Dear Mr. Andres:
Thank you for your time and cooperation during your annual hazardous materials inventory and
site visit on July 12,2004. This letter contains information'from that visit that will help the Town
of Barnstable Highway Division become compliant with Article 39 of the Town of Barnstable
Ordinance: The Control of Toxic and Hazardous Materials. Enclosed is a copy of the Toxic and
Hazardous Materials On-Site Inventory form from your site visit. Please note the problems and
their corresponding-orders/recommendations listed below:
Problem:
Approximately 225 gallons of liquid calcium chlorite is stored in a large plastic tank outdoors
with no secondary containment of up to 110%,no roof to protect this item from the elements, and
an unlocked valve with unmonitored accessibility. There are no nearby provisions to contain an
accidental release.
Order:
Please comply with the Town of Barnstable Ordinance: Article 39, Section 5-1 and 5-2 (copy
enclosed)which states that all hazardous materials stored outside must have 110%containment
and a roof to conceal them from the elements,leakage, accidental damage and vandalism. (Note.
no less than 20 feet away from this tank are the trucks that were burned by vandals over the 4`h of
July holiday weekend). A lock out/tag out system is recommended for the valve on this tank.
Spill response equipment must be made available near this tank. If the protection described
cannot be provided,the tank must be moved indoors immediately. When stored indoors,the tank
must be placed.on an impervious surface (concrete floor), away from any open drains.
Problem:
Full hazardous material barrels(asphalt emulsion)are stored outside with no secondary
containment of up to 110%and no roof to protect these items from the elements.
Order:
All hazardous materials and wastes stored outside must have 110%containment and a roof to
conceal them from the elements,leakage, accidental damage and vandalism. If this type of
protection cannot be provided,they must be moved indoors immediately. When stored indoors,
they must be placed on an impervious surface(concrete floor),away from any open drains.

Problem:
There is a small gear oil/water spill under the air compressor in the hazardous materials/waste
storage room. There is a large motor oil/water puddle under a front end loader vehicle in a
separate shop. Accidental spills and discharges of petroleum products("releases")onto the
ground violate Article 39: Control of Toxic and Hazardous Materials.
Order:
Provisions must be made to contain and clean up these releases. There is a spill response kit in
this same room as the spill by the air compressor. it should be put to use when a spill of this
nature(2 feet in diameter)has occurred. Spill pads were used during the inspection to soak up
the oil/water spill under the loader. This puddle should be completely contained and soaked up,
and the absorbent material should be disposed of properly(i.e. as hazardous waste).
Problem:
Open buckets that are full of used oil and antifreeze are being left on the shop floor. Leaving
open spill pans and buckets on the floor or among shop clutter can cause an accidental hazardous
waste release or spill.
I Order:
Please instruct your staff to empty all hazardous waste accumulation pans/containers directly into
holding tanks and barrels. Do not store these on the floor or on top of the holding tanks and
barrels. Antifreeze is especially toxic and can cause irreversible health problems or death;
therefore,it should be handled properly and with extreme caution.
Problem:
The hazardous material/waste storage room floor has accumulated numerous stains and residue.
This is not from water spills,but from petroleum products spilling or being leaked onto the floor...
Order:
Please instruct your staff to use spill catchment/containment pans and to empty them immediately
into proper hazardous waste storage containers. Use more absorbent in addition to secondary
containment when draining fluids from vehicles. Use caution when accessing this storage room.
Keep the room clear of clutter(hand trucks,buckets,etc.)and organized.
Problem:
The hazardous waste drums in the hazardous material/waste storage room do not indicate the
level of health hazard they can have.
Order:
Please label ALL hazardous waste containers,barrels and tanks,"TOXIC"and"HAZARDOUS
WASTE",in addition to the type of waste contained.
Problem:
There is a large plastic bag of shop rags and numerous other shop rags scattered throughout the
fleet maintenance shop at the Highway Division. This is a fire hazard and a serious safety issue,
particularly if there is any smoking in the shop area.
Order:
Used shop rags which contain any petroleum residue must be contained at all times in metal shop
rag cans with metal lids. These rags should be laundered professionally and not disposed of as
solid waste.
The Toxic and Hazardous Materials On-Site Inventory from July 12th shows that you have
approximately 22,066.5 gallons of toxic and hazardous materials being used,stored, generated
and disposed of at the Town of Barnstable Highway Division maintenance/storage shops.
The,Board of Health has determined that the using,storing, generating and disposing of over 111
gallons of hazardous materials per month requires businesses and municipal facilities in the Town
of Barnstable to obtain an annual license/permit. The Highway Division's permit for fiscal year
2004-2005 should be purchased within the next 30 days. Please refer to the enclosed license
application for more information on how and where to purchase a license.
Why are these recommendations being made for Highway Division?
• This information is intended to educate-you,a facility operator in the Town of
Barnstable,in order to keep your operation in compliance with local,state and federal
toxic and hazardous materials laws so that you can avoid future regulatory,legal and
possibly,financial problems.
0 Complying with the Control of Toxic and Hazardous Materials ordinance(Article 39)can
prevent contamination of Barnstable's existing and future drinking water supply and
prevent environmental contamination which can bankrupt site owners,lower or destroy
land values, drive out residents and industry,depress local economies and endanger
public health.
As a follow up to the site visit and inventory completed on July 12,2004,a representative from
the Public Health Division will re-visit your business during;the next thirty days to further advise
you on your compliance and what is required to pass your annual inspection. If you have any
questions about these problems and/or their recommendations,or you need further information,
please do not hesitate to contact me at the Public Health Division.

flashing, or other carpentry net ding replacement will be done and charged for as an extra at the
rate of$110.00 per hour, plus 0%mark-up materials.
Possible Extra—If ice&wate is found on current roof sheathing-removal of plywood will be
needed as the existing ice &water cannot be removed.Due to its melting to plywood.Price is
time and material at the rate o $110.00 per hour,plus 20%mark-up materials.
Any deviation or alteration fron above specification will be executed upon written orders and
will become an extra charge o er and above the estimate. All agreements contingent upon
strikes, accidents or delays are beyond our control. Owner should carry fire,tornado and other
