I received a two part complaint on this unit at 800 Bearse Way
The unit has had the master bedroom sealed off from the rest of the unit and is being rented out
and it apparently has its own cooking facilities installed.
The main part of the unit has a number of occupants who are heavy smokers. They are
apparently throwing their butts down the stairs, onto lower decks and the grass area below.
Residents are afraid of a fire.

To whom it may concern,
On 10-10-12 I went to said unit (6NE) for follow up visit due to inspection
conducted on 9-6-12. During first inspection I did observe several violations which
produced an order letter to correct. On September 10, 2012 owner/occupant did
sign for said letter. During my 10-10-12 inspection I did observe all violations stated
in 9-6-12 order letter had been corrected. Owner stated he no longer rents the
room in question which was the main focus of order letter. I did explain to owner if
he does rent room in the future he may not block second egress and occupant of said
room must have access to main kitchen within dwelling unit. Furthermore, he must
register rental unit with Barnstable Health Division for yearly inspections. If you
have any questions I can be reached at number below.

Dear Ms Murphy,
I have not been able to actually talk to a responsible party concerning the issues identified in my
email below. Please know that I have received yet another complaint concerning the same
problem and Mr. Vargem appears to have chosen not to cooperate with regulatory officials. In light
of this, the Health Dept. intends to issue citations directly to Mr. Vargem for his failure to abate the
violations cited on Sept. 6,.2012 in a registered letter to him.
This email will serve to document that this office has twice notified you and attempted to discuss
the matter with you, once by phone on 9/6/2012 at 10 AM (I left a voice mail message on the
management office number) and again by email to you on 9/7/2012 (see below). Our concern is
greatly enhanced due to the most recent fire in another building in this same condo complex-
which is still being repaired and corrected months later.
I think it would be in everyone's best interest to sort this matter out.
Please advise. Thank you.

I have inspected Unit 6NE as the result of a complaint I received concerning both the disposal of cigarettes
and the conversion of the master bedroom and bath into a segregated and independent living unit rented
out by the owners of 6NE. The initial complaint cited concerned not only for the inconsiderate behavior
and unsightly mess with regards to the cigarettes but also included the hazard of creating additional living
space without the assurance of proper permits, inspections or life safety provisions in place. I did indeed
find the rental unit as described and it was lacking the the necessary safety provisions. The health agent
with me during the inspection sent a letter to the owner directing him to correct the violation found and
cited.
As I am aware of at least 2 fires on this site within recent history, I thought it wise to alert you to the
situation and in fact I actually left a message yesterday for Maryanne(?) at 508-775-7382 . I have not
heard back from anybody, hence my email to you today. Be aware that the converted studio only has one
means of egress as the door to the main part of the condo is blocked and locked. The only means of
ingress or egress is the slider on to the second story deck.
Any feedback or assistance you can provide with this compliance issue would be greatly appreciated.

NOTICE OF VIOLATION
Dear Mr. Vargem;
Please be advised that this office represents the Board of Trustees of the Cape Crossroads
Condominium Trust. Our client informs us that you were recently cited by the Town of
Barnstable Public Health Division for multiple violations of the State Sanitary Code and Town of
Barnstable Code (a copy of the notice from the town is enclosed herein).
Please note that not only do the problems listed in the enclosed notice constitute violations of the
State and Town code,but they also constitute violations of the governing documents of the
Condominium, and misconduct by you. As such, demand is hereby made that if any of these
violations remain you immediately take steps to remedy the situation.
In addition to the violations cited on the enclosed notice, we are also writing to address the fact i
that you are leasing a portion of your Unit in violation of the governing documents of the
Condominium. Pursuant to the relevant provisions,"no portion of any unit (other than the entire
unit)shall be leased for any period." As you are currently renting/leasing one of your bedrooms,
you are in violation of this provision. As such,demand is hereby made that you immediately
cease and desist from renting/leasing a portion of your Unit.
Please be advised that if any of the violations cited in the enclosed notice shall continue and/or if
you continue to rent/lease a portion of your Unit,the Board has the right and will assess your
account fines,with each day that the violations continue constituting a separate fineable offense.
In addition,if necessary, the Board may choose to pursue legal action to force you to comply
with the governing documents of the Condominium. In such an event we would name you as the
defendant in a lawsuit, and you would be responsible for any and all legal fees and costs incurred
in connection with that legal action.

NOTICE TO ABATE VIOLATIONS OF 105 CMR 410.000, STATE SANITARY
CODE lI — MINIMUM STANDARDS OF FITNESS FOR HUMAN HABITATION
AND THE TOWN OF BARNSTABLE CODE CHAPTER 170.
The property owned by you located at 800 Bearse's Way 6NE Hyannis was inspected
on September 6, 2012 by Timothy B. O'Connell, R.S., Health Inspector for the Town of
.Barnstable. This inspection was conducted on the basis of a complaint.
The following violations of the State Sanitary Code were observed:
410.450 Means of Egress: Observed room within dwelling unit being used as a bedroom
without second means of egress. (Second means of egress is locked and not capable of
being unlocked.)
105 CMR 410.482—Smoke Detectors
There was not a smoke detector observed within bedroom.
105 CMR 410.100- Kitchen Facilities: Occupant does not have access to kitchen
facilities. Occupant must have access to kitchen area to be able to prepare, store and cook.

The following violation(s) of the Town of Barnstable Code were observed:
1� 70-4—Certificate of Registration. Property is not registered with Town of Barnstable
Health Department.
You are directed to correct the violations listed above within twenty four(24) hours
of your receipt of this notice by installing smoke detector within said bedroom; by
removing lock from door so that it may act as second means of egress. You are
directed to correct the violations listed above within fourteen (14) days
of your receipt of this notice by registering dwelling unit with Health Division.

You may request a hearing before the Board of Health if written petition requesting same
is received within ten (10) days after the date the order is served.
Non-compliance will result in a fine of $100.00 per violation. Each day's failure to

Health Division and ask to speak with the inspector who performed the inspection.

I was out at the aforementioned locations this morning with Paul Roma & Pat. Tin'from Health joined us
at Cape Crossroad and Uncle Al's as well.

I spoke to MS Gould, the daughter of the owner of 92 County Seat. Mrs. Higgins. The property was
greatly improved since the last time I was out there. The dumpster is gone but the storage containers
remain. The debris and and items formerly littering the side and rear yard have been mostly removed. I
told Ms Gould that I would stop by when I was in the area to check on her progress. She agreed to this
and stated her goal is to continue to sort out the storage units and get rid of them and beautify the. .
property. The significant improvement is a good sign.

We had-previously-received complaints concerning the condo owner and tenants. The owner resides
here with his elderly mother. They speak Portuguese but very limited English. I called my translator who
convinced the owner to admit us. We found a two bedroom condo with a door at the end of the hallway
blocked by decorative items. The owner would not allow me to open that door and indicated that
someone was on the other side. He gestured to me to follow him outside on to the deck and knock on the
slider. The tenant emerged and allowed us inside. He had a bed &couch, TV, microwaves, and a mini
fridge. There was no smoke detector and no second means of egress. The door to the rest of the condo
was blocked off. I contacted my translator again who explained to the owner that he is unable to wall off a
portion of the unit as a separate unit. My translator will assist the owner in complying with our directive to
restore the condo to its proper configuration and register it as a rental. Written orders will be sent to the
owner directly and he will contact my translator accordingly.
5 Uncle Al's
Responded to this address as the result of photos provided to me by Lt John Cosmo. Apparently, the
HFD responded.to a cooking event on Monday and found a separate apartment in the lower level. The
owner was not home but I spoke to the cousin of the owner's wife, who was replacing hardwood flooring
upstairs. We walked around the property and Tim checked for evidence of septic failure as was reported.
Tim advised me that he will research the septic records when he returns to the office. The bulkhead has
been replaced with a doghouse entrance,and a separate drive was noted to this rear entrance from Uncle
Willies. 1 advised the cousin that I must speak to the owner today or tomorrow or otherwise I must issue
citations each day in the amount of$100.00. 1 left my business card with him. He assured me that the
owner would contact me today. Arrangements have been made for the owner to come into the office
tomorrow morning. (9/6/12).
26 Pine Grove
A stop work was issued for new windows. I arranged an inspection to confirm whether or hot there is still
a zoning violation before a permit is issued. At the counter yesterday the owner assured me it is a SF
home, it is vacant and claims he intends to move in himself. I was surprised to hear this so l questioned j
his intention to relocate from Dolphin Lane to.Pine Grove and he once again declared that was in fact his
Intention. When we arrived this morning I found the downstairs center entrance to a Cape style home
opens to a stairway and,keyed locked door on the left. This unit is being renovated. There was no kitchen
-all cabinets and appliances were removed. The unit was being painted. Multiple keyed locks were piled
in the rear first floor bedroom. The interior basement door was locked and the owner was unable to open it- it was noted to be unusually secured -extra precautions to keep the door locked. The two rooms at
the top of the stairs were also locked. He had no keys for the two bedrooms on the second floor and at
that time admitted that they were occupied -allegedly by his"girlfriend" in room and a"distant relative" in
the other. We walked,around the property to the rear entrance. A door opened into a small alcove with

two doors-one on the right and one on the left. He was unable to access either space but also admitted the
space was occupied. He argued that the property is a single family home and everybody in residence is related
to him but his girlfriend. At this point I simply advised that he could argue his position before a judge because the
property is clearly not a SF; no interior access to a (now removed)common kitchen, keyed deadbolts on all doors,
not owner occupied and the same story he always presents. I did not see any smoke detectors in the area under
construction -unable to confirm the provisions in the secured areas.

HI,
I got a complaint from a condo owner concerning Unit 6NE at Cape Crossroads. The caller claims the
owner/residents of this unit segregated the master bedroom with a wall and.rents it out as a studio
apartment. The tenants use the slider as the the only means of entry. The caller stated this use has
been going on for quite sometime but now they are really fed up with the volume of cigarette butts being
thrown outside by the tenants as well as the level of noise. They cited concerned about the fire hazard
and complained about the additional effort it takes to keep the area clean and attractive.
would suggest that we all go together very soon. Please let me know when you are available. I am
unsure the weather will be cooperating this week but I am open on both Thursday and Friday afternoons.
