They have a permit for 9 cars and I observed 25 cars and 1 large boat. I spoke to the owner who was very polite and asked him to remove excessive cars. Background: The property that is the locus of these appeals is a 0.21 acre lot developed with a one-story commercial structure having 2,087 sq.ft. gross area' and an unfinished basement. The property recently housed a commercial printing and photocopy business but is presently vacant. The applicant is proposing to acquire the property and improve it for social service and medical offices. The improvements will include using half of the basement area for future office expansion. The medical offices portion of the proposal is why the applicant must seek Variance relief in terms of use. Medical office are not permitted in the UB-Urban Business District and Appeal No. 2000-52 is a petition for that Use Variance. In Appeal No. 2000-53, the applicant is seeking a special permit for the reduction of on-site parking requirements. Section 4-2.10 Reduction of[Parking] Requirements of the Zoning Ordinance allows the Board to issue a Special Permit to reduce the required on-site parking given"special circumstances". Specifically: "1) Use of a common parking area by different uses having different peak hours of demand. 2) Age or other characteristics of occupants which reduce auto usage. 3) Characteristics of use invalidating normal methods of calculating parking demand. 4) Supplementary parking provided off-premise." This is an existing site and 11 parking spaces are provided on site. The proposed use will require 12 spaces. Variance Findings: In consideration for the Variance, the applicant must substantiate those conditions unique to this lot that justify the granting of the relief being sought. In granting of the Variance the Board must find that: • unique conditions exist that affect the locus but not the zoning district in which it is located, • a literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship, financial or otherwise to the petitioner, and • the relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of the Zoning Ordinance. Special Permit Findings: In addition to satisfying one or more of the provisions of Section 4-2.10, as cited above, the granting of a Special Permit requires the following finding of facts to be made by the Board (as required under Section 5- 3.3(2)): • that the application falls within a category specifically excepted in the ordinance for a grant of a Special Permit, • that after evaluation of all the evidence presented, the proposal fulfills the spirit and intent of the Zoning Ordinance and would not represent a substantial detriment to the public good or the neighborhood affected, and. • a site plan has been reviewed and found approvable in accordance with Section 4-7 herein subject only to the issuance of a Special Permit. Suggested Conditions-Variance Appeal No. 2000-52: If the Board should find to grant the requested Use Variances, they may wish to consider the following conditions: 1. The variance is issued to the O'Neil Health Clinic only for the combination of medical and social service offices. 2. The medical offices shall not occupy more than 50% of the building. 3. Also in attendance were Dan Ojala, John Fellino, Toma Stamenkovic, Andre DuPrey, Attorney Peter O'Keefe, Peter Sullivan, Scott Cameron, and Frank Polak. This meeting was called to order at 9:05 AM and adjourned at 11:25 AM. SPR 67-2000 O'Neil Health Clinic 89 Bassett Lane, Hyannis R308-041 Attorney Peter O'Keefe representing the O'Neil Health Clinic appeared before the panel seeking approval of a change of use for 89 Bassett Lane. The applicant seeks to establish a multiple human service facility including weekly dental exams, a daily on-call doctor, nurse and social health support professionals. This facility shall be devoted to servicing the low income population. Housing, employment, medical and substance abuse advocates are proposed to be housed in this single facility. Attorney O'Keefe advised the panel that this change of use impacts the site in a less negative manner then that of the prior tenant, Off-Set Printing. He argued that this proposal is primarily an office use with a secondary medical accessory use. Regarding the physical aspects of the site, Attorney O'Keefe informed the panel that there is a 1,000 gallon septic system which passed inspection. There is also a catch basin on site. 11 parking stalls are provided. A handicap parking stall is proposed but Attorney O'Keefe explained that the typical clinic clients do not drive. This proposal consists of 2,200 square feet of useable space, 3000 with the storage area in the basement. Planning inquired about a state charter.. General discussion indicated that most medical staff members such as the nurse practitioner and doctors are volunteers. Attorney O'Keefe stressed that this is not a full medical service facility. They offer only simple medical essentials. Attorney O'Keefe reiterated that this is primarily an office use. The philosophy of O'Neil Health Clinics is a team effect dedicated to the rehabilitation or transition of a patient as well as maintenance support. The goal is to mainstream patients into society as productive citizens. Engineering asked for clarifications on the site improvements. The applicant responded that their intention is to provide small plantings in front and some screening in the back; f r , r mostly a visual enhancement. Engineering advised the applicant to delineate the parking stalls. At this time, it was also noted that the handicap ramp is not shown on the plan. The Building Commissioner expressed concern over the applicant's definition of office space. Ultimately, it was determined that approximately one third of the available space would actually be devoted to a medical use. Twenty percent is traditional office use. The primary use is the defining mechanism. The Commissioner inquired if the applicant had 501 C3 educational use in their corporate papers. The applicant replied negatively. Health inquired about the dumpster location. There is not one now but they agreed when they obtain one, it shall be installed 10' from the property line and be screened from view. Mr. McKean reviewed the septic history. It was upgraded in 1984. Including the storage area, the allowed use is 75 gallons per day. Title 5 classifies all of the reported space as office use. The Commissioner reminded Attorney O'Keefe that if Zoning doesn't allow a given use, the Building Commissioner has no choice but to refer the application to the Zoning Board of Appeals. Conclusion: Continued pending the result of the Building Commissioner's research regarding the definition of office vs. medical use.* *The Commissioner ultimately determined that this proposal is primarily a medical use and therefore this application must be referred to the ZBA. The BHA is aware of the work conducted by the Housing Assistance Corporation at the present O'Neil facility and we believe these services have benefited many homeless and low-income individuals. The BHA's primary interaction with the Housing Assistance Corporation has been around the management and creation of housing programs. HAC is the service provider at the Kit Anderson House, a property owned by the BHA. The BHA has been very satisfied with the professional management of this facility for mentally ill individuals. The two agencies collaborated on an SRO on Winter Street for individuals tranitioning from the NOAH shelter to self-sufficiency and again HAC's administration of the faciltiy has been professional and without incident. There are several other rental assistance programs where the two agencies share administrative responsibilities and in each instance HAC has committed the necessary staff to enable the programs to function smoothly. The BHA feels less qualified to comment on the services to be offered at the O'Neil Health Clinic but the agency believes that the high quality of management exhibited by HAC on our housing program collaborations would be exercised in the management of this health facility. The BHA does not believe the housing developments which we manage on Sea Street Extension and 200 Stevens Street would be negatively impacted by the location of this facility on Bassett Lane. I would suspect that if financially qualified, several of our low-income residents at these developments may choose to take advantage of the free dental and medical services. At the meeting of August 30,2000,a Motion to Grant the relief requested did not carry. Hearing Summary: Board members hearing this appeal were Tom.DeRiemer,Dick Boy,Gail Nightingale,Ron Jansson and Dan Creedon. Attorney Peter O'Keeffe represented the petitioner,O'Neil Health Clinic for a change of use for a structure located at 89 Bassett Lane,Hyannis,MA. The petitioner is seeking a Use Variance in a UB district,where medical offices are not allowed. The proposal is for mixed use,one dental office,two medical offices,and social service rooms. There will be staff and administrative offices Attorney O'Keeffe also discussed that statutory requirements for a Use Variance were being meet. The members of the Board expressed concern that the facility could be a drug and substance abuse clinic. Additionally,data was presented on the traffic issues and it was determined that traffic was not a major issue Concern was expressed for controlling the behavior of the clients,with safeguard in place to assure that no problems would occur. At the hearing of August 30,2000,. Mr.O'Keeffe stated that he would present a overview of the goals of the clinic as presented by him at the August 16,2000 hearing. He stated that I 4 there were other agencies within walking distance to the proposed facility and that related services are in the vacinity. PUBLIC COMMENT: Art Kimber,member of the Barnstble Housing Authority spoke in favor of the petition. He stated that the applicants would provide a much needed service for the community.Paula Schnepp,River Rd.,Marston Mills,also spoke in favor of the applicants. Letters of support were introduced by Chairman Jansson on behalf of the petitioner. FINDINGS: Dick Boy 1. The granting of the Use Variance cannot be taken lightly.In order to grant this request,the Board must find that essentially no other use is possible of this locus. The site is zoned UB-Urban Business and a host of uses are possible as-of-right. 2. The proposed use is permitted in the PRD district located'/Z mile from the locus. That district was specifically created to accomodate the Cape Cod Hospital and other medical offices,clinics and out-pattient services. The proposed use would be better located as of right in that district. 3. There is no substantial hardship financial or otherwise to the petitioner. The hardship if any would be self imposed because the applicant does not yet own this building. 4. To grant the Use Variance would be a substantial detriment to the public good and a substantial detriment to the surrounding business interest. 5. Expansion of medical uses within the business district of downtown Hyannis would constitute a substantial detriment to businesses,the skating rink and the elementary school. 6. Granting this Variance would derogate from the intent of the Zoning Ordinance. The applicant is proposing to acquire the property and improve it for social service and medical offices. The improvements will include using half of the basement area for future office expansion. The medical offices portion of the proposal is why the applicant must seek Variance relief in terms of use. Medical office are not permitted in the UB- Urban Business District and Appeal No. 2000-52 is a petition for that Use Variance. In Appeal No. 2000-53, the applicant is seeking a special permit for the reduction of on-site parking requirements. Section 4-2.10 Reduction of[Parking] Requirements of the Zoning Ordinance allows the Board to issue a Special Permit to reduce the required on-site parking given "special circumstances". Specifically: 1) Use of a common parking area by different uses having different peak hours of demand. 2) Age or other characteristics of occupants which reduce auto usage. 3) Characteristics of use invalidating normal methods of calculating parking demand. 4) Supplementary parking provided off-premise." Also in attendance were Dan Ojala, John Fellino, Toma Stamenkovic, Andre DuPrey, Attorney Peter O'Keefe, Peter Sullivan, Scott Cameron, and Frank Polak. This meeting was called to order at 9:05 AM and adjourned at 11:25 AM. SPR 67-2000 O'Neil Health Clinic 89 Bassett Lane, Hyannis R308-041 Attorney Peter O'Keefe representing the O'Neil Health Clinic appeared before the panel seeking approval of a change of use for 89 Bassett Lane. The applicant seeks to establish a multiple human service facility including weekly dental exams, a daily on-call doctor, nurse and social health support professionals. This facility shall be devoted to servicing the low income population. Housing, employment,medical and substance abuse advocates are proposed to be housed in this single facility. Attorney O'Keefe advised the panel that this change of use impacts the site in a less negative manner then that of the prior tenant, Off-Set Printing. He argued that this proposal is primarily an office use with a secondary medical accessory use. Regarding the physical aspects of the site, Attorney O'Keefe informed the panel that there is a 1,000 gallon septic system which passed inspection. There is also a catch basin on site. 11 parking stalls are provided. A handicap parking stall is proposed but Attorney O'Keefe explained that the typical clinic clients do not drive. This proposal consists of 2,200 square feet of useable space, 3000 with the storage area in the basement. Planning inquired about a state charter. General discussion indicated that most medical staff members such as the nurse practitioner and doctors are volunteers. Attorney O'Keefe stressed that this is not a full medical service facility. They offer only simple medical essentials. Attorney O'Keefe reiterated that this is primarily an office use. The philosophy of O'Neil Health Clinics is a team effect dedicated to the rehabilitation or transition of a patient as well as maintenance support. The goal is to mainstream patients into society as productive citizens. Engineering asked for clarifications on the site improvements. The applicant responded that their intention is to provide small plantings in front and some screening in the back; mostly a visual enhancement. Engineering advised the applicant to delineate the parking stalls. At this time, it was also noted that the handicap ramp is not shown on the plan. The Building Commissioner expressed concern over the applicant's definition of office space. Ultimately, it was determined that approximately one third of the available space would actually be devoted to a medical use. Twenty percent is traditional office use. The primary use is the defining mechanism. The Commissioner inquired if the applicant had 501C3 educational use in their corporate papers. The applicant replied negatively. Health inquired about the dumpster location. There is not one now but they agreed when they obtain one, it shall be installed 10' from the property line and be screened from view. Mr. McKean reviewed the septic history. It was upgraded in 1984. Including the storage area, the allowed use is 75 gallons per day. Title 5 classifies all of the reported space as office use. 1 The Commissioner 'C mmi loner reminded Attorney O'Keefe that 'f y t i Zoning doesn't allow a given use, the Building Commissioner has no choice but to refer the application to the Zoning Board of Appeals.
