Dear Mr. Bearse:
In response to your letter of July 30, 1 991 , please be advised that
I represent Cape Crossroads Condominium Trust.
My clients have always acted responsibly with respect to the
maintenance of the complex and specifically to any problems which
have been addressed to them through. you.
Unfortunately, in the Patterson matter, we have been barraged with
a series of nit-picking, vociferous, constant and persistent
complaints, which in our view, do not relate to our high standards
which are maintained in the maintenance program* Rather, it is a
personal matter between .Mr*. Patterson and the Members of Board of
Trustees.
In specific response to your letter, the Board of Trustees will
continue to work with you to correct any building code violations
which may exist. We are aware of the constant communications to
your office , which also may have contributed to your letter of July
30, 1 991 .
Notwithstanding, the issue with the Board of Trustees as always,
will be the proper maintenance and repair of the complex,
notwithstanding Mr. Patterson' s distractions.

805.1 Obstructions: It shall be unlawful to obstruct, or reduce in any-manner, the'.`-'.... '--

by the provisions of this code. { a 0 r
805.2 Maintenance: All required means of egress components shall af'all times
be maintained in a safe usable condition. AN exterior stairways, fire escapes;egress,,,
balconies and bridges shall be kept free of snow and ice. All corrodible`structural
parts thereof shall be kept painted,or otherwise protected against rust and corrosion
both before and after erection. All wood structural members shall be maintained to -:
prevent rotting and decaying. Where these elements tie directly intolhe building iA
structural system, all joints shall be sealed to prevent water from damaging for i
1 corroding the structural elements. � �

805.3 Testing and certification: All exterior bridges, steel or woo den'stairways,
fire escapes and egress balconies shall be examined and/or tested, and certified for
structural adequacy and safety every five (5) years, by a Massachusetts Registered '::,
Professional Engineer,or others qualified and acceptable to the building official,who
shall then submit an affidavit to the building official.
SECTION 806.0 OCCUPANT LOAD
806.1 Design occupant load: In determining required facilities;' the number of
occupants, for whom exit facilities shall be provided shall be established by�the
largest number computed in accordance with each of Sections 806.1.1 through
806.1.3.
6.1.1 Actual number: The actual number of occupants for which eacl 'occupied j
space, floor, or building is designed.
806.1.2 Number by Table 806: The number of occupants computed at the'rate'of
one occupant per unit of area as prescribed in Table 806.
806.1.3 Number by combination: The number of occupants of any space::as
computed;in Sections 806.1.1 or 806.1.2 plus the number of occupants similarly
computed'for all spaces that discharge through the space in order to gain.access to
an exit.

comprised in the trust property, and for that purpose to give
proxies, to any person or persons or to one or more of their
number, to vote, waive any notice or otherwise act in respect

�Iothers in any cases where they shall deem that it is to the
advantage of this trust that t give such guaranty; 4
(xii) To maintain such offices and other places of
business as they shall deem necessary or proper and to engage

cleaning and other services to owners of Units in the Condo-
minium;

Condominium as shall be reasonably necessary to the performance
and exercise of the dutit-s, obligations, rights and powers of
the Trustees hereunder;
(xv) To employ, .appoint and remove such agents, managers,
officers, board of managers, brokers, employees, servants,
assistants and counsel (which counsel may be a firm of which
one or more of the Trustees are members) as they shall deem
proper, for the purchase, sale or management of the trust
property, or any part or parts thereof, or for conducting the
business of the trust and may define their respective duties
and fix and pay their compensation and the Trustees shall
not be answerable for the acts and defaults of any such person.
The Trustees may delegate to any such agent, manager, officer,
board, broker, employee, servant, assistant or counsel any or
all of their powers (including discretionary power, except

Dear Ms. Kaposi and Trustees of Cape Crossroads:
I wish to bring to your attention a situation of concern to me for the safety of my tenant and others .
who may be using the common deck area off of unit IWD. In a recent visit to the property,
noticed rotten supporting structure clearly visible in the corner area under the decking.,. As this
appears to me to be a key support to the structure of the deck, I am concerned that someone :: fz
may be hurt in the event of the deck structure not being secure. Please inspect the deck`a' its hd
supporting structure and inform me of your findings. I am forwarding a copy of this letter to the
building inspector so that any question of the safety on my tenant or others may be carefully .
examined.

have enclosed a copy of a letter I have forwarded to Ms. Mary Kaposi, Chairperson of the Cape
Crossroads Condo Trust. In this letter I have brought to the Board's attention my concern for the
safety of my tenant and others using the common area of decking in front of Unit 1WD:
In a recent visit to the property, I noticed rotted wood in the support structure of the.deck. f This
rotted wood appears to me to be a safety hazard. As owner of the unit IWD which is a leased
property, I am concerned for the safety of my tenant and others in this common area.
Please'advise me as to the safety of this structure and your recommendations as to its required
repair. .<,

Dear Mr. Bearse:
I represent James Patterson who is the owner of Unit 3SC at the
Cape Crossroads Condominiums. Mr. Patterson has previously been in
contact with you and with Joseph Deluz with regard to a deck on his
property at Unit 3SC at the Cape Crossroads Condominiums, 800
Beacses Way, Hyannis, Massachusetts. Mr. Patterson fears that the
,deck which is part of the exterior of the building and is the
responsibility of the Cape Crossroads Condominium Trust. to maintain
is unsafe. He has reported this condition to the Condominium Trust
and also to the Town in an attempt to get the Condominium Trust to
take some action to fix the deck. He is very fearful that the
Condominium Trust is not fulfilling its responsibility to him and
to the Town of Barnstable by allowing this condition to continue.
Could you please follow up on this by sending out the letter which
you mentioned that you would send so►►►e months ago. Mr. Patterson
have been in contact with your office on numerous occasions in an
attempt to obtain from the Town a commitment to send out a letter
to the Condominium Trust to take care of' this problem.
He has asked me to follow up since he has not had any success with
either the Condominium Trust or with the Town. Please let me know
what the status of this is at your earliest possible convenience.

Dear Mr. Dumont:
I represent James Patterson who is the owner of Unit 3SC at the
Cape Crossroads Condominiums. Mr. Pattecson has been in touch with
you but has not been able to receive any satisfactory commitment
from the Condominium Association to repair the deck on Unit 3SC.
This condition could possibly constitute a dangerous condition and
could lead to the injury of some person. Mc.. Patterson has
reported this potentially dangerous condition to you and has
-requested that the Condominium Association repair the deck properly
so that the dangerous condition will be ended.
Please be advised that your failure to follow up on Mc. Patterson 's
repeated requests that his deck be repaired may constitute an
assumption of liability on the pact of the Cape Crossroads
Condominium Trust if any person is harmed as a result of the
potentially dangerous condition in 3SC ' s deck.
I 'must therefore demand that the deck repair be done forthwith. I
further inform you that any liability for any injury sustained by
any person as a result of the deck at Unit 3SC shall not be assumed
by Mr. Pattecson and is the responsibility of the Cape Crossroads
Comdominium Trust.

This letter is in reference to the deck at unit 3SC, 800 Bearses
Way, Hyannis, owned by Mr. James Patterson.
Earlier this year I met with you re the condition of the deck. At
that time we discussed a method of making temporary repairs. The temporary
repairs were made. However, as I recall, permanent repairs were to be made
in the near future. The owner has advised me that as of this date the re-
pairs have not been made.
It is imperative that permanent repairs be made to the floor joists
and decking. Contact this office within seven (7) days of receipt of
this letter with a schedule for repairs.

I have enclosed a copy of a letter I have forwarded to Ms. Mary Kaposi, Chairperson of the Cape
Crossroads Condo Trust. In this letter I have brought to the Board's attention my concern for the
safety of my tenant and others using the common area of decking in front of Unit 1 WD.
In a recent visit to the property, I noticed rotted wood in the support structure of the deck. This
rotted wood appears to me to be a safety hazard. As owner of the unit IWD which is a leased
property, I am concerned for the safety of my tenant and others in this common area.
Please advise me as to the safety of this structure and your recommendations as to its required
repair.

I wish to bring to your attention a situation of concern to me for the safety of my tenant and others
who may be using the common deck area off of unit IWD. In a recent visit to the property,I
noticed rotten supporting structure clearly visible in the comer area under the decking. As this
appears to me to be a key support to the structure of the deck, I am concerned that someone
may be hurt in the event of the deck structure not being secure. Please inspect the deck and its
supporting structure and inform me of your findings. I am forwarding a copy of this letter to the
building inspector so that any question of the safety on my tenant or others may be carefully
examined.
