The Building Commissioner oversees the activities on this property. The memo is quite specific, Mr. Bill declared. Continuing discussion ensued. Ultimately, Mr. Bill advised the applicant that this application appears to be an extension or modification of a non-conforming use. Mr. Bill expressed his opinion that the applicant shall be required to pursue and obtain a modification of a non-conforming use with the Zoning Board of Appeals. In addition,Mr. Bill noted that Paxson Communications is not listed on exhibit 2 (see: Memo of Understanding referenced above),which identifies 31 users. The applicant was required to provide a current list of users and co-locators. Users are not to exceed 31 in accordance with the Memo of Understanding. A copy of Paxson's lease agreement and authorization was also required. Mr. Bill confirmed that no additional tower is proposed (the existing single unit will remain). This project(structure) is located at the(tower)base. "What is it attached to?" Mr. Bill asked. The applicant was unable to respond. A landscaping plan was requested. It was also noted that approval from OKH may be necessary for the structure. Engineering expressed concern regarding the site access crossing private property..Mr. Hunter explained if that if this is the case, the applicant must relocate the access,which ultimately will affect the drainage.and grading. A revised plan reflecting this alteration must be submitted if this assessment is accurate. Mr. Hunter also commented that the applicant is increasing the impervious area. He advised the applicant to confirm the retention of run-off on site. Mr. Hunter added that the drive way should be designed and constructed to accommodate large trucks if they are anticipated to access this site. The Building Commissioner remarked that there are no building code issues. He advised that if Paxson is another carrier, this name is not reflected on the list before him. It was noted that this issue must clearly be resolved in order to proceed. Mr. Bill interjected that the locus map on the plan should be corrected. Conclusion: Continued. SPR 032-02 Hyannis Auto Center, 55 Airport Rd.,Hy (R294-016-001) \an Ojala and Peter Cutler appeared before the panel seeking approval to add another use (used car sales and related services) on this site and modify a previously approved site plan (048-99). This site is in WP zone and GP overlay district. 3 .� SPR Notes of 05/09/02 Town Taxi will maintain the office on this site and secure the existing off-site parking for 30 cars (taxi use). Health confirmed that the applicant washes vehicles off site. The vehicles for sale shall be displayed on this site(office site). Mr. Barry inquired about the nature of`related services' as indicated on the application. Mr. Cutler replied that they will do warranty work. He identified alternators,radiators and small, miscellaneous repairs of a similar type to be typical of the used car sales industry. Discussion revealed that that the uses Mr. Cutler seeks would result in the expansion into a third bay. The Duck Mobile occupies the south end bay. Mr. Cutler reviewed the history of repair work on this site. It was noted that in 1971 Hillshire RV provided sales and service without interruption. The repair use has not been abandoned. A letter from Paul Larusso confirmed this, as did information contained in the Building Division's street file. Planning inquired about the waste oil tank. It was determined that the tank is not currently contained in a vault allowing for 110%capacity per current requirements. Mr. Bill recommended that applicant provide such a vault. Discussion ensued about the number of uses on site. The previously approved plan was also discussed. Mr. Cutler advised that there are four offices and a driver's room. Mr. Bill addressed the parking needs. He noted 49 spaces to be required. Mr. Cutler disputed this declaring that the only time all vehicles (taxi use) are in the yard is between IAM and 5AM. Mr. Bill confirmed that none of the cars shall be cannibalized. Mr. Cutler declared that It was noted that the off-site lot is not paved. There are 20—22 cabs in the winter and 28- 30 in the summer. The remote lot has curb stops for 14 and directional signage. Shift scheduling was discussed. The modus operandi is to substitute a private vehicle for a j cab. Mr. Bill asked about the location of the car rental business. It was noted that this occurs at the office. Mr. Cutler reminded that panel that typically the rental vehicles are out. There may be two or three left on the lot at any given time. Mr.Bill asked about proposed landscaping improvements. The applicant responded that loam has been installed out front. The area has also been seeded. Mr. Cutler complained that the large trucks accessing the area have consistently driven over this little island ruining all vegetation. 4 SPR Notes of 05/09/02 Engineering inquired about drainage calculations. Dan Ojala replied that he did not update the 1998 plan. Mr. Hunter noted concern on the discharge of water in the entrance area. He suggested that the applicant provide spot elevations in front of the building. He advised the applicant to provide"some kind of catchment"in this area. Retention issues were discussed. Mr. Hunter pointed out the areas of concern to the applicant and Dan Ojala. The Building Commissioner inquired about the types of repairs the applicant intends to perform. Mr. Cutler responded that they change shocks,brakes, alternators and general "quick stuff'. Discussion recognized the pre-existing use but reminded the applicant that this is a serious issue due to the project's location in a ground water district. The Commissioner asked about the typical number of employees on site at given time. Some additional discussion ensued. Employees park in the remote lot, exchanging vehicle for vehicle. Some employees car-pool, and sometimes a cab is dispatched to pick up an employee,Mr. Cutler declared. Conclusion. Continued. A subsequent meeting occurred on May 30'�'. SIR 028-02 Harvey Industries, 186 Breed Hill Rd, Barn (R314-024-005) Continued from 4/25/02. The applicant seeks approval for a 9,100 sf addition to an existing warehouse and installation of a 750 sf shed. Improvements are also sought for the parking lot and loading docks. Zoltan Juhasz reviewed the amendments required during the last meeting. He advised that the easement does not exist and a previous reference to it was eliminated. In addition he stated that all of Health's previous concerns have been satisfied. Mr. Juhasz reviewed the issues discussed on April 24t': • The Fire Department is satisfied with the connection and re-enforced fire lane. • The dumpster was relocated. • The number of employees was noted to be IS.Maintain same approach with existing roof run off(roof slope—no leaders). • Will provide additional landscaping. • Natural state ratio (30%) required is satisfied. • The 25 year storm assessment indicates retention pond will absorb flow. • CC berm on drive way shall be removed per Fire Dept. 's request. 1 • Will provide a concrete block retaining wall. 5 SPR Notes of 05/30/02 Discussion revealed that 3 rental cars may be on site. This business is associated with Hyannis Auto Center. The applicant has three business components: Hyannis Auto Center,the rental business and Hyannis Taxi. Mr. Bill confirmed that the building was constructed in 1984. It is situated in a GP district. The grand fathering of uses was also discussed. The applicant remarked that they seek to maintain all existing uses as currently utilized and seek to maintain the uses status quo. Mr. Bill commented that no curb stops are provided to define the parking in the gravel area. Dan Ojala replied that there are pre-cast units in the center aisle providing some order. The Fire Department reviewed the prior uses confirming that the taxi repair, rental use and washing(aka rinsing)has continued unabated. The panel agreed that the applicant has the right to continue these uses but not to intensify or otherwise add new non-conforming uses. Don Chase, Hyannis Fire inquired about the nature of repairs currently occurring on this site. The applicant responded that although they may exchange an engine they do not rebuild. No valve or machine work is done. Primarily, the work is limited to the removal and replacement of components. The Building Commissioner inquired about repairs involving fluids. It was noted that the applicant has a waste oil tank on site. The Board of Health recognized this provision and remains satisfied. The Fire Department indicated no other concerns or questions. Engineering confirmed that on the NE side parking occurs against the building. The vehicles.exceed the property line but it was noted that both sites are under common ownership. The Building Commissioner relayed his assumption that the applicant will clean up the Plant Road site and re-stripe the parking area. The applicant indicated his cooperation. The Commissioner advised the applicant to notify the panel upon completion and reminded Mr. Cutler that a compliance inspection shall be performed. Conclusion: Approved with the following condition: The washing of vehicles is prohibited on this site. 4 SPR Notes of 05/30/02 Mr. Bill deferred the use issue (unit vs. complex) to the Building Commissioner. The Commissioner asked the applicant to identify when the non-conforming use was last utilized. Attorney Butler again argued that the entire site is pre-existing,non-conforming. Different tenants and uses have been occurred on this site. He referred to the Festival Mall as an apt example to determine the"change of use". Mr. Bill countered that this proposal does not meet the requirements of the HB zone. Attorney Butler continued his argument that this is a pre-existing and a less intense use. John Hunter reminded the applicant of the purpose of this review process. The Fire Department was satisfied with the site access but identified some litigation involving pollution as yet unresolved. Engineering has no comments. Conclusion: Approved with the following conditions: The applicant shall submit the capacity and location of the grease trap. SPR is required in the event that a change of use is proposed for the residential dwelling. It was noted that the remote lot is a one to one exchange. The maximum capacity occurs from 2Am to 5:30 AM. Enclosed are copies of Article 39: Control of Toxic and Hazardous Materials ordinance and,.a,, copy of the Toxic and Hazardous Materials On-Site Inventory form from the visit to your shop. Please note the problems identified at your place of business during the hazardous materials inventory and their corresponding recommendations listed below: Problem: Waste oil,waste antifreeze and waste cleaning solvent barrels and tanks are not labeled correctly. On a previous site visit on May 21, 2002,your business was ordered to label all waste storage barrels and tanks,"TOXIC"and"HAZARDOUS WASTE". Recommendation: Please label all waste storage barrels and tanks"TOXIC"and"HAZARDOUS WASTE". This should be completed immediately. Problem:, You have some parts stored on shelves that have antifreeze still in them(i.e. small plastic antifreeze tank with no cap or lid stored on metal shelves). Recommendation: If you are saving these used auto parts to reuse them at some point,please drain any/all liquid hazardous waste from them and dispose of it properly. J Problem: Bob's Tire removes your used/waste tires and New England Environmental Services removes your used oil filters and waste antifreeze but there is no paperwork that documents who removed these hazardous materials from your business,when they removed them, and where the material was taken to. Recommendation: Starting immediately,please obtain waste hauling documentation and retain all hazardous material disposal records and manifests from Bob's Tire and NEES (as well as Safety Kleen and "Syntas"). All records pertaining to storage,removal and disposal of toxic or hazardous wastes need to be retained on site for no less than five years by the hazardous materials registration holder(i.e. Hyannis Auto Center)so the Public Health Division,MADEP or EPA can review these records at any time. This must be done in accordance with section 12-3 of Article 39. Problem: Hazardous materials were being drained onto the floor with no catchment/containment from the vehicles being repaired in your shop. There were spills of oil and antifreeze on the floor of your shop and an insufficient amount of absorbent material(Speedi-Dry)used to contain these releases. Recommendation: Beginning immediately,please use proper catchment pans/trays under vehicles when they are being worked on and liquid hazardous waste is drained from them. Place a larger portion of Speedi Dry on the spills in your shop and DO NOT REUSE this absorbent material. "Evaporating the liquid waste"from your Speedi Dry is a fire hazard. These materials should be , cleaned off the shop floor and disposed of DAILY. Spills or releases of Antifreeze must be controlled:because it is especially toxic and can cause irreversible health problems or death. Problem• Used shop rags were on the floor and in open storage containers. Recommendation: Used shop rags must be picked up and stored in a metal container with a lid at all times. Containing your shop rags properly can prevent a fire hazard. On Site Inventory Total: The Toxic and Hazardous Materials On-Site Inventory from May 111`shows that you have approximately 1,124.5 gallons of toxic and hazardous materials being used,stored, generated and disposed of at Hyannis Auto Center(Please see enclosed Toxic and Hazardous Materials On Site Inventory sheet). The Board of Health has determined that the using,storing, generating and disposing of over 111 gallons of hazardous materials per month requires businesses in the Town of Barnstable to obtain an annual Hazardous Materials License. The Health Department may, according to law, enter upon any premises at any reasonable time to inspect for compliance. 12-2 Upon request of the Health Department, the owner, individual identified on a registration or license application, or operator of any premises at which toxic or hazardous materials are used or stored shall furnish all information required to monitor compliance with this Ordinance. A sample of wastewater disposed to on-site septic systems, drywells or sewage treatment systems may be required by the Health Department at the operator's expense. 12-3 All records pertaining to storage, removal and disposal of toxic or hazardous wastes shall be retained for no less than five (5) years by the registration holder or license holder, and shall be made available for review by the Health Department upon request. 12-4 The Building Commissioner of the Town of Barnstable shall condition issuance of building and occupancy permits upon conformity with the requirements of this Ordinance respecting any hazardous materials and/or acutely hazardous materials to be used in the course of such construction or occupancy. Section 13 VIOLATION: Written notice of any violation of this Ordinance shall be given by the Health Department, specifying the nature of the violation; any corrective measures that must be undertaken, including containment and cleanup of discharged materials; any preventive measures required for avoiding future violations; and a time for compliance. Requirements specified in such notice shall be reasonable in relation to the public health hazard involved and the difficulty of compliance. The cost of containment and cleanup shall be borne by the owner and operator of the premises. Section 14 PENALTIES: 14-1 Any person who shall violate any section of this Ordinance for which penalty is not otherwise provided in any of the General Laws shall upon conviction be fined 300 dollars. 14-2 Any person who shall fail to comply with any order issued pursuant to the sections of this Ordinance shall, upon conviction, be fined 300 dollars. Each day's failure to comply.with an order shall constitute a separate violation. 14-3 In the alternative to criminal prosecution, the Health Department may elect to utilize the non-criminal disposition procedure set forth in MGL c.40, s.21d. Non-criminal ticket citation for any violation of any section of this Ordinance shall be in the amount of $75.00 for the first violation and $25.00 for each additional violation.
