "All grease interceptors must be pumped at an interval not to exceed three months" (Town Code 322-19). Water Pollution Control staff, has informed me that the last recorded pumping of this grease trap is June of 2019,so the grease trap is currently out of compliance and must be pumped immediately. It is my understanding that there will be a maintenance agreement put in place between the two business owners. I would request that DPW has the opportunity to review this agreement and that a central point of contact for the maintenance agreement be provided to DPW. I will note that the Board of Health is the jurisdictional authority for a grease trap variance. As you know,.our Health Dept staff can assist you with the necessary paperwork to get this on the Board's agenda. If a variance is approved by the Board, I would recommend that the variance is non-transferrable and future failure to properly maintain the grease trap may result in a further review of the variance. Per Section 901-15(B) of the Town Code, a "grease trap shall be installed for all facilities discharging other than domestic wastes, such as food handling/preparation facilities". While the applicant may not be intending to make food items in-house,they will be handling food and beverages that have the potential to generate FOG (Fats, Oils and Grease) discharges to the municipal sewer system.
