You would have to come to a dead-end at Lot C and continue the finished asphalt so that there is a total of 50'of asphalted frontage along Lot C. 3) The first section of Elizabeth Lane that is patched asphalt would not have to be upgraded. 4) Lots F&G would need asphalt from the intersection of Frost and Sydney to a point 50'beyond the beginning of Lot G. 5) The section of Frost from Pitchers to Sydney Drive is substandard but you will not be required to upgrade it. 6) Yes the same requirements for Frost Lane would apply. You will recall we discussed the requirements for adequate frontage and reasonable access to certain lots located near Pitcher's Way in Hyannis. As we agreed, I am requesting by this letter a determination of what road construction specifications will be required for these lots in order to make them eligible for a building permit. I understand that there are other requirements that also contribute to a determination of whether or not a building permit is ultimately issued. However, for purposes of this letter, I seek a determination of only the road requirement. To help clarify this discussion, I have enclosed a map of the property. The map is a copy from the Town Engineer's office, and matches a copy of a street layout plan dated February 12, 1962 and filed in Plan Book 167, Page 133 (as amended by a subdivision plan within the 1962 street layout, recorded in Plan Book 183, Page 21, dated March 1964). My questions regarding the Town Engineer's map are as follows: 1)Regarding the lots labeled A and B: In order to satisfy the frontage requirement, would an asphalt road be required to be built on Whip-O-Will Drive at a point commencing at the northern boundary of lot A and extending southward at least 50' along Lot B, or would the asphalt road have to commence at Sterling Road? 2) As an alternative frontage requirement for lot B, and with respect to frontage for lots C, D, and E: Would an asphalt road be required commencing at the current end of Elizabeth Lane (approximately 267 feet in from Pitcher's Way) to dead end at lot C? The town has maintained this road since the 1950s. Would this first section of Elizabeth Lane require up- grading to the new asphalt road standard(i.e., repaving the entire road)? If so, is that the responsibility of the town or the developer of lots B, C, D, and E? 4) Regarding lots F and G on Pawnee Court: Would an asphalt road be required beginning at the intersection with Sydney Drive? Would Sydney Drive require asphalt paving? If so, would such paving begin at the intersection of Frost Lane and Sydney Drive? 5) The first 220 feet of Frost Lane (beginning at Pitcher's Way) consists of patched asphalt, and probably does not conform to the new asphalt road standard. The town has maintained this road since the 1950s. Would this first section of Frost Lane require up-grading to the new asphalt road standard? Frost Lane has not been constructed or paved along the frontage of these two adjacent lots. Additionally Sidney Drive has not been constructed or paved along the frontage of lot 289/14. Lot 289/14 is a comer lot with frontage on both Frost Lane and Sidney Drive. 2. Frost Lane between Pitchers Way and the beginning of these two lots is paved, though the pavement is in poor shape and has been patched repeatedly. This section of Frost Lane could be significantly damaged by the passage of heavy construction equipment. -)P. 3. 1 recommend that Frost Lane and Sydney be properly constructed and paved where it provides access to these two lots (from Pitchers Way to the front of these two lots and along the frontage of the two lots..
