Gentlemen:
The Department of Environmental Quality Engineering, in response to a telephone
conversation with Mr. John Kelly, Town of. Barnstable Health Agent, and subsequent
conversations with Mr. Gary Neal of. the Catholic Social Services in Hyannis, is
investigating a release of No. 2 fuel oil at the above-referenced site.
The Department's findings to date are as follows:
1. The one thousand (1,000) gallon underground fuel oil tank was
tested for tightness according to the Kent-Moore procedure on
June 14 , 1985. The tank was found to be leaking at an estimated
rate of three (3) gallons per day.
2. Fuel oil was immediately pumped from the tank by Scudder-Taylor Oil Company,
Inc.
3. On June 21, 1985, the tank was excavated and removed by Clean Harbors, Inc. ,
in the presence of representatives of the Department of Environmental Quality
Engineering, Barnstable Health Department and Fire Department.
4. The tank showed signs of corrosion and had numerous small holes through
the bottom.
5. The soil below the tank was observed to be contaminated with oil to .an
unknown depth.
Based on the above conditions, the Department has determined that hazardous
waste is present on this. site and poses a threat to public health and the environment.
Please be advised that these conditions constitute a violation of Chapter 21E of the
-General Laws of Massachusetts, the Massachusetts Oil and Hazardous Material Release
Prevention and Response Act, which was enacted on March 24, 1983, through Section. 5
of Chapter 7 of the Acts and Resolves of Massachusetts of 1983.

This letter is intended to:
1. Inform you in writing that the Department has reason to believe that
you are, under the provisions of Massachusetts General Laws, Chapter
21E, Section 5, responsible for the release of said hazardous waste.
2. Provide you an opportunity to accept such responsibility.
3. Advise you of the potential consequences of your failure to accept
such responsibility.
Your acceptance of responsibility for release means that you will take steps
to more fully assess the extent of the contamination and to conduct any necessary
remedial action.
Please be advised that if you fail to accept such responsibility under the
provisions of Chapter 21E, Section 4, the Department of Environmental Quality
Engineering is authorized to take any abatement actions it deems necessary in
response to a release of hazardous materials in the interestof protecting the
public health and environment. All persons responsible for a release of.hazardous •
materials for which the Department incurs costs for containment and removal are
liable to the Commonwealth for amounts up to three times their liability. In
addition to liability for costs incurred by the Commonwealth for the containment
and removal of a release, any person who violates any provision of Massachusetts
General Laws, Chapter 21E, is subject to fines of not more than twenty-five thousand
dollars ($25,000) for each day of violation.
Therefore, the Department requires the following assessments and remedial action
to be undertaken:
1. Excavate and remove all contaminated soil and treat it as a hazardous
waste.
2. If the contamination proves to be extensive to the point where
the affected soil cannot be removed and groundwater .contamination may
exist, contract the services of a firm experienced and knowledgeable
in assessing and abating subsurface petroleum contamination. A comprehensive
report shall be prepared detailing the extent of groundwater contamination,
its potential impact to off-site property and nearby water supply wells,
if any and what further remedial action is warranted in order to clean up
the contaminated groundwater.
Please notify this office orally or in writing by August 1, 1985, of your
intentions concerning this matter.

Enclosed is the information regarding the tanks removed
from two locations in the Town of Barnstable by Clean Har-
bors , Inc .
(A ) Catholic Social Services , corner of Pearl and
South Street , Hyannis , MA. Removed ( 1 ) 1 , 000
gallon fuel tank . The tank was found to be leak-
ing , the contaminated soil was removed and dis-
posed of and a monitoring well was installed .
No contamination of the ground water was found .
Job complete .
(B ) Cape Cod Academy , formerly Oster Ville Elementary ,
corner of West Bay Road and First Street , Oster-
Ville , MA . Two tanks were removed , ( 1 ) 1 , 000 gal-
lon tank and ( 1 ) 2 , 500 gallon tank . Tanks were
not leaking . Job complete .
