Massachusetts General Laws chapter 152 section 25 requires all employers to provide workers' compensa'd for th--
employees. As quoted from the 'law",an employee is defined as every person in the service of another under any cc=—
of hire, w•cpress or implied, oral or written.
An employer is defined as an individual partnership, association, corporation or other legal entity, or any two or more or
the-foregoing engaged in a joint enterprise, and including the legal representatives of a deceased emplover, or the rec., 'e:
trustee of as individual,partnership, association or other legal cmity, employing employees. However the owner of a
dwelling house having not more than three apartments and who resides therein,or the occupant of the dwelling house of
another who employs persons to do maiaaeaaace, construction or repair work as such dwelling house or on the=nmas or
building appurtenant thereto shall not because of such employment be deemed to be an employer.
MGL chapter 152 section 25 also states that every state or local.Hcensing agency shall withhold the issuance or renewal
of a license or permit to operate a business or to construct buildings in the commonwealth for any applicant who has
not produced acceptable evidence of compliance with the insurance coverage required. Additionally,aePrthe

time these buildings were built the deck railings did meet code requirements. If in the
future it becomes necessary to replace or rebuild these porches/decks,then the new work
would need to meet the present-day codes for deck railings. In the future, if we can be of

This note persuant to our telephone conversation July 15, 1992 regarding the Cape
Crossroads Condominiums on Bearse's Way in Hyannis, Massachusetts,

On August 15, 1991, your office was the recipient of a letter from-Cape Cross-
roads Condominium Trust's Attorney responding to your July 30, 1991 letter.
In the letter of August 15, 1991, a sp.ecific was indicated regarding Mr. Dumont,
the General Manager of Cape Crossroads Condominium Trust, contacting you relative
to the progress and repairs taking place at Cape Crossroads Condominiums -and
advising you of same.
It has come to my attention that the contractor at the time, Mr. King, was termin-
ated on June S, 1992, and to the best of my knowledge, a new contractor has yet
to be hired.
. At a Board of Trustees meeting held in June 1992 a

King, stated that Mr. King 's work was inferior, was not up to code, and would not
be acceptable to the Town Building Inspectors,

regarding the specifics of the deck and stairwell difficulties that sill exist at
Cape Crossroads?
