There are no minimum quantity exemptions. As a business owner, you are responsible for registering the hazardous materials inventory for Cape & Islands Glass with the Town of Barnstable Public Health Division. You are also required to submit copies of all material safety data sheets upon request. The Public Health Division is requesting that you submit all MSDS/SDS for review. You are directed to provide the items described above within fourteen (14) days of receipt of this order letter. Failure to obtain annual Hazardous Materials License for storage/handling of greater than 25 gallons of hazardous materials. Facts: A September 12, 2016 routine hazardous materials inspection by the Town of Barnstable Public Health Division at Cape & Islands Glass found that approximately 52 gallons of hazardous materials are stored on site, including approximately 30 gallons of adhesives and 20 gallons of windshield wash. At that time, Mr. Jake McMahon of Cape & Islands Glass was provided with an application for the hazardous materials license. The owner of Cape & Islands Glass, Mr. Scott Gladish, contacted Timothy Lavelle of the Public Health Division soon after the inspection to inquire why the facility was required to have a license. Mr. Lavelle explained that Mr. Gladish could reduce the amount of hazardous materials stored on site, submit a registration of the inventory and request a reinspection. Due to non-response, Mr. Gladish was mailed a warning notice (BAR-W 5164) to comply on September 23, 2016. The license was never applied for and no reinspection was requested. Due to non-response, Mr. Gladish was issued a $75 citation on October 4, 2016. This was sent by certified mail and signed off as received on October 6, 2016.
