The Commission did not issue a typical DRl decision for the project;the decision issued in the form of a certificate (copy attached);and determined that there is no DRI jurisdiction over the project or any continuing DRI jurisdiction over the project site. There are two conditions in the decision dealing with an affordable housing payment to the town and the applicant's trip reduction program; it was the Commission's intent in the decision that town officials,in their discretion and through the town permitting process,determine whether those conditions, among others the town may have imposed in its permitting, have been satisfied prior to occupancy. Existing signs and pavement markings at the intersections will be reviewed, upgraded and/or replaced, to include the installation of advance lane use markings and accompanying sign on the Enterprise Road approach to Route 132; 2. Traffic signal timing and clearance times will be review and adjusted as necessary; 3. Traffic signal indications will be cleaned, relamped and adjusted as may be required in order to improve the visibility of the signal indications; 4. Reflectorized tape.will be added to the perimeter of backplates in order to enhance the visibility of the signal indications;and 5. The vehicle detection system will be tested and repaired/replaced or adjusted as necessary. The Applicant will complete these improvements prior to the issuance of a Certificate of Occupancy for the Project and subject to receipt of all necessary rights,permits and approvals. In addition, at the request of the Cape Cod Commission, the Applicant will escrow$5,000 for use by the Town in conducting a Roadway Safety Audit(RSA)for the intersection of Route 132 at Enterprise Road. TRAFFIC OPERATIONS EVIPROVEMENTS($15,000), The Applicant will escrow$15,000 for use by the Town to implement traffic signal timing changes at the intersections of Route 132 at Bearses Way and Route 132 at Enterprise Road and Independence Drive in order to reduced motorist delays and velucle queueing that may be associated with the Project. With implementation of the traffic signal timing changes,_the resulting betterments were achieved as documented in the September 2015 Transportation Impact Assessment for 2022 Build with Mitigation conditions: Route 132 at Bearsess Way: Average-Month Conditions: Overall LOS C operating conditions maintained during the weekday Morning,weekday evening and Saturday midday peak hours. Enterprise Road/Cape Cod Mall Driveway: Reconstruct wheelchair ramps for crossing Enterprise Road consistent with ADA accessibility standards; install crosswalk pavement markings; install pedestrian crossing warning signs. TRIP REDUCTION MEASURES(INCLUDED IN OPERATION COSTS) In an effort to reduce the overall volume of traffic that is expected to be generated by the Project and to encourage use of alternative modes of transportation to single-occupant vehicles, the Applicant will implement the following trip reduction measures subject to corporate policies: • A transportation coordinator will be assigned to coordinate the traffic reduction program for the Project. A "commuting alternatives packet" will be made available to employees detailing available public transportation services, bicycle and walking alternatives, and commuter options available through MassRIDES' and their NuRide program which rewards individuals that choose to walk, bicycle, carpool, vanpool or that use public transportation to travel to and from work, and the RTA. • A guaranteed-ride-home program will be offered to employees that car/vanpool, walk or bicycle to work for emergencies that may arise during the workday. • Direct deposit of employee payroll checks will be offered. • Employees.will be provided with a free meal for each shift that they work. • Sidewalks will be provided within the Project site that will link the proposed building to the sidewalk infrastructure along Route 132 and Enterprise Road. • Lighting will be provided within the Project site and around the building perimeter to provide a safe an inviting pedestrian environment. Tentative Event Date: November 9th ; Event Time: 6 a.m. November 9th - 6 p.m. Guests may arrive no earlier than 6 a.m. to register to be a part of the First 100 We will register guests up until we reach 100 participants. We will register 10 alternates who move into the 100 spaces should anyone drop out or become disqualified. If we have over 100 hopefuls at 6 a.m. on November 9th we will do a drawing for the 100 spots.They will still have to remain on the property for the remainder of the event if selected. Guests will be allowed to use the restroom at Chick-fil-A. They will be fed breakfast, lunch,land dinner inside the restaurant while a part of the event. Games will be played to keep the group entertained in the morning and afternoon. Security will be provided for the duration of the event by the Barnstable Police Department from 6 a.m. until 6 p.m. on November 9th. Chick-fil-A representatives will be present during the entirety of the event. The Grand Opening of the new Chick-fil-A will be at 6:30 a.m. the following day, November loth. Cape Cod Mall (owned by Simon) has allowed us to use the lot adjacent to Chick-fil-A for parking for the First 100 participants. Once their cars are parked they will not go back and forth. The security officer will patrol the parking lot. This is the only spot the participants will be allowed to park. I have included our Grand Opening Market Strategy for the new restaurant.This includes a breakdown of the events we are planning to execute leading up to our Grand Opening day. The transformer had been fully installed and was on the ground at,the time of our meeting (which was one of your questions). I will also be sending you a separate letter from the contractor and site engineers which addresses the timing for completion of the traffic/road work (set out in the conditions of the ZBA Special Permit) we discussed for obtaining a temporary CO if needed. In my discussions with them it sounds as though they anticipate all work is projected to be completed by November. I anticipate having this in the next day or so and will send it along as soon as I receive it. In terms of your concerns with the transformer and sidewalk area we have done the following: 1. You were concerned that the transformer was encroaching into the sidewalk area (used only by an Employee at the drive thru as discussed) which resulted in a safety hazard. Your recommendation was if this was in fact the case and the transformer had been installed, you recommended that we remove that portion of the sidewalk in that area, as the rear sidewalk created safe connection without having to go in front of the transformer. This has been completed and is currently on the ground in this new configuration. I have attached a copy of a recent photo showing this has been completed. It is also reflected on the revised site plan attached as well. 2. Secondly, you were concerned that the bollards previously on the plan had been removed. These have been added back on the plan which was an oversight. 5 individual bollards have been installed and are currently on the ground. These can be seen protecting the transformer in the picture attached and on the revised site plan attached. Please let me know if you will need any additional information and if this sufficiently addresses your concerns. If so, I will deliver a full size set of the plans to your office for the file.
