Donna Z. Miorandi, R.S., Health Inspector for the Town of Barnstable, on January 31, 2014 conducted an investigation of a property located at 7 General Patton Drive, Hyannis, MA. The owner's name of this property is Anthony Soares (now deceased). There are three known occupants (2 adults, one young child) in the dwelling at said property. Conditions found on the property, which give rise to consideration of finding of unfitness and consideration of condemnation, include 410. 750 (F): Conditions Deemed to Endanger or Impair Health or Safety: 410.750 (F)- Failure to maintain a sewage disposal system in operable condition as required by 105 CMR 410.150 (A)(1) and 410.300. You are also in violation of 310 CMR 15.00, The State Environmental Code, Minimum Requirements for the Subsurface Disposal of Sanitary Sewage and the Town of Barnstable Code. The following violations were observed: 310 CMR 15.303 (1)(a): Septic system is in hydraulic failure. Sewage was observed overflowing onto the ground on January 31, 2014 and March 14, 2014. There is also an illegal discharge of grey water via a pipe directly onto the ground where the cesspool is already overflowing. Failure to correct all of the above violations on or before April 4, 2014, shall result in automatic scheduling of a show-cause hearing before the Board of Health. This hearing will take place on Tuesday,April 8,2014 at 3:00 PM at the Town Hall located at 367 Main Street, 2nd Floor, Hearing Room, Hyannis. This show-cause hearing may result in the condemnation of your property at 7 General Patton Drive, Hyannis. During this hearing,you will have the opportunity to be heard, present witnesses and documentary evidence in regards to this case. You have a right to request a hearing if written petition is received within (7) seven days.
