The first issue is the exits off of the decks. These decks have had doorways installed,evidently to afford some privacy. The problem with this is that these doors are blocking the necessary egress from the decks. Section 1006.2.1 provides that an exit access shall not pass through an area subject to locking. These doors have in cases had dead bolts and other types of locks installed and also the direction of the swing on these doors inhibits the flow of egress. If these doors were to be reversed the the direction of the swing would be better but the doors would then be swinging into the passageways served by the other units and would end up blocking the exit ways. Therefore,I am directing that the deck doors be removed from the building that is now being reconstructed and that the deck doors on the remaining buildings be removed by November 12,2002. The second issue that has surfaced is the way the fans are being vented in the unit bathrooms. 780 CMR, the state building code,section 1205.2.1 requires that bathrooms be vented to the exterior of the building. Certain of the second-floor and third-floor Units shall have appurtenant thereto the right and easement of passage in common with an adjoining Unit as to certain portions of the deck designated with the numbers of both such Units on the Plans, subject to and in accordance with the provisions and requirements of Sections 7 and 8 hereof.
