The property is shown on Assessor's Map 250,Parcel 004, and is commonly addressed as 1047 Falmouth Rd.,Hyannis,MA in a Residential D-1 Zoning District. Appeal 2001-130-AT&T Wireless PCS,LLC,d/b/a/AT&T Wireless Services has applied to the Zoning Board of. Appeals for a Special Permit in accordance with Section 4-4.4,Non-conforming Buildings and.MGL Chapter 40A, Section 6,Pre-existing Non-conforming,and/or any and all necessary zoning relief to co-locate and operate its wireless communication facilities on and next to an existing Sprint Spectrum,LP monopole. The property is shown on Assessor's Map 250,Parcel 004,and is commonly addressed as 1047 Falmouth Rd.,Hyannis,MA in a Residential D-1 Zoning District. Background: The applications before the Board seek to co-locate communication antennas and equipment on an existing monopole tower. The tower is located along Route 28 on property commonly referred to as the"Child's Building". In appeals 2001 —129 and 130,the applicant is seeking multitude of possible relief to accomplish the proposal. Variance 2000-31 authorized the existing 120-foot tower. That permit was issued to Sprint Spectrum,LP on March 29,2000, and authorized the replacement of a 115-foot communication tower with the 120-foot monopole. In that decision, the Board imposed 8 conditions, three of which would need to be modified if the applicant were to locate on the monopole. They are: "L The property shall be developed in accordance with the approved site plan titled"Sprint Spectrum, LP Site I.D.#BS13XC661B4 Associated Alarm System 1047 Falmouth Road Hyannis,MA 02601", prepared by.Clough,Harbour&Associates LLP and dated March,2000. "6. There shall be no further development of the subject property without Zoning Board of Appeals, Board of Health, and Site Plan Review approval. Planning Division-Staff Report "8. There shall be no more than nine (9) antennas from Sprint Spectrum,LLP and two whip antennas which is in accordance with the plan submitted." Appeal 2001-129: In Appeal 2001-129,the applicant is seeking a variance or modification of the existing variance to co-locate on the monopole. In early 2001,the applicant was before the Board in Appeal 2001-19 for identical relief. On July 25,2001 the variance request was not granted by a vote of three to two. On August 28,2001 the applicant appealed the decision of the Board to U.S.District Court and to the Barnstable Superior Court. Those two cases are still pending. Repetitive Petition: Part of the variance request being made is identical relief as Appeal 2001-19. The request for a variance to Section 3-1.1(5) Bulk Regulations and the request for a Modification of Variance 2000-31 would constitute a "Repetitive Petition"under MGL Chapter 40A,Section 16. That section states: "No appeal ... which has been unfavorable and finally acted upon ... shall be acted favorable upon within two years after the date of final unfavorable action unless. [the] permit granting authority finds, by .... a vote of four members of a board of five members, specific any material changes in the conditions upon which the previous unfavorable action was based, and describes such changes in the record of its proceedings, and unless all but one of the members of the planning board consents thereto." In Appeal No. 2001-129,the Board should rule that the request for a variance to Section 3-1.1(5)Bulk Regulations and the Modification of Variance 2000-31 constitutes a repetitive petition. The Board needs to make findings identifying what,if any, specific and material changes in conditions upon which the denial occurred have changed. The Board's finds must be set to the Planning Board for its concurrency and consent to the repetitive petition. The Planning Board is also required to hold a public meeting to takes up the issue.' The repetitive procedure does not apply to,or prohibit, hearing different or alternative forms of relief as requested in Appeal 2001-129.2 Material Changes: The decision of the Board not to grant the variance request in Appeal 2001-19 was due to two negative votes. Those votes were cased in the negative as cited during the hearing and summarized in the decision as follows: "The dissenting members cited that the revised plans received at the July 25 continuance has not been approved by site plan review, that the modification to co-locate more antennas on the monopole would increase the harmful effects of the tower on the neighborhood and represented a substantial detriment to the surrounding neighborhood." 'Note—The Planning Boards actions must be at a public meeting and not a public hearing. Notice of the proceedings must be given by mailing to"parties in interest"as defined in Section 11,however,publication or posting under Section 11 need not be given(Massachusetts Zoning Manual 10-50). z Note-A special permit denial does not preclude variance request within the two-year period-Halko v. Board of Appeals of Billerica, 349 Mass.465,473,209N.E. 2d 323,328(1965). 2 i Planning Division-Staff Report The new plans before the Board today have been approved by Site Plan Review at the October 11,2001 meeting of the Committee. The new plans change the location and mounting of the antennas. The earlier plan proposed to locate 6 antennas on one triangular array mounted an estimated 6 to 7 feet from the poll at an elevation of 88 feet. The new plan proposes two sets of three antennas each mounted flush with the pole. One set is at elevation 84 feet the second set at 91 feet(see attached elevation drawings as a comparison of previous plans to today's plans). The applicant is also proposing to change the fencing around the base equipment from a chain link fence to a stockade fence for increased visual screening. Procedure: The findings of the Board must be transmitted to the Planning Board for concurrence with the findings before the Board can continue to hear the merits of the appeal for a variance. Planning Board hearings are scheduled for November 19 and December 10,2001. Staff would suggest a continuation of this appeal to January of 2002 allowing sufficient time for the Planning Board to respond. Other Relief Request-Appeal 2001-130: With reference to Appeal 2001-130,it is staffs opinion that this appeal, being that of a special permit and differing relief under the Zoning Ordinance, does not constitute a repetitive petition. The Board can proceed with the public hearing on this application. This special permit request was made with reference to MGL Chapter 40A,Section 6—Non-conformities, Section 4-4.4(1)(A) of the Ordinance—Nonconforming Building or Structure, and Section 4-8-Personal Wireless Communication. In the special permit request, assertions are made that no relief is necessary and the installation of the antennas should be permitted as-of-right or at the most by the issuance of a special permit. With reference to Section 4-4.43,and the expansion of a non-conforming building or structure, the applicant is contending that the additional antennas are not intensifying the use of the structure. In this argument,it must be cited that the monopole exists by the issuance of a valid variance and is not a non-conforming structure. Relief under this provision of the Zoning Ordinance does not appear to be available to the applicant. r 3 Copy of Section 4-4.4-Nonconforming Building or Structure Not Used as Single or Two-Family Dwellings: 1)As of:Right: A. The normal and customary repair and maintenance of a pre-existing nonconforming building or structure not used as a single or two-family dwelling is permitted as of right. B. The alteration and expansion of a pre-existing nonconforming building or structure, housing a conforming use,is permitted as of right, provided that the alteration or expansion does not increase or intensify the degree of the pre-existing nonconformity of the building or structure, and that the alteration or expansion conforms in all other respects with all applicable requirements of the Zoning Ordinance. 2)By Special Permit: Alterations or expansions in a pre-existing nonconforming building or structure that do not meet the provisions of Section 4-4.4(l), shall be permitted only by a special permit from the Zoning Board of Appeals. In granting such special permit, the Board must find that the proposed repairs, alterations and/or expansion are not substantially more detrimental to the surrounding neighborhood. If the building or structure houses a nonconforming use,the provisions of Section 4-4.5 shall also apply. 3 Planning Division-Staff Report In consideration for Section 4-8.34-Personal Wireless Communication, the applicant cites that the phase"other than a communications tower" excludes the monopole from the provisions and therefore the location of the antennas should be permitted as-of-right. The phase"other than a communications tower"was included in the drafting of that section in direct response to the overcrowding of equipment on the"Flynn"tower and the unsafe conditions it caused. The phase is specifically excluding communication towers from being added to as-of-right and being overly cluttered with equipment and antennas. Project Staff Review and Comments: State Public Health Approval: The applicant has provided an October 19,2000 letter from The Commonwealth's Department of Public Health,Robert M. Hallisey,Director,Radiation Control Program. That letter approved the proposed communication facility. With that letter, the Board need not concern themselves with issues concerning radiation and health. Site Plan Review: The initial plans submitted in Appeal 2001-19 were before Site Plan Review and found approvable on November 30,2000,with one condition that: "The location of the concrete pad shall maintain a 10 foot setback from all cesspools and leeching fields." The revised plan submitted with todays applications were found approvable by the Site Plan Review Committee on October 11,2061. Special Permit Findings: The granting of a Special Permit requires the following finding of facts to be made by the Board: • that the application falls within a category specifically accepted in the ordinance for a grant of a Special Permit, • that after evaluation of all the evidence presented, the proposal fulfills the spirit and intent of the Zoning Ordinance and would not represent a substantial detriment to the public good or the neighborhood affected. 4 4-8 Personal Wireless Communication: 3. Antennas permitted by Special Permit in all Zoning Districts: Except where permitted as-of-right in paragraph 4 below,in all Zoning Districts,an antenna mounted or located on any existing building or structure other than a communications tower, may be permitted by Special Permit from the Zoning Board of Appeals, provided that no antenna exceeds the height of the existing structure by more than 12 feet, unless the Board finds that additional height is necessary to provide coverage, and the additional height will not be visually intrusive upon the surrounding area. 4. Antennas permitted as-of-right in all zoning district: Q An antenna completely enclosed within an existing structure other than a communications tower, provided that the associated equipment or base transceiver station is located within an underground vault,or within an existing building or addition thereto, other than an equipment or base receiver shelter. D)An antenna located upon the roof of an existing building or structure other than a communications tower, provided that the antenna does not exceed a height of twelve feet, and provided that the equipment shelter is set back from the roof edge a distance equal to the height of the equipment shelter. 4 l Planning Division-Staff Report • that a site plan has been reviewed by the Site Plan Review Committee and found approvable. Variance Findings: In consideration for the Variance, the applicant must substantiate those conditions unique to this lot that justify the granting of the relief being sought. In granting of the Variance the Board must find that: • unique conditions exist that affect the locus but not the zoning district in which it is located, • a literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship, financial.or otherwise to the petitioner, and • the relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of the Zoning Ordinance. Suggested Conditions: If the Board finds to grant relief, they may wish to consider the following: All provisions of Variance 2000-31 shall remain in full effect except that: • Condition 8 shall be stricken and not replaced, • Condition 6 shall remain in effect after the grant of this relief, and • Condition 1 is to read: "The property shall be developed in accordance with the approved site plan entitled,"AT&T—AT&T Wireless HYN153A Sprint Tower-Barnstable," 1047 Fahnouth Road Hyannis,MA,prepared by SFC Engineering Partnership last dated 9/26/01. 5 EXISTINO . Also in attendance: Attorney Doug Wilkins This meeting was called to order at 9:05 AM and adjourned at 9:40 AM SPR 077-01 AT&T Wireless, 1047 Falmouth Rd,Hyannis Attorney Doug Wilkins appeared before the panel seeking approval to attach 6 closely mounted panel antennas to an existing 120' monopole tower with screening and associated electrical equipment on a concrete pad. The applicant is re-applying and has submitted a revised plan. Attorney Wilkins identified the revisions for the benefit of the panel. • Replace the proposed chain link fence with stockade for improved screening per ZBA recommendation. • Reconfiguration of ground equipment. Said equipment shall maintain 10' buffer from septic and leeching areas as indicated previously by the BOH. • Installation shall be closely mounted resulting in a less visually obtrusive array. • Installation of two cabinets reserved for future use. The original proposal reflected a single unit. Doug Bill inquired if the AT&T had secured repetitive application status before the ZBA. He asked Attorney Wilkins that the Planning board was unable to hear the case until this issue had been resolved. Attorney Wilkins acknowledged this. Subsequently, Mr. Bill.asked the applicant to confirm that the installation of this panel will not exceed the 15 total allowed. The applicant advised that 9 (Sprint) are existing and this 6 will achieve the maximum number of 15. Mr. Bill focused on ground equipment the potential impact to the existing parking. `By moving the cabinets (referring to the latest revision)will you lose parking?"he asked. "No" Attorney Wilkins responded. "This is by the heat pump". Mr. Bill identified that 1 1) ,1 SPR Notes of 10/11/01 placement appears to impact the first parking stall. "We don't want to see a loss of spaces,"he declared. Discussion ensued regarding lighting. The applicant advised that motion-activated security lighting is proposed; therefore no impact to the residential side is anticipated. Engineering and Health offered no comments. Conclusion: Approved. The Leased Area is approximately 575 square feet and is accessed from the existing parking area. The Site is located in the Residential (RD-1) District. The Town of Barnstable granted Sprint Sites USA ("Sprint") approval to construct a 120' wireless communications monopole, equipment pad and chain link fence at the Site for the installation; operation and maintenance of a Wireless Telecommunications Facility. Sprint has completed construction of the facility, which has been designed to accommodate additional wireless carriers. ANDERSON &KREIGER LLP Attorneys at Law CPrinted on recydrd paper Zoning Board of Appeals Town of Barnstable October 4, 2001 Page 4 THE PROPOSAL The Proposal is similar to the proposal previously considered by this Board in its August 8, 2001 Decision on Appeal No. 2001-19. However, there are several changes to address matters specifically raised by this Board.' Those changes are listed below, after a brief description of the basic nature of the proposal. AWP proposes to locate on the existing monopole six(6) closely mounted antennas, three with a centerline elevation of 91' AGL and three with a centerline elevation of 84' AGL. AWP's proposed antennas are all below the existing Sprint and Associated Alarm antennas. AWP's appurtenant communications equipment will be installed in cabinets on a concrete pad at the base of the monopole near the existing equipment pad at the Site. Cabling will connect from the cabinets, through the inside body of the monopole,to AWP's antennas. AWP will utilize the existing electrical panel, electric and telephone conduits to the extent permitted and possible. THE PROPOSAL INCLUDES SPECIFIC MATERIAL CHANGES Since the approval in SPR-160-00, AWP has made specific and material changes to its application as follows: • To respond to issues raised by the dissenting members of the Board of Appeals in Appeal No. 2001-19, the antennas are now close-mounted to the existing monopole and are vertically separated, thereby minimizing any alleged visual impact. • In further response to the issues raised by the dissenting members of the Board of Appeals in Appeal No. 2001-19, AT&T Wireless proposes to replace the existing chain link fence with a stockade fence, as shown on page C-2 of the attached plans. The stockade fence will not only be more attractive in itself, but will also provide more complete screening of both AT&T Wireless' proposed equipment and Sprint's existing equipment. Therefore, the AT&T Wireless application will actually improve the site's present appearance. After the Planning Board approved AWP's proposed installation, subject to conditions, in SPR- 160-00,the Board of Appeals denied AVWP's application for zoning relief in Appeal No.2001-19. The Board of Appeals' Decision in No.2001-19 is now on appeal in both state and federal courts. AT&T Wireless PCS,LLC v. Town of Barnstable,United States District Court No.01-CV 11485-RCL and AT&T Wireless PCS,LLC v.Town of Barnstable,Barnstable Superior Court No.01-548. The present application makes changes to the previous proposal for the purpose of addressing the specific issues raised by the dissenting Board of Appeals members whose votes caused the disapproval of Appeal No.2001-19 for failure to obtain a 4/5 vote. Accordingly, the changes are,as a matter of law, material enough to justify a reapplication prior to the expiration of the two year period specified in G.L. c.40A,section 16. If necessary,AT&T Wireless requests that the Boards so find pursuant to that section. ANDERSON &KMGER LLP Attorneys at Lam C j Printed on receded paper Zoning Board of Appeals Town of Barnstable October 4, 2001 Page 5 • In accordance with the condition imposed during site plan review No. SPR 160- 00, AT&T Wireless has changed the location of the concrete pad and equipment, for the purpose of placing its installation more than 10 feet from existing cesspools and leaching fields at the Site. • AWP's revised plans note the location of an additional future cabinet to allow both this Board and AWP to plan now for future needs and avoid unnecessary future proceedings. The changes discussed above constitute "specific and material changes in the condition upon which the [Board's] previous unfavorable action was based", within the meaning of G.L. c. 40A, § 16. See Ranney v. Board of Appeals, 11 Mass.App. 112 (1981) ("cosmetic"changes in the plans for a proposed addition to a motel, resulting in a less intrusive building, constituted "specific and material changes"within the meaning of Section 16); see also Corkery v. Town of Canton, Civ. Action No. 98-10054-MEL (D.Mass. July 13, 1998) (changes in proposed wireless communication facility addressing the Board's criticisms were"specific and material changes"). PURPOSE OF THE PROPOSAL The proposed PCS wireless facility will enhance wireless telephone service to Barnstable. The technology underlying this proposal represents the next generation of cellular telephone communication. Through a fully digital system, this technology affords improved reception, more private communications, increased ability to handle data, short messaging, enhanced cellular battery life, and other technological advantages. As a result of the higher frequency but lower power of the improved system, installations such as the proposed facility.must be sited at closer intervals than the first generation of cellular antennae. As a result, to serve this area of Barnstable with this improved phone service, a facility immediately within this area provides the best coverage. The proposed site has been selected because of its location and because the installation can be sited on the existing monopole tower consistent with the Zoning Bylaw, thereby avoiding any aesthetic concerns with respect to the site. AT&T Wireless is a duly licensed carrier who has authority from the FCC to provide wireless communication services for the facility being proposed. A copy of AT&T's FCC license is attached as Exhibit 7. ANDERSON &KREIGER LLP Attorneys at Law Printed on gdn d paper Zoning Board of Appeals Town of Barnstable October 4, 2001 Page 6 MODIFICATION OF THE EXISTING VARIANCE FOR THE MONOPOLE ON THIS SITE As a result of review by and consultation with the Barnstable Site Plan Review Board, AT&T Wireless has identified a need to modify three provisions of the Variance granted in Appeal Number 2000-31 (Exhibit 13)("Sprint Variance"). A brief discussion of the issues shows that modification of these three items provides the only necessary relief. The Sprint Variance allowed construction of the 120' monopole by granting a variance with conditions from the 40 foot height limitation in the RD-1 Zoning District. The Board's Decision(p. 1) granting the Sprint Variance noted that,"[o]n,March 20, 2000, the Zoning Board of Appeals granted relief to the owner of the property and the property is now in compliance with the uses on the site." See also ZBA Decision in Appeal No. 2000-24. If not for the conditions in the Sprint Variance, therefore, the proposed AT&T Wireless installation.would be permitted under the Town's Zoning By-Law solely upon site plan review.and issuance of a building permit. Condition #I of the Sprint Variance states "The property shall be developed in accordance with the approved site plan titled `Sprint Spectrum, LP Site LD. #BS13XC661B4 Associated Falmouth Road Hyannis MA 02602 prepared b Clough Harbour Alarm System 1047 Falmo a y ,p p y g & Associates LLP and dated March 2000." Proposed Modification: Condition#1 should be modified by adding the following bold-faced language at the end,to read: "The property shall be developed in accordance with the approved site plan titled `Sprint Spectrum, LP Site I.D. #BS13XC66IB4 Associated Alarm System 1047 Falmouth Road Hyannis MA 02602',prepared by Clough Harbour&Associates LLP and dated March 2000, as modified by the approved site plan titled "AT&T Wireless HYN153A Sprint Tower-Barnstable 1047 Falmouth Road Hyannis, Barnstable County,Massachusetts, prepared by SFC Engineering Partnership, Inc., and dated October 20,2000,revised September 26 and 27, 2001." Basis for Modification: The Board should modify this condition to allow co-location by AT&T Wireless, in accordance with the revised plans submitted as Exhibit 4 to this application. The plans done for this co-location use the approved Sprint plans as their starting point. They make only those changes necessary for the co-location, and do not affect any aspect of the original site plan that is material from the zoning standpoint. In particular, the plans do not increase the height of the tower, which is the characteristic of the Sprint proposal that required a variance. The addition of one more set of antennas for a co-locator was contemplated in the Sprint Variance proceedings (Decision on Appeal # ANDERSON &KREIGER LLP Attorneys at Law CJ Printed on rccwkd paper y Zoning Board of Appeals Town of Barnstable October 4, 2001 Page 7 2000-31 at p. 2) and would not be a detriment to the neighborhood, or to the public good. On the contrary, co-location on an existing tower promotes the public good by reducing the total number of towers in the area. The AT&T Wireless plans have received site plan approval (subject to modification of the Sprint Variance). Condition #6 of the Sprint Variance states: "There shall be no further development of the subject property without Zoning Board of Appeals, Board of Health and Site Plan Review approval." Proposal: Condition#6 does not need to be modified. However, the Zoning Board of Appeals should issue a decision granting approval under Condition#6 for the AT&T Wireless installation. The Board should grant approval under this condition to permit the proposed AT&T Wireless development, for essentially the same reasons it should modify Condition 1, discussed above. Condition#6 does not prohibit further development, but only requires approval of the new proposal. At the public hearing on this proposal, AT&T Wireless will demonstrate that its application is consistent with the co-location on this monopole that the original design contemplated, and that it achieves co-location in a manner consistent with the public good. AT&T Wireless has obtained site plan review approval. It has previously obtained approval by the Massachusetts Department of Public Health with respect to radio frequency emissions (Exhibit 6) and will obtain any necessary approval by the Town of Barnstable Board of Health as well. Condition #8 of the Sprint Variance states: "There shall be no more than nine (9) antennas from Sprint Spectrum,LLP and two whip antennas, which is in accordance with the plan submitted." Proposed Modification: Condition#8 should be modified to add the bold-faced phrase as follows: "There shall be no more than nine (9)antennas from Sprint Spectrum, LLP, six (6) antennas from AT&T Wireless and two whip antennas, which is in accordance with the plan(s) submitted" As previously noted during Site Plan review on the earlier application in 2000, it is possible that this condition does not apply here, because Sprint will not have more than 9 antennas. Nevertheless, AT&T Wireless seeks modification of this condition to make it clear that it may place its own antennas on the monopole in accordance with the plans submitted. The proposed AT&T Wireless installation complies with Massachusetts Department of Public Health requirements (Exhibit 6) and does not materially alter the visual impact of the monopole, which already has Sprint's array and whip antennas on it. AT&T Wireless currently proposes only 6 ANDERSON &KREIGER LLP Attorneys at Lau es printed on recycled paper Zoning Board of Appeals Town of Barnstable October 4, 2001 Page 8 closely-mounted antennas, which present an even sleeker profile than the other antennas on the monopole. COMPLIANCE WITH OTHER BYLAW PROVISIONS/SECTION 6 FINDING The Zoning Board of Appeals should also make a finding pursuant to G.L. c. 40A, § 6, and Section 4-4.4(1)(A)that the proposed installation is permitted as of right. First, as to the use, section 4-8.2(C) of the Ordinance requires, in all zoning districts, that an antenna be attached to "a legally built structure under zoning or a pre-existing legal non-conforming structure." The Sprint tower is a"legally built structure"under zoning. Section 4-8.3 of the Ordinance requires a Special Permit.for antennas mounted or located on any existing building or structure "other than a communications tower." (Emphasis added) No Special Permit is accordingly required for co- location on an existing communications tower. In any event, the tower on the Site, and its replacement by Sprint predated enactment of section 4-8 of the Ordinance and, as such, constitutes a lawful pre-existing use and structure. The Sprint Variance (p. 2) demonstrates that, in response to questions raised by defendant Nightingale during the Sprint proceedings, Barnstable Town Counsel opined that the Personal Wireless Communications Section of the Ordinance did not bear on the Sprint facility. Town Counsel further stated that"the relief needed for Sprint Spectrum can be granted by means of a dimensional variance.". Under Section 4-8 of the Ordinance, as properly construed in the Sprint case, there was no need for zoning relief (beyond the Sprint Variance authorizing additional height) for construction and use of the Sprint monopole, nor would any additional relief beyond modification to the Sprint Variance be needed for the AT&T installation. Moreover, as to dimensional requirements, the installation is as of right under section Section•4-4.4(1)(A), which permits as of right development where the new construction does not "increase or intensify the degree of the existing non-conformity of the building or structure." There is an existing non-conformity on the site, because the existing commercial building is closer than 100 feet to Route 28. See Bylaw, 3-1.1(5), fn. However, the proposed wireless facility will be behind the building and, though it will be within 100 feet, it remains farther away ' from Route 28 than the existing building. The proposed facility therefore does not increase the existing non-conformity and is permitted as of right under Section 4-4.4(1)(A). In the alternative, the Board should grant a Special Permit pursuant to G.L. c. 40A, § 6, and Section 444(1)(13)(2) because the proposed facility is not substantially more detrimental to the surrounding neighborhood than the existing facility. As shown above, any non-conformity as to use or dimension already exists, and the proposal does not change the use or place any elements closer to Route 28 than the existing commercial building. There can, therefore, be no substantial detriment to the surrounding neighborhood. ANDERSON &KREIGER LLP Attorneys at Law CPrinted on recycled paper Zoning Board of Appeals Town of Barnstable October 4, 2001 Page 9 VARIANCE CRITERIA (If necessary, all rights reserved). Pursuant to Section 5-3.2(3) of the Barnstable Zoning Bylaw, the Board has authority to grant variances as follows: Variances: To authorize upon appeal or upon petition in cases where a particular use is sought for which no permit is required, with respect to a particular parcel of land or to an existing building thereon, a variance from the terms of this ordinance where, owing to conditions especially affecting such parcel or such building but not affecting generally the zoning district in which it is located, a literal enforcement of the provisions of this ordinance would involve substantial hardship, financial or otherwise to the appellant, and where desirable relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of this ordinance, but not otherwise. These criteria are met here. The Board found in Appeal Number 2000-31, regarding this same monopole on the same property, that"the topography of the site is burdened with a great slope which is unique to this property. . . . [T]here is a need to take care of the people in the town who need cell phones. It would be a hardship for.the applicant to locate outside this area which would lead to a gap in service and place the applicant in jeopardy of penalty from the FCC. There are conditions on the site that warrant the grant of a variance." Without repeating these findings, on which AT&T Wireless relies, the applicant submits the following additional grounds for a variance. (a) There are special conditions relating to the soil condition, shape or topography of the land or structures for which the variance is requested, which especially affect the land or structures but do not affect generally the zoning district in which it is located. The special conditions related to this land that do not generally affect the zoning district (in addition to those found by the Board) are that there is an existing tower on the site and that the topography of the surrounding land makes it impossible to provide the necessary capacity for personal wireless services coverage without a height variance. (b) The variance requested may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of the Zoning Bylaw. ANDERSON &KREIGER LLP Attorneys at Lam C1 Printed on recycled paper tl s Zoning Board of Appeals Town of Barnstable October 4, 2001 Page 10 The requested variance may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of the Zoning Bylaw because AT&T proposes to co-locate as the second carrier on a monopole designed for two carriers. The present application specifically addresses the issues raised by the dissenting voters in No. 2001-19. In any event, as the Board has already found, the monopole poses no threat of harm.or injury. The proposed use is passive, requires no employees on the premises, and has no characteristics that are incompatible with the industrial zoning district or nearby residential neighborhood. Specifically, it will generate only about one vehicle trip per month, will be served by standard electrical service, and requires no water, sewer or other town services. (c) Substantial hardship, financial or otherwise, will result from a literal enforcement of the provisions of the Zoning Bylaw. The applicant will suffer substantial hardship if the provisions of the Zoning Bylaw were literally enforced to preclude the proposed use on the subject property. The applicant requires a location for its communications antennae to address capacity in this area.of Barnstable, and the proposed site is the most appropriate site due to its elevation and topography, the existing telecommunications uses of the property, as well as its location with respect to the area requiring service. Moreover, this hardship is underscored by overriding federal law. The Federal Telecommunications Act of 1996 [47 U.S.C. § 332(c)(7)] limits the power of any state or local government to regulate "the placement, construction and modification-of personal wireless service facilities." Without limitation, the Act makes it unlawful for any municipality to discriminate against carriers of PCS service, or to impose regulations on the basis of the environmental effects of the radio frequency emissions to the extent that such facilities comply with the [Federal Communication] Commission's regulations concerning such emissions. 47 U.S.C. § 332(c)(7)(B)(iv). The proposed installation fully complies with those regulations. Therefore, as Chief Justice Tauro recently stated in Telecorp Realty, LLC v. Town of Edgartown, 81 F.Supp.2d 257, 261 (2000) (citation omitted): Every day that Plaintiff's special permit is denied is a day Plaintiff loses against its major competitors, whose antennae presently are attached to the Tower. In today's quickly advancing world of telecommunications services, the costs of delay cannot be understated. The "balance of equities" and "public interest"factors further favor allowing the motion. In contrast to Plaintiff s potential losses, Defendants lose virtually nothing ANDERSON &KREIGER LLP Attorneys at Law CPrinted on recycled paper . Zoning Board of Appeals Town of Barnstable October 4, 2001 Page 11 by granting the special permit, other than the effect of prohibiting Plaintiffs construction of its antennae on the Tower. ... [I]t cannot be contested that the addition of Plaintiff to the marketplace will be in the public interest. A basic premise of the TCA is "to increase competition in the telecommunications industry." CONCLUSION AT&T Wireless thanks the Board for its attention to this proposal. AT&T Wireless looks forward to providing the most advanced wireless telephone services available to this section of Barnstable within the near future. Sincerely, 1 glas H. Other long-term .liabilities increased due to §Qcqf81" received in consideration for a long-term leasing arrangement, and other current liabilities increased due to increased business taxes and operating accruals. MTotal preferred stock held by AT&T increased to $3.0 billion at September 30, 2000, from $1.0 billion at December 31, 1999, due to the recapitalization of $2.0 billion of intercompany debt into preferred stock subsequent to the initial public offering. Dividends payable on the preferred stock were paid at 9,1 per annum. Total equity was $24, 502 million as of September 30, 2000, an. increase of $10, 505 million, or 75. 1a, compared with December 31, 1999. The increase was primarily due to increased combined equity associated with the attribution of initial public offering proceeds to the AT&T Wireless Group, as well as net transfers from AT&T prior to the initial public offering to fund capital expansion and acquisitions, and the additional $2.0 billion of preferred stock issued to AT&T. ' RECENT ACCOUNTING PRONOUNCEMENTS In December 1999, the Securities and Exchange Commission (SEC) issued Staff Accounting Bulletin (SAB) No. 101, "Revenue Recognition in Financial Statements' . SAB No. 101 provides guidance on revenue recognition, including service activation fees, and certain related costs, which requires adoption by the end of fiscal year 2000. Management does not expect the adoption of SAB No. 101 to . have a material impact on the AT&T Wireless Group's results of operations, financial position or cash flows. In June 1998, the Financial Accounting Standards Board_ (FASB) issued Statement of Financial Accounting Standards (SFAS) No. 133, "Accounting for Derivative Instruments and Hedging Activities Among other provisions, it requires that entities recognize all derivatives as either assets or liabilities in the statement of financial position and measure those instruments at fair value. Gains and losses resulting from changes in the fair values of those derivatives would be accounted for depending on the use of the derivative and whether it qualifies for hedge accounting. The effective date of this standard was delayed via the issuance of SFAS No. 137. The effective date for SFAS No. 133 is now for fiscal years beginning after June 15, 2000, though earlier adoption is i encouraged and retroactive application is prohibited. For the AT&T Wireless tGroup, this means that the standard must be adopted no later than January 1, 2001. Based on the types of contracts we currently have, management does not expect the adoption of this standard will have a material impact on the AT&T Wireless Group's results of operations, financial position or cash flows. In June 2000, the FASB issued SFAS No_ 138, "Accounting for Certain Derivative Instruments and Certain Hedging Activities" as an amendment to SFAS No. 133. I This statement provides clarification with regard to certain implementation issues under SFAS No. 133 on specific types of hedges. Based on the types of contracts we currently have, management'does not expect this statement to have a material impact on the AT&T Wireless Group's results of operations, financial position or cash flows. <PAGE> SUBSEQUENT EVENTS On November 13, 2006, TeleCorp PCS, Inc. (TeleCorp) completed its merger agreement with Tritel, Inc. , as part of a stock transaction. Pursuant to the terms of the agreement, each company merged with a separate newly formed subsidiary of a new holding company named TeleCorp PCS, Inc. , upon consummation of the transaction. Prior to the merger, the AT&T Wireless Group held equity interests in each of TeleCorp and Tritel which were both affiliates of the AT&T Wireless Group. In connection with tie merger, the AT&T Wireless Group contributed to TeleCorp PCS, Inc., rights to acquire additional wireless licenses in Wisconsin and Iowa, paid approximately $20 million in cash and extended the term of its brand license a. reement through July '00S, in exchange for approximately 9.3 million common sha_es in the newly combined Company. This transaction will bring the AT&T Wireless Group's equity stake in the combined company to approximately •'3:,, . assuming the conversion of all currently L convertible preferred stock to common Stock. in a separate transa':t.ion . with TeleCorp, the AT&T Wireless Groue comoleted an exchange of certain wireless licenses and rights to acquire licenses in r.he Wisconsin ar,d markets, as http://www.sec.gov/Archives/edgar/data/5907/0000005907-00-000038.txt 1/24/01 well as made a cash payment of approximately $80 million. In return, VW AW81 Wireless Group received TeleCorp's PCS licenses and wireless systems in several New England markets. The AT&T Wireless Group . anticipates it will recognize .a significant gain on the transactions. On October 25, 2000, AT&T announced its intention to dispose of its remaining interest in the AT&T Wireless Group tracking stock, which has been approved by AT&T's Board of Directors. AT&T intends to offer AT&T common shareowners the stock . opportunity to exchange AT&T common stock for AT&T Wireless Group tracking . AT&T plans to distribute its remaining interest in the AT&T Wireless group tracking stock to AT&T common shareowners in 2001. Upon completion of the exchange offer and distribution, AT&T intends to convert the AT&T Wireless Group tracking stock into an asset-based AT&T Wireless common stock and distribute to its shareowners. ' On October 2, 2000, the AT&T Wireless Group completed its acquisition of several equity interests in international ventures acquired by AT&T as a result of its acquisition of MediaOne in June 2000. The AT&T Wireless Group acquired these interests from AT&T for approximately $1 billion in cash, which was determined based upon a third party valuation. Additionally, the AT&T Wireless Group assumed deferred tax liabilities totaling approximately $220 million which were transferred from AT&T. On October 2, 2000, the AT&T Wireless Group completed its acquisition wireless system in Indianapolis for approximately $530 million 1incash.oThe transaction was recorded under the purchase method of accounting. The tower is located along Route 28 on property commonly referred to as the "Child's Building" and located at 1047 Falmouth Road/Route 28, Hyannis, MA. The 120-foot tower was recently installed as authorized by Variance 2000-31. That variance was issued to Sprint Spectrum, LP on March 29, 2000, and authorized the replacement of an existing 115-foot communication tower. In rendering that decision, the Board imposed 8 conditions, three of which would need to be modified if the applicant were to co-locate on the monopole. They are: "1. The property shall be developed in accordance with the approved site plan titled"Sprint Spectrum,LP Site I.D.#BS13XC661B4 Associated Alarm System 1047 Falmouth Road Hyannis,MA 02601",prepared by Clough, Harbour&Associates LLP and dated March, 2000. "6. There shall be no further development of the subject property without Zoning Board of Appeals,Board of Health, and Site Plan Review approval. "8. There shall be no more than nine (9) antennas from Sprint Spectrum, LLP and two whip antennas which is in accordance with the plan submitted." Procedural &Hearing Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on December 06, 2000. An extension of time for holding the hearing and for filing of the decision was executed between the applicant and the Board. A public hearing before the Zoning Board of Appeals was duly advertised and notice sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened February 21, 2001,continued to April 04, 2001, May 16, 2001,and to July 25,2001 at which time a motion to grant the relief sought did not carry. Board Members hearing this appeal were; Thomas A. DeRiemer, Daniel M. Creedon,Gail Nightingale, Richard Boy and Ron S. Jansson. During the proceedings,'Attorney Douglas Wilkins, Attorney Steven Anderson, and Kenneth J. Kozyra'represented the applicant. Also present were Jeffrey Dunakin a radio engineer for AT&T and a Mr. Carera. At the February 21, 2001, opening of the hearing, the board and petitioner agreed not to proceed. It inuance, the representatives and Board first discussed the was continued to April 04, 2001. At that cont license agreement to establish the standing of the applicant. Mr. Kozyra stated that the purpose of this appeal was to modify conditions 1,6 and 8 of existing variance, number 2000-31, to permit co-location of antennas on an existing monopole tower. The plans were presented and discussed. The conditions imposed by site plan review were cited and the board noted that the plans did not clearly illustrate that the equipment would be sited so that it was no closer than 10 feet to existing cesspools and leaching fields. The nature of the equipment cabinets and the size was discussed as well as screening of the cabinets with an 8-foot high fence. The public was invited to speak and Attorney Adam Ellman representing Michelle Maher, an abutter use variance is needed, and the addition of the antennas posed a spoke in opposition citing that a . health and safety risk to his client. The Board requested that Mr. Ellman present factual in the fact th at the proposal has received state health with respect to the safety issue, especially in light of p P approval with respect to radiation imitations. It was noted that the issue of a use variance was not before the Board. Mr. Ellman was given time to present the Board the factual information supporting his concerns. Ms Michelle Maher, an abutter explained that she had purchased her property in 1993, and had rented the property. She described the view from her front door as being ugly. Walter Bailey, owner of two adjacent properties, spoke in opposition to the tower citing that there are no guidelines.or light beacon on it. Robert Daniels stated that the previous tower had been there since the mid-sixties. Mr.Jansson noted for the record that a petition was submitted to the board in opposition to the proposal. The hearing was continued to May 16, 2001. At that time a letter from Kenneth J.Kozyra, dated May 14, 2001,was received requesting a continuance. The Board continued the hearing to July 25, 2001. At the July 25 continuance,Attorney Steven Anderson summarized the proposal and relief requested. Findings of Fact: At the hearing of July 25, 2001, a motion was duly made and seconded to make the following findings of fact: 1. The applicant is AT&T Wireless PCS, LLC, -AT&T Wireless Services, Inc.,d/b/a/AT&T Wireless Services. The property address is 1047 Falmouth Road (Route 28), Hyannis, MA as shown on Assessor's Map 250, Parcel 004. The property is zoned Residential D-Land GP Groundwater Protection Overlay. 2. The applicant seeks to modify Variance 2000-31 to allow for co-location of antennas on a 120- monopole tower. That variance was issued to Sprint Spectrum LP on March 29, 2000, and was authorized with conditions, namely the replacement of a 115-foot lattice tower with the 120- foot monopole tower, associated equipment and antennas. 3. This appeal seeks to modify conditions 1, 6, and 8 to the existing variances. Condition Number 1 of Variance 2000-31 references the earlier plan that provided for the reconstruction 2 of the tower and location of Sprint `s antennas. Condition Number 6 limits further development of the tower without approval of the Zoning Board, Board of Health and Site Plan Review Committee. Condition Number 8 limits the use to no more than nine antennas from Sprint Spectrum, LLP and two whip antennas. 4_ The applicant, AT&T Wireless, wished to add 3 sets of 3 (a total of 9) new antennas to the tower located at the 88-foot elevation of the monopole. 5_ Applicant also seeks to modify the structures located on the property with the addition of communication cabinets at'the base of the monopole 6. Site Plan Review Committee has reviewed the plans for the co-location of the antennas and equipment on November 30, 2000. The Committee approved a plan dated 10120100, last revised date 12/04/00", entitled, "TeleCorp Realty, L.L.C. HYN153A Sprint Tower- Barnstable," 1047 Falmouth Road Hyannis, MA, prepared by WFI, 10 Tara Boulevard, Nashua, NH and SFC Engineering Partnership" 7. The applicant has presented revised plans to the board that reflect the condition of Site Plan Review, and request of the board that the location of the concrete pad shall maintain a 10 foot setback from all cesspools and leeching pits. The applicant has complied with the request by a plan revised dated 7-24-01,which was received at the continuance of this hearing today,July 25, 2001. That plan rearranged the location of the power cabinet and added one additional communication cabinet that measures 2'-4" long, 2'-7" wide and 5'-6" high. These plans, represent a modification of the plans previously approved by Site Plan Review and as cited in the previous finding, are the plans before the Board. 8. The Zoning Ordinance, the adopted Local Comprehensive Plan and the Regional Cape Cod Commission Plan encourages the co-location of antennas on existing towers rather than building new towers. This appeal before the Board is requesting to co-locate on an existing tower as encouraged in the ordinance and those plans. 9. This relief may be granted without substantial detriment to the public good and neighborhood affected in that although zoned residential the character of the neighborhood is commercial. Many surrounding uses are commercial in nature and many are not residential along this section of Route 28. The vote was as follows: AYE: Tom DeRiemer,Dan Creedon,Ron S.Jansson, Chairman NAY: Gail Nightingale, Richard Boy The dissenting members cited that the revised plans received at the July 25 continuance has not been approved by site plan review, that the modification to co-locate more antennas on the monopole would increase the harmful effects of the tower on the neighborhood and represented a substantial detriment to the surrounding neighborhood: Decision: Based on the findings of fact, a motion was duly made and seconded to grant the applicants'request for a modification of Variance 2000-31, subject to the following terms and conditions: 1. All provision of Variance 2000-31 shall remain in full force and effect except to the extent that they are changed or modified by this decision. 3 Xi q 2. Condition 8 shall be replaced with -No more than 15 antennas and two whip antennas shall be located on the monopole tower. 3. Condition 6 shall remain in effect after the grant of this relief. 4. Condition I shall incorporate this new plan as well as the original approved plan for the replacement of the Tower. The new plan, as approved by Site Plan Review is entitled,"TeleCorp Realty, L.L.C. HYN153A Sprint Tower- Barnstable," 1047 Falmouth Road Hyannis,MA,prepared by WFI, 10 Tara Boulevard, Nashua,NH and SFC Engineering Partnership dated 10/20/00, last revised date 12/04/00." 5. The following additional condition shall also apply to this installation - The location of the concrete pad shall maintain a 10-foot setback from all cesspools and leeching fields. The vote was as follows: AYE: Tom DeRiemer, Dan Creedon, Ron S.Jansson, Chairman = NAY: Gail Nightingale, Richard Boy Ordered: Special permit 2001-19 did not carry and therefore is not granted. Appeals of this decision, if any, shall be made pursuant to MGL Chapter 40A, Section 17, within twenty (20) days after the date of the filing of this decision. A copy of which must be filed in the office of the Town Clerk. 78 0-1 10 Ron S. ansson, hairman Date Signed I Linda Hutchenrider, Clerk of the Town of Barnstable, Barnstable County,Massachusetts, hereby certify that twenty (20) days have elapsed since the Zoning Board of Appeals filed this decision and that no appeal of the decision has been filed in the office of the Town Clerk. The existing building consists of two levels; an exposed finished basement and a first floor level. The applicant is proposing to replace the existing tower with a 120 foot monopole structure and associated base equipment for use as a wireless communications facility. To allow the proposed facility, the applicant has applied for the following zoning relief: • Appeal Number 1999-147-Special Permit pursuant to Section 4-4.4(2) Nonconforming Building or Structure Not Used as Single or Two-Family Dwellings, to permit the replacement of an existing 115 foot radio tower with a 120 foot monopole structure and associated base equipment station. • Appeal Number 1999-148-Special Permit pursuant to Section 4-4.5(2) Expansion of a Pre-Existing Nonconforming Use, to permit the replacement of an existing 115 foot radio tower with a 120 foot monopole structure and associated base equipment station for use as a wireless communications facility. • Appeal Number 2000-31 -Variance from Section 3-1.1(5) Bulk Regulations-Maximum Building Height to permit the tower to exceed the 30 foot height limitation on structures and allow 120 foot tower. Procedural Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on March 31, 2000. A public hearing before the Zoning Board of Appeals was duly advertised and notices sent to all abutters in accordance with MGL Chapter 40A. The Applicant and Board Chairman executed an extension of time to file the decision. A copy of which is contained in the file. The hearing was opened on April 26, 2000, and continued to May 10, 2000 at which time the Board granted the variance with conditions. Hearing Summary: Board Members deciding this appeal were Gene Burman, Richard Boy, Tom DeRiemer, and Dan Creedon, and Gail Nightingale, Acting Chairman. During the hearings,Attorney Edward D. Pare, Jr. represented the applicant. Attorney Pare reviewed the appeals. He noted that when the applicant was previously before the Board with reference to Appeal 1999- 147& 148, there was some concern regarding the uses on this site. On March 29, 2000, the Zoning Board of Appeals granted relief to the owner of the property and the property is now in compliance with the uses currently on the site. Attorney Pare noted that at the previous hearing, the Board questioned the legal non-conforming structural status of the tower, so - in the alternative-the applicant submitted this Variance request to bulk regulations, maximum building height. He also stated that since, the tower is already there, the use of this new antennae is allowed as-of- right under the recently amended Section 4-8 Personal Wireless Communication of the Zoning Ordinance. The Town of Barnstable-Planning Department-Staff Report m Sprint Spectrum,LP-Appeal Number 2000-31 Variance-Section 3-1.1(5)Bulk Regulations-Maximum Building Height proposal needs a dimensional variance for the additional height. They will be rebuilding the tower for safety reasons. Attorney Bruce Gilmore who represented the owner of the property (Randy Childs) at a previous hearing of Appeal No. 2000-24 for a modification of an existing Special Permits/Variances for the use of the locus, explained that the existing tower was mentioned at the March 2-9, 2000 hearing of the appeal and cited in the Board's findings The tower was an accessory use, first by Childs Electric, and then by its successor Associated Alarm. William Hastings, RF Engineer Specialist, explained that Sprint needs to be up high on the monopole (120 feet high).in order to separate them from Associated Alarm antennas. The height is also needed to clear the trees and allow coverage of Hyannis_ Sprint and Associated Alarm will be the only users of the tower. Kevin Washburn, an engineer from Clough, Harbour&Associates, LLP, explained the GPS antenna is very small in size(about the size of a small drinking cup)and placed on the antennae to allow the signal to locate other Sprints antennas. The tower is designed to accommodate one other use, but they are not now seeking a co-locator. - Attorney Pare reiterated that Sprint's use will be legal because communication antennas are allowed, under certain conditions pursuant to Section 4-8, in every zoning district. The variance request is for height, not use variance. Ralph Crossen, Building Commissioner noted that the current tower does not have a building permit. Public Comment: No one spoke in favor or in opposition to this appeal. The Board asked the applicant to demonstrate variance conditions. Attorney Pare stated that since there is already a tower on the site, this is a unique condition only to this site and not the neighborhood affected. The relief is for only an additional five feet and as such not a detriment since there is currently a 115 foot tower on the site. If the relief is not granted it will be a hardship to Sprint as they are required by the FCC to provide telecommunication services throughout the State. They have to comply with the Telecommunication Act of 1996 and without this relief Sprint would suffer a substantial hardship. The immediate area is largely commercial and the relief can be granted without substantial detriment to the public good or the neighborhood affected. The Board was concerned with the nature of relief needed. They determined to request the Town Attorney review the case and advise on the relief needed. The Board continued the appeal to May 10, 2000. At the May 10, 2000, continuance Acting Chairman Gail Nightingale expressed concern for the tower as an existing communication tower as defined in the Personal Wireless Communications Section of the Ordinance. Town Attorney Robert Smith responded that defining the tower in that context would not have a bearing in this particular case. The relief needed for Sprint Spectrum can be granted by means of a dimensional variance. Part one of Section 4-8(3), Personal Wireless Communications, deals with communication devices, antennas and appliances on existing structures. The"use"-"wireless communication"is permitted everywhere in Town of Barnstable on existing structures. It is only the height of the structure that needs relief in this case. That can be done through a dimensional Variance. Findings of Fact: At the hearing of May 10, 2000, the Board found the following findings of fact as related to Appeal No. 2000-31: 1. The applicant, Sprint Spectrum LP, is seeking a Variance from Section 3-1.1(5) Bulk Regulations-Maximum Building Height. 2. The property address is 1047 Falmouth Road/Route 28, Hyannis, MA, as shown on Assessor's Map 250, Parcel 004 and located in the RD-1 Residential D-1 Zoning District and the GP Groundwater Protection Overlay District. 3. The petitioner is seeking to replace an existing 115 foot-tall tower structure with a 120 foot-tall monopole. 4. The applicant originally proposed to accomplish this segment of the plan through a request for a Special Permit (Appeal Number 1999-147) pursuant to Section 4-4.4(2) Nonconforming Building or Structure Not Used as Single or Two-Family Dwellings 5. As to MGL Chapter 40A, Section 10 Variance Conditions, the topography of the site is burdened with a great slope which is unique to this property_ This monopole could add visual pollution to the area, but there is a need to take care of the people in the town who need cell phones. It would be a hardship for the applicant to locate outside this area which would lead to a gap in service and place the applicant in jeopardy of penalty from the FCC. There are conditions on the site that warrant the grant of a variance. 2 r Town of Barnstable-Planning Department-Staff Report Sprint Spectrum,LP-Appeal Number 2000-31 Variance-Section 3-1.1(5)Bulk Regulations-Maximum Building Height 6. The neighborhood is surrounded by commercial businesses across the street and down the road. 7. The relief may be granted without substantial detriment to the public good. There may be visual pollution, however proper screening and painting would help. 8. The relief may be granted without nullifying or substantially derogating from the intent or purpose of the Zoning Ordinance as there is a need in the town for this type of service. 9. During the course of these proceedings there was no opposition voiced by any abutters. The vote was as follows.- AYE: Gene Burman, Richard Boy, Tom DeRiemer, and Dan Creedon NAY.- Acting Chairman Gail Nightingale Ms. Nightingale voted in the negative because she felt this was not within the spirit and intent of the Zoning Ordinance. Decision: Based on the findings of fact, a motion was duly made and seconded to grant the relief being sought in Appeal No AOO-31 subject to the following terms and conditions: j 1.J The property shall be developed in accordance with the approved site plan titled"Sprint Spectrum, LP Site I.D.# BS13XC661B4 Associated Alarm System 1047 Falmouth Road Hyannis, MA 02601", prepared by Clough, Harbour&Associates LLP and dated March_2000. 2. The proposed monopole, including all antennas, shall not exceed a height of 120 feet. 3. The color of the monopole shall be earthtone to lessen the visual impact. 4. If use of the monopole is abandoned or not used for a period of one (1)year, the pole shall be removed within 30 days and the site restored. This is to be done by the petitioner. 5. If transmissions from this pole or its antennae interfere with any local television, radio, telephone, alarm system, or other electronic equipment, Sprint Spectrum, LP or its successor shall have 20 days to rectify the situation. If not rectified within those 20 days, the Building Commissioner shall order the communication devices to be shut down immediately. ( 6.1 There shall be no further development of the subject property without Zoning Board of Appeals, Board of Health and Site Plan Review approval. 7. The petitioner shall post a Performance Bond acceptable to the Legal Department or its Designee for removal of the monopole. (8.) There shall be no more than nine (9)antennas from Sprint Spectrum, LLP and two whip antennas which is in . accordance with the plan submitted. The vote was as follows: AYE: Gene Burman, Richard Boy, Tom DeRiemer, and Dan Creedon NAY: Acting Chairman Gail Nightingale Ms. Nightingale voted in the negative because she felt the granting of the Variance was not in compliance with the Zoning Ordinance. Order: Variance Number 2000-31 has been granted with conditions.
