The prior tenant was Merchandise Home Improvement cvk/a which operated a retail outlet and showroom and it is my understanding sold paint and L other materials. I have attached herewith a list of previous items carried by the prior tenant, which included in excess of 250 gallons of oil-based paint and various other hazardous materials totaling 412 gallons. My client proposes to operate a paint supply retail outlet catering to the general public and professional painters. Due to changes in the environmental laws both nationally and within the Commonwealth, oil paint is generally not available. Mr. D'Olimpio will be selling 2to primarily water-based paints which are not hazardous materials. My reading of the present state of the law is that my client would be entitled to operate a retail business that could carry up to but not exceed 412 gallons of hazardous materials. My client, however, anticipates having approximately half that amount which would consist of paint thinner and lacquer thinner, although I believe he wouldbe allowed to have up to the pre-existing non-conforming amounts as indicated above.
