Reported to this site on this date with Darcy Karle of Conservation at 10:30 AM. The
subject property is a vacant lot with a small wetland. We have a history of complaints
concerning this site.
Previously, Guadalupe Amaral (508-566-0720),the property owner and business owner
of Champion Tree Work began to clear the lot with the declared intention of building a
house but had not sought out any permitting assistance. We responded to those
complaints and also asked Conservation to check the site as the neighbors declared the
area to be a wetland habitat.
Darcy Karle issued an enforcement order at that time when it was determined that there
was in fact a small wetland on the site. Mr. Amaral subsequently submitted a re-planting
plan and obtained approval for that submittal. During this interaction, Mr. Amaral
suggested that he fence the side of the property along Uncle Willie's so it looked better.
Darcy agreed as fencing could delineate the local 100' limit
On this date, a neighbor called to complain about illegal dumping, stating that multiple
trucks were going in and out of the site all week end (both Sat& Sun) and dumping
landscape debris behind the fence. I asked Darcy to check the status of the lot and get
back to me.
A short while later she came back and told me that she called Mr. Amaral and he agreed
to meet her on site immediately. We went out together. Upon arrival,Mr. Amaral was
using in a small bobcat filling up the back of a dump truck with organic material. He had
installed an apron of cobblestones and and an area of gravel up to the gate.
Inside the fence was a huge pile of organic debris on the left side, a barren swath just
before us running approximately the length of the fence and un-stacked fire wood on the
right side.
Darcy cited Mr. Amaral for a failure to adhere to the enforcement order($300.00). I
discussed the removal of his sign advertising his services from all residential properties
where he is not working, as well as the relocation of his business and equipment to
commercially zoned locations. He immediately pulled the sign at this location.
During our conversation,Mr. Amaral was inconsistent with his living arrangements. He
stated he no longer lives at his brother's house on the corner of Uncle Willies' and Uncle
Al's. He lives at 79 Oak Street,Hyannis and his landlord is Steve Sundelin. Later in the

conversation he referred to living in a basement apartment—I am unsure if this reference `
is the Oak Street dwelling or his brother's house at 5 Uncle Al's where we have a history ;
of a basement apartment. :: ''

I told him to have his brother contact me. I will ask Brenda to send out the form letter to
Paulo Silva(brother) at 5 Uncle Al's so we can address that roe and the basement

I will also check to see if Steve Sundelin has registered 79 Oak Street yet. I informed `
him in a phone conversation in May 2013 that he must register it. I was informed this . .
summer that he had not.
I explained to Mr. Amaral that he cannot have equipment on Oak Street,Uncle Willies or
Uncle Al's or any residential property and he cannot be dumping material here or
a
allowing any other operation to dump here. He said he would clean up the lot and put it .M
up for sale.
It should be noted that designing and citing a SF dwelling and septic on this site will bey°
very difficult due to the conservation issues. However, Mr. Amaral also owns two y
abutting lots that front on Garden Lane. R292-328-002 40 acre aka-108 Garden Lane i
&R328-328-003 .40 acre aka 118 Garden Lane. All three lots are unregistered land '`
and being less than the current land mass requirement of 1 acre contiguous upland for
each individual lot. These lots are merged for zoning purposes. A final determination will `
should be rendered prior to the conveyance of any of theses lots being represented as
a
individual buildable lots and marketed with and an expectation of permitting as such.
