Town targets packed rentals By ERIC GERSHON STAFF WRITER HYANNIS - The telltale signs are these, says Bill Elkins: a walk-out basement, eight or 10 cars parked on a beaten lawn,maybe a second driveway snaking behind the house. They're the insignia of"flophouses," the 68-year-old auctioneer said yesterday during a tour of his neighborhood,just north of Hyannis East Elementary School. In the past few years, he's noticed more and more of them near his Kent Lane home. These aren't new buildings. They're the same modest single-family houses built decades ago. Only now, Elkins said, they're occupied not by traditional families,but by groups of adults of little obvious relation. "I keep saying 'Brazilians,"' he said in an interview yesterday, "but I'm going to say 'immigrants.' They're not all Brazilians." Years of complaints, mostly informal, from Elkins and other residents, have led the town council to consider a crackdown on overcrowding in rental properties, especially single-family dwellings, largely because overcrowding is perceived as a public health threat. Town officials are aware of at least one three-bedroom house that was sheltering 24 people, with mattresses on the floor near a furnace, Assistant Town Manager Paul Niedzwiecki said. Septic systems can also overload. Despite the anecdotes, town officials have provided little documentation on the extent of overcrowding. There were 123 "housing related" complaints from citizens last year, Health Director Tom McKean said. But the complaints pertained to many types of grievance, not just overcrowding, he said. Public officials have limited authority to enter private homes, even for health and safety inspections, making a scientific assessment of who's living where nearly impossible, town officials said. "We're responding to the people in the community who live near these homes and see the everyday activity that goes on there," said Councilor Harold Tobey of Hyannis, one of three councilors sponsoring two anti-overcrowding proposals before the council. Among other things, the proposals would require landlords to apply for a board of health certificate stating the maximum number of occupants allowed to live in their rental units. Health inspectors would calculate that cap number based on state and local health and safety regulations. A provision that would apply only to single-family dwellings strictly defines the term "bedroom" and limits the number of occupants in each- two people in each of the first two bedrooms, one in each additional bedroom. Individuals under the age of 19 would be exempt from the total count. "This is a debate this community has been asking to have," Assistant Town Manager Paul Niedzwiecki said. "There's a tension here between the need for workforce housing and the preservation of community character in single-family neighborhoods." A public hearing on the overcrowding proposals is scheduled tomorrow at town hall. The council convenes at 7 p.m. Whether or not the town council adopts new regulations, local officials appear determined to take action. The town has already hired a former Barnstable County assistant district attorney, Christine Palkoski, to coordinate enforcement activity. The town has also begun developing a database to track complaints of overcrowding from neighbors. While local officials acknowledge many of the complaints they hear specifically refer to Brazilians, they emphasized the problem exists independent of the Cape's Brazilian immigrants. Summertime on Cape Cod has long attracted groups of temporary workers -U.S. citizens and foreigners alike, as well as college students - who jam into rentals to minimize housing costs. But town officials say overcrowding is now a year-round phenomenon. The residents of one George Street house that Elkins described as a"flophouse" say it's no such thing. Claudio Jordao, who came to the United States from Brazil 18 years ago and runs his own cleaning business, bought the home two years ago,he said.
