Dear Mr. DaLuz:
This office represented Franklin G. Pilicy in the purchase of the above captioned
lot. I understand that before a building permit issues, an opinion is necessary
relative to the question as to whether or not any of the lots surrounding Lot 4
were held in contiguous ownership. My review of the title abstract to Lot 4 reveals
the following:
1. On September 16, 1949, Miles Sidney and Elizabeth Frost Sidney took title to a
parcel of land of which this lot was a portion.
2. In February, 1984, an approval-not-required subdivision plan was prepared and
recorded in the Barnstable County Registry of Deeds in Book 183, Page 19. Lot 26
was shown as Lot 4 on said plan and had consisted of 11,060 square feet.
3. On July 26, 1965, Sidney conveyed Lots 4 and 2 as shown on said plan to Paul R.
and June M. Botello. At that time, Lots 2 and 4 were not contiguous, with the only
common point being the southeast corner of Lot 2 and the northwest corner of Lot 4.
4. On October 1, 1969, Botello conveyed Lot 4 (now Lot 26) to Louis and Josephine
Kolandra.
5. On February 26, 1974, Kolandra conveyed Lot 4 (now Lot 26) to Thelma J. DePamphilis.
6. On October 4, 1974, DePamphilis mortgaged Lot 4, among other lots she owned, to
Homeowner's Federal Savings & Loan Association. On May 15, 1978, Homeowner's Federal
foreclosed on the mortgage and took title to Lot 4 (now Lot 26).
7. On August 23, 1978, Homeowner's Federal sold Lot 4 (now Lot 26) to A. Frank and
Celia Foster.

8. Foster conveyed to Susan Beth Zucker on January 16, 1986.
9. Zucker conveyed to the current owner, Franklin G. Pilicy, on June 2, 1986.
As you can see from the above, it is therefore my opinion that there is no question
as to the contiguity of ownership of any lots, and therefore I request that a
building permit issue.
