Description of Work: The Tales of Cape Cod (TCC) is a non-profit organization that owns the Olde Colonial Courthouse building at the corner of Rendezvous Lane and Main Street in Barnstable Village, MA. TCC uses the building for many educational programs including a summer lecture series that focuses on the history of Cape Cod, as well as Historic Re- enactments. These programs are the only source of income for.TCC other than fundraising and rent from the second floor residence (second floor apartment). In 2018, the Tales of Cape Cod began a multi-phase project that focuses on the repair and maintenance of the historic building, as well as renovations and proposed building addition intended to improve handicapped accessibility. TCC hired Brown Lindquist Fenuccio & Raber Architects to study the use of the building and provide budget pricing for proposed renovations. The study was completed by BLFR in late 2019. TCC also worked with a fundraising consultant on a feasibility study to determine their fund raising capacity. TCC has begun a capital fundraising campaign. Funding for Phase 1 was a combination of the Massachusetts Preservation Projects Fund, and local Town of Barnstable Community Preservation Act Funds. A Preservation Restriction was placed on the building prior to releasing funding for Phase 1 work. Any changes to the existing building interior and exterior must for approved by the Massachusetts Historic Commission and must follow the Secretary of the Interiors Standards for.Rehabilitation. TCC applied for and received Massachusetts Preservation Projects Fund Emergency Funds for Phase 2, they are working with the local Community Preservation Committee to obtain funds for the remainder. The structural repair work must be completed in order for the TCC to use the building for assembly purposes, including the summer lecture series which is a,large portion of TCC's annual income. The structural work must be done to continue use of the building for the programs that TCC is known for. Based on the fundraising feasibility study, TCC estimates it will take 5 years to fundraise for the largest phase of the project (Phase 3) which will include most of the handicapped accessibility improvements. During the Baptist Society's ownership of the building, the parish undertook significant renovations to the building including: o. Moving main entrance to the west elevation (Rendezvous Lane). o Spire roof at new main entrance. o Balcony at west end of building within the sanctuary. o Replacement of existing windows with-colored stained glass windows. o Parish House, Lady's Parlor at second floor, and Bell Tower additions. • 1972— Present owned by Tales of Cape Cod. Tales of Cape Codas a non-profit organization that specializes in educating members and the public on Cape Cod history. They host a lecture series in the summer, with additional special lectures in the fall. In addition they educate school children on local historic events, and host historical re-enactments. These programs take place in the main assembly and meeting room spaces within the building. The Historic Building sitting on the corner of Main Street(Route 6A) and Rendezvous Lane acts as a gateway to Barnstable.Village. Renovated in 1905 by the Third Baptist Church in the Gothic Revival Style, it appears today much as it did in 1905. The original main gabled massing houses the assembly space with coved vaulted plaster ceiling. The original main entrance to the church is on the west end of this portion of the building facing Rendezvous Lane. A secondary two story gabled massing (ell) was added in 1905 to the east end of the main original building massing. At the same time a bell tower and steeple were added at the intersection of the original building and the ell. The exterior is clad with painted clapboard siding on the West, South, and East facades, with wood shingle siding on the North fagade. Large double-hung wood, colored/stained textured glass windows installed in during the 1905 renovation are located in the assemblyspace, balcony, and parish hall. The interior of the assembly space includes plaster clad walls and vaulted double height ceiling. The existing stage appears to be a modification of an earlier stage, there are differing railings, and several levels which are difficult to navigate. A large opening in the south wall of the assembly space has a multi-leaf, wood paneled folding door. This enables flexibility to open the former Parish Hall (now known as Meeting Space)to the assembly space to provide additional seating. The Meeting Space has a non-original acoustic.tile ceiling with surface mounted fluorescent lighting, and custom natural wood cabinets along the east wall. During this renovation, the windows on the east wall were covered with cabinetry. The bell tower provides stair to the second floor former Lady's Parlor that has been renovated as a residence/apartment, the studio style apartment houses one tenant/occupant. The stair appears to be original to the 1905 renovation. A small (non- accessible)single user toilet room was added below the stair, it has been designated as the women's room. My Code Analysis on that subject is as follows: Since the area of the second floor that would be used as a gymnasium, including adjacent seating and standing areas, is less than 750 S.F.,the Use is Group B. I have applied a ratio of 15 S.F. per person for the space, which I believe is the most restrictive given the area required for exercise bicycles, gym mats, etc. The actual area of the entire space is 620 S.F. so the maximum Occupancy Load for the second floor, adding another person for the office, is 43. Since the Occupancy is less than 50 a second means of egress is not required. , It is therefore my opinion that if the variance is granted from the A.A.B. and no lift is required, that Ms. Jones should be allowed to resume the use of the second floor for the same classes that she was offering,which again, are identical to classes also offered on the first floor. Building Code; The 2015 International Building Code (henceforth referred to as "IBC ; The Mass- achusetts Amendments to the International 'Building Code 2015 Basic/ Commercial-Ninth;Edition:(henceforth referred to as "MA') and 52.1 CMR, (Code of-Massachusetts:Regulations) Regulations of the Architectural.Ac cess Board. These codes were compiled by the Commonwealth as in full force and effect.on 10/20/2017. . The Existing Building Code, ;in this case, categorizes the renovation work to be made to this,building as "Alterations - Level 2". The significance here is that the designer must defer to the IBC, MA and 521.CMR in.mak- ing determinations with regard to accessibility,and toilet room require- ments. The IBC is some 700 pages long, includes 35 chapters plus appendices and further includes hundreds of explanatory subsections, each num- bered for reference.. The MA makes replacements or. revisions to these subsections where .it,'deerns that the specific concerns of Massachusetts are different from those of the IBC. It is important to note that the MA draws, a distinction between those which are 'to be, "replaced" and those which are to be .revised". t 1 of 3 The first job of a designer is to determine the "Use and Occupancy Clas= sification" of the proposed work. In this case I have been told that the proposed use is to be that of a gymnasium. Checking the IBC, specifically subsection 303.4 Assembly Group A-3, one .fi.nds that Gymnasiums (without spectator seating) are precisely listed here. Checking the MA to determine if the Commonwealth has issue with this classification, one finds that there is no amendment to this section. Therefore the use clas- sification is set and determined to. be as originally stated "Assembly; A-3, Gymnasium". Please note that 248 CMR (Code of Massachusetts Regula- tion, [Plumbing Code]) does not determine use. If the MA wanted to change the use,. it would have done so by amendment to subsection 303.4. Also note that subsection 303.6 Assembly A=5 specifically "includes as- sembly uses intended for participation in or viewing outdoor activities in- cluding, but not limited to: Amusement. park structures, Bleachers Grandstands, Stadiums" The proposed gymnasium is clearly not an A-5 use. Chapter 29 -of the IBC speaks to Plumbing Systems. Here is where the difference between "replace" and "revise" come into play. If the 'MA in-. tended to replace the entire section with 248 CMR it would have so stat- ed. For example, "Chapter 28: Mechanical Systems is such an instance where "scope" is 'cited for."replacement" and the designer is instructed to reference various other. codes. Thus one will find that no further amendments are offered: The designer is to simply follow the dictates.of the replacement. This is not the case for Chapter. 29.. There is a "revision" to subsection 2901.1. and there are no further revisions to the chapter. if there were further revisions the MA would so state. For. example, "Chapter 27: Electrical" also "revises" ,scope but goes on to amend additional subsec- tions to the code. - So, back.to. Section 29. The,revision to the subsection: "2901.1 Scope addresses :construction and desires that the construction of plumbing systems;be determined, by 248 CMR.- For example: Pipe sizes, materials configuration and the like.
