While on assigned Sector 1 patrol., 06/14/06 at,approx. 1745 hours, this Officer was dispatched, along with
Officer Jennifer Ellis, to 230 Fawcett Ln, Hyannis for. a 9-1-1 abandoned call. Upon arrival, this Officer
observed the following: 230 Fawcett Lane is a split level residence,with an 'EMPORIUM REALTY for sale
sign in front. The residence was observed with all front windows open, no screens observed. The grass approx.
one foot high.. Several,voices heard in the rear of tl..l.e residence. Officer Ellis and I approached the rear of the
residence, observing three males on,the second story deck. This Officer asked if they lived there and they stated
they did, however, their English was broken and could not provide any additional: information when asked if
they dialed 9-1-1. One of the males motioned Officer Ellis and I inside at which time we met with, Maria
Rodriguez, who spoke broken English. Ms Rodriguez was informed,n
formed of the abandoned 9-1-1 and explained that
she was attempting to make an international call and was not aware that she dialed 9-1-1. This Officer
performed a check of the residence to ensure that there were no immediate threats or emergencies. Finding
none, I returned.to Ms Rodriguez and was informed that thirteen (13)people were renting the house for the
summer. Ms. Rodriguez believes the owners name is 'Peralta'. The following names were provided as living in
the residence: 1)MARIA RODRIGUEZ
2)KELVYN VENTURA
3)ANGELA VENTURA
4) JENNY RODRIGUEZ
5)DONALD LOPEZ
6) LYVYS MARTTNEZ
7) YANIRIS NUNEZ
8)ERWIN DOMINGUEZ

This Officer was further informed that Ms.Rodriguez believes that the eleven mentioned subjects were
all that reside at 230 Fawcett Ln.
'EMPORIUM REALTY' (tel, # 508-536-9582) was contacted by this Officer. The listed
agent for the property is JUAN MARICH_EL. Mr.. Marichel informed this Officer that the owner of 230 Fawcett '
Lane is WISTON PERALTA. Mr. Marichel stated that the owner resides off Cape and, did not want to provide
any additional contact information. This Officer requested that Mr.. Marichel relay a message to have Mr.
Peralta contact the BPD with my name and number. Mr. Marichel stated that he would.

The current exemption for "homeowners" was extended to include owner-occupi.
dwellings of six units or less and to allow such homeowners to engage an ins
dividual for hire who does not possess a license, provided that the owner
acts as supervisor.
DEFINITION OF HOMEOWNER:
Person(sj who owns a parcel of land on which he/she resides or intends to r
side, on which there is, or is intended to be, a one to six family dwelling
attached or detached structures accessory to such use and/or farm structure
A person who constructs more than one home in a two-year period shall not bl
considered 'a homeowner. Such 'homeowner". shall submit to the Building Offi ;
on a form acceptable to the Building Official, that he/she shall be respons..
for all such work performed under the building permit. (Section 109.1.1)

HOME OWNER'S EXEMPTION :. }
The code state that: "Any Home Owner performing work for which----a-J%ild.
Permit is required shall be exempt from the provisions of this section
(Section 109. 1. 1 - Licensing of Construction Supervisors) ; provided tha-
Home Owner engages a person(s) for hire to do such work, that such Home
shall act as supervisor. "
Many Home Owners who use this exemption are unaware that they are assum:
the responsibilities of a supervisor (see Appendix Q, Rules and Regulat4
for .licensing Construction* Supervisors, Section 2.15) . This Pack of awz
often results in serious problems, particularly when the Home Owner hire
unlicensed persons. In this case our Board cannot proceed against the
inlicensed person as it would with licensed Supervisor. The Home"owner:
as supervisor is ultimately tesponsible.
To ensure that the Home Owner is fully aware of his/her responsibilities
communities require, as part of the permit application, that the Home Ow
certify that he/she understands the responsibilities of a supervisor. 0,
last page of this issue is a form currently used by several towns. You
care to amend and adopt such a form/certification for use in your commun.
