Johnson, Trustee, to construct an onsite sewage disposal system at 225 lyannough Road (JD's Pizza / Mitie's Restaurant), Hyannis, Massachusetts. The variances granted are as follows: 310 CMR 15.211: The soil absorption system will be located 10 feet away from cellar (crawl space), in lieu of the twenty (20) feet minimum setback required. 310 CMR 15.211: The soil absorption system will be located 5 feet away from the property line, in lieu of the ten (10) feet minimum setback required. 310 CMR 15.211: The underground grease tank will be located 0.4 feet away from a slab, in lieu of the ten (10) feet minimum setback required. 310 CMR 15.211: The underground grease tank will be located 8.4 feet away from the cellar, in lieu of the ten (10) feet minimum setback required 310 CMR 15.211: The top of the existing 2,000 gallon septic tank #2 will be maintained at 3.85 feet below finish grade, in lieu of the maximum 3 feet required. The variances are granted with the following conditions: (1) A 40 mil polyethylene liner shall be installed against the crawl space. (2) The septic system shall be installed in strict accordance with the engineered plans dated revised April 17, 2007. (3) The designing engineer shall supervise the construction of the onsite sewage disposal system and shall certify in writing to the Board of Health that the system was installed in substantial compliance with the submitted plans dated revised April 17, 2007. These variances are granted because physical constraints at the site severely restrict the location of a soil absorption system due to the very small size of the parcel and due to the location of a drain which leads to wetlands. The proposed septic system is designed to meet the maximum feasible compliance standards contained ithin the State Environmental Code, Title V.
