The new structure is attached to the existing dwelling by a one- story addition. Plans for the new addition show the use of the first floor to be that of a two-car garage. No. floor plan for the second floor was submitted. Elevations of the proposed addition submitted with the application show the second level as a full floor. It was estimated that the second floor area was 840 sq.ft. According to the Assessor's Record, the property is a 0.26=acre parcel developed with a two-story,2,400 sq.ft.living area, five-bedroom, single-family dwelling. The structure dates to 1964. The property is served by public water and is connected to the Town's Wastewl'ter Treatment facility. The locus is in a . Groundwater Protection Overlay District that;in this case would restrict the lot to maintain 30% of the area in-natural vegetation and restrict lot coverage by impervious surfacing to no more than�0%- Otis Road, dates to 1934 and was created by a subdivision plan recorded at the Barnstable Registry of Deeds as Land Court Plan 11519B. The roadway dead ends at the terminus of the lot and is undeveloped in that 190 foot section bordering the subject lot. The parcel across Otis Road from the subject lot is also owned by the Applicants. Procedural & Hearing Summary: This Appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on March 17, 2005. A public.hearing before the Zoning Board of Appeals was duly advertised and notice sent to all abutters in accordance with M.G.L. Chapter 40A. The hearing was opened May 11,2005, at which time the Board found to grant the Special Permit. Board Members deciding this Appeal.were,Richard L. Boy, Sheila Geiler,Gail Nightingale, Ron S. Jansson, and Chairman Daniel M. Creedon III. Attorney Paul R. Tardif represented the Applicants before the Board. The Applicants,Robert A.Faria and Charles J. Faria, were also present. Mr. Tardif noted that the lot is undersized and that the existing structure does not conform to the required side yard setbacks required for the Residence B Zoning District. He stated that the lot and structure are legally-created pre-existing nonconformities and that the Applicant qualifies to 1 seek special permit relief for the proposed addition to be located within the front yard setback. The Board agreed, and Mr. Tardif addressed the special permit requirements and criteria cited in Section 240-92(B) Nonconforming Buildings or Structures used as Single and Two-Family Residence. Mr. Tardif noted that Otis Road is undeveloped in this section and that it is only a paper road that provides no access to any lots. The two lots that boarder the sides of this.section of the way are owned by the Applicants. He stated that the only persons affected by the proposed expansion would be the Applicants and therefore,the proposal would not represent any detriment to the neighborhood. He further cited that the shape of the lot and the fact that it has two front yard requirements further justified the grant of the relief. The Board noted that recent structures, a shed and a screen house, infringed into the setbacks required. It was stated that the screen house was erected in 1985 and,at a time when the front yard requirement for the district was 20 feet. The Applicant agreed to remove the shed and to relocate the screen house into conformity to the required setbacks for the district. The Board and Applicant discussed the size of the garage and the Applicant noted that he desired the added area of the first floor for his personal wood working shop. The second floor would be used only for storage. The Board questioned that large of a spec for storage only and the Applicant cited that he may in the future desire to use it as an affordable apartment. The Board noted that the Accessory Affordable Housing restriction does not permit affordable units from being located in a new separate structure as this second floor would constitute. The Applicant agreed to restrict the use of the second floor to storage only and to reduce the second floor area in the structure by eliminating the dormers and by reducing the height of the structure to that of 19 feet to the ridge. The height would then be equal to that of the existing dwelling. i Public comment was requested and no one spoke in favor or-in opposition to the request. Findings of Fact: At the hearing of May 11, 2005, the Board unanimously made the following findings of fact: 1. The Applicants in Appeal 2005-039 are Robert.A.Faria and Charles J.Faria. They have applied for a Special Permit pursuant to Section 240-92(B)Nonconforming Buildings or Structures used as Single and Two-Family Residence. They seek to construct a 28 by 30 foot,garage addition to be located 11 feet from Otis Road where the required front yard setback is 20 feet. The subject property is shown as parce154 on Assessor's Map 310 addressed 83 Baxter Road,Hyannis,MA. It is in a Residence B Zoning District. 2. The proposed originally submitted was.to construct a 28 by 30 foot two-story garage addition,however, the Applicants have agreed to reduce the proposal in terms of the-height of the building and the area of the second floor. The Applicant has also agreed that no area in the garage structure would be designed as habitable space and to restrict the use of the second floor to that of storage. Further understandings include that there would be no utilities on the second floor except electricity for lighting and the height of the structure would be reduced as well as the dormers eliminated from the proposal, thus.restricting area on the second floor. 3. The property is a 0.26-acre parcel, approximately 11,000 sq.ft. According to the Assessor's record, the dwelling on the lot is a two-story, 2,400 sq..ft. living area,five-bedroom, single-family structure that dates to 1964. The age of the structure renders the.nonconformity with respect to the side yard setback and lot as a legally-created pre-existing situation. In which case, the subject property in terms of 2 i structure would qualify under M.G.L. Chapter 40A, Section 6 and under Section 240-92(B)for relief via a Special Permit for the proposed addition. 4. The property is served by public water and is connected to the Town's Wastewater Treatment facility. The locus is in a Groundwater Protection Overlay District that requires 30% of the lot be retained in natural vegetation and limits lot coverage by impervious surfacing of 50%. 5. The Applicant seeks the special permit to allow for the addition to be located 11 feet from Otis Road within the required 20 foot front yard setback required by the district's regulations. Otis Road is a paper road at this locus and terminates at the edge of the subject property. It most likely would never be developed, as that would go nowhere and serve no purpose. Testimony was also given that the Applicants own not only the subject lot,but also the lot across Otis Road and the interest in this undeveloped segment of Otis road. 6. The proposed addition does represent an intensification of the use of the property; however,the Applicant has agreed to reduce the amount of building to be constructed and agreed to certain restriction on the use of the addition. With that reduction and with restrictions imposed,the proposed development would not represent a substantial detriment to the neighborhood nor nullify or substantially derogate from the intent or purpose of the Zoning Ordinance. 7. The Assessor's record states that the number of bedrooms in the dwelling is five. The Applicant has stated that there are a total of six bedrooms in the dwelling. With regards to this situation, if the Applicant has six bedrooms, those bedrooms must be approved by the Building Commissioner and conform to building division requirements and all applicable codes of the Town. Decision: ,. Based on the findings of fact,a motion was duly made atad seconded to grant the Special Permit to permit a 9-foot infringement into the 20-foot front yard setback.required on Otis Road,subject to all of the following conditions: 1. This Variance is issued only to an accessory garage structure to be located as shown on a proposed site plan entitled"Plot Plan of Land located at 83 Baxter Road Hyannis,MA prepared for Robert&Charles Faria"as drawn by Yankee Survey Consultants and dated March 15, 2005. 2. The structure to be built under this Variance shall be in conformity to elevations and plans presented entitled, "83 Baxter Road Hyannis,MA", as drawn by CADzooks Architectural Graphics, dated.3/1/05 with the exception that: • both the second floor dormers and the windows located in those dormers shall be eliminated. The structure shall have a pitched rood. • The maximum height of the"structure as measured for grade to ridgeline shall not exceed 19 feet in height. . use of the garage is restricted to that of a garage and only storage shall be permitted on the second floor area. There shall be no area for human habitation permitted in the garage structure. • Only electrical service for lighting only shall be permitted on the second floor. 3 3. The existing shed located on the property shall be removed from the property. The existing screen house located on the property and infringing into the front yard setbacks shall be relocated on the property so as to conform to the required setback for the district. 4. Use of the property is limited to that of single-family use only. The dwelling is limited to a maximum of five bedrooms unless the actual number is six bedrooms es may be authorized by the Building Commissioner only if those six bedroom can be shown to comply with all applicable Codes of the Town,Health Division requirements and Fire District requirements for six bedrooms. 5. Use of the structure authorized in this Variance is that of a two-car garage and storage. There shall be no finished area created for human habitation in the structure. 6. Upon executing this Variance, the existing structure and the accessory structure authorized by this Variance shall be considered full build out for the property and the structures shall be expanded neither in footprint nor in gross area without permission from the Board. . 7. A public hearing before the Zoning Board of Appeals was duly advertised and notice sent to all abutters in accordance with M.G.L. Chapter 40A. The hearing was opened October 19,2005', at, which time the Board found to grant the modification. Board Members deciding this Appeal were, Daniel M. Creedon,James R. Hatfield, Ron S. Jansson, Jeremy Gilmore, and Chairman Gail Nightingale. Attorney Paul R. Tardif represented the Applicants before the Board. The Applicants,Robert A. Faria and Charles J.Faria, were also present. Mr. Tardif gave a brief background noting that the foundation had been poured and when surveyed, it was located too close to the rear property line.
