NOTICE_TO ABATE VIOLATIONS OF 105 CMR 410.00, STATE SANITARY
CODE II MINIMUM STANDARDS OF FITNESS FOR HUMAN HABITATION
AND BOARD OF HEALTH NUISANCE CONTROL REGULATION NUMBER ONE
The property owned by you located at the two lots located at
the end of White Birch Way, MA , listed as parcels 12 and 13
on Assessor's Map 129 was inspected on June 25, 1991, by
Thomas McKean, Director of Public Health for the Town of
Barnstable, because of a complaint. The following
violations of 105 CMR 410.00, State Sanitary Code II,
Minimum Standards of Fitness for Human Habitation were
observed:
410.602A: Pile of leaves, grass clippings, tree limbs, and
several cups on the ground at parcel # 13.
A rusted abandoned 275 gallon oil tank, an abandoned bent
stainless steel sink, and several boards on the ground, and
buried tree limbs, leaves and grass clippings in the. ground
at parcel # 12 bordering Town owned property. However, a
witness stated that he has observed your trucks dumping the
materials there.
You are directed to remove these materials within fourteen
(14) days of receipt of this letter. The oil tank must be
transported to an approved tank yard and a copy of the
manifest shall be furnished to the Board of Health within
fourteen days of receipt of this order letter.
You may request a hearing if written petition requesting
same is received by the Board of Health within seven (7)
days after the date order ism received. However, these
violations must be corrected re rdless of any request for a
hearing.

Please be advised that failure to comply with an order could
result in a fine of not more than $500. Each separate day's
failure to comply with an order shall constitute a separate
violation.

Dear John:
A site inspection was undertaken on your property, Lot #29, White Birch Way,
West Barnstable, on June 27, 1991. Although the majority of stumps and related
debris have been removed from the site, some work remains to be completed.
Additional hand work is required to remove the remaining smaller stumps and brush, r.
limbs, leaves, etc. The 275 gallon oil tank needs to be removed for proper off-
site disposal as does the damaged sink. The exposed slope then needs to. be sta-
bilized. Loaming and seeding would effectively remedy the situation.
Additionally, work needs to be completed on the isolated wetland adjacent to
parcel #13.
As mandated in the Enforcement Order dated June 4, 1991:
All silt (eroded material) in the vegetated wetland and its buffer zone (up to
the paved roadway) shall be removed. This work shall take place by hand. There
shall be minimal disturbance of the existing vegetation. All disturbed areas
shall be replanted. All work shall take place in consultation with the Conserva-
tion Department. The catch basins shall also be modified, as necessary, to ensure
no future erosion problems. This work has not yet taken place. You are required
to complete this work by July 12, 1991. The cleanup, loaming and seeding work on
,and around Lot #29 also shall be completed by July 12, 1991.
