Dear Mr. Perry: .
This office represents the assessed owner,John Otis Drew, in connection with a pending petition to
partition the above parcel by sale in the Barnstable Probate Court docket no. BA14E0029PP1. A
commissioner has been appointed by the Court to sell the parcel.and the commissioner has entered
into a purchase and sale agreement to sell the property.
The purchaser under the agreement has inquired about the ability to construct a single family
residence on the property and has asked for a zoning opinion.
The parcel was once part of a larger woodlot parcel which was bisected by the 1932 taking of Route
28.That portion of the parcel lying to the north of Route 28 was taken by the Town of Barnstable for
the sewer beds.
Enclosed is a portion of Assessors'Map 271 showing the parcel. Although there is no plan of record
of the parcel, it appears from the 1932 taking of Route 28 that it has frontage of approximately 1.48
feet,copy of taking plan enclosed,and frontage of.approximately 245 feet on Pitcher's way
according to the Assessors records.

The parcel lies in an RB residential zoning district in which a single family residential dwelling is an
allowed use,exceeds the minimum,width,frontage and area bulk requirements and, if the proposed
dwelling is sited to meet the minimum yard setbacks and complies with the maximum height
requirement, it is my opinion that a single family dwelling may be constructed and used thereon as a `
matter of right without need for any zoning relief.
