Sincerely, Building Inspection Department Giangregorio, Robin From: Traczyk,Art Sent: Friday, October 26, 2001 9:37 AM To: Giangregorio, Robin; DiMatteo Peter ZV Subject: Hides N' Seats- Leather furniture store-276 Rt. 28 Peter, Robin: I have reviewed information related to the above store and its location in 3,800 sq.ft. of the 22,500+/-sq.ft. retail &storage building at 276 Route 28- Bornstein's Building. Although I do not agree with the previous Building Commissioner's evaluation and conclusion to permit the redevelopment as-of-right, the fact is that the structure is there. The building permit was issued with the parking calculations that approximately 1/3 of the space for storage, 2/3 for retail (less a few sq.ft. for office). The applicant seeking to locate within -Peter L. Pepper-discussed the proposal with me. As noted tome, he would use 1/3.of his space for storage- keeping with the approximate overall building use ratios. My recommendation would be to permit this building to be occupied as-of-right provided the ratios of storage to retail are maintained. This is a specialty furniture store and traffic should not be of concern. I have communicated this recommendation to Ron Jansson,ZBA Chairman, and he concurs with my thinking that the building is there and tenants should not be held accountable for the developer's past issues. It should be noted that if this decision should be appealed the Board would then handle it. (My impressions of the Board members are that many felt that the redevelopment should have secured a Conditional Use Permit and an Expansion of a Non-conforming Structure special permit.) art 1 6A �FIKE lq,. I advised you during our telephone discussion earlier this month that according to Mr. Burgmann,the sewer lines are now scheduled to be installed on the opposite side of Route 28. All reasonable attempts to avoid the disruption of your property shall be made. In fact,Mr. Burgmann indicated that the connection could be designed to meet at the site access with little disturbance. It is my sincere desire that you meet with Mr. Burgmann in order to resolve this matter to the satisfaction of both the town and yourself. I would be happy to assist you in any manner necessary in order to facilitate the required landscaping and close the corresponding Site Plan Review file.
