Purpose of the Elevation Certificate The Elevation Certificate is an important administrative tool of the National Flood Insurance Program (NFIP). It is to be used to provide elevation information necessary to ensure compliance with community floodplain management ordinances, to determine the proper insurance premium rate, and to support a request for a Letter of Map Amendment (LOMA) or Letter of Map Revision based on fill(LOMR-F). The Elevation.Certificate is required in order to properly rate Post-FIRM buildings,which are buildings constructed after publication of the Flood Insurance Rate Map (FIRM), located in flood insurance Zones Al—A30, AE, AH, A (with BFE), VE, Vl—V30, V (with BFE),AR,AR/A,AR/AE,AR/A1—A30,AR/AH, and AR/AO. The Elevation Certificate is not required for Pre-FIRM buildings unless the building is being rated under the optional Post-FIRM flood insurance rules. As part of the agreement for making flood insurance available in a community,the NFIP requires the community to adopt floodplain management regulations that specify minimum requirements for reducing flood losses. One such requirement is for the community to obtain the elevation of the lowest floor (including basement) of all new and substantially improved buildings, and maintain a record of such information.The Elevation Certificate provides a way for a community to document compliance with the community's floodplain management ordinance. Use of this certificate does not provide a waiver of the flood insurance purchase requirement. Only a LOMA or LOMR-F from the Federal Emergency Management Agency (FEMA) can amend the FIRM and remove the Federal mandate for a lending institution to require the purchase of flood insurance. However, the lending institution has the option of requiring flood insurance even if a LOMA/LOMR-F has been issued by FEMA.The Elevation Certificate may be used to support a LOMA or LOMR-F request. Lowest floor and lowest adjacent grade elevations certified by a surveyor or engineer will be required if the certificate is used to support a LOMA or LOMR-F request. A LOMA or LOMR-F request must be submitted with either a completed FEMA MT-EZ or MT-1 package,whichever is appropriate. This certificate is used only to certify building elevations.A separate certificate is required for floodproofing. Under the NFIP, non- residential buildings can be floodproofed up to or above the Base Flood Elevation (BFE).A floodproofed building is a building that has been designed and constructed to be watertight (substantially impermeable to floodwaters) below the BFE. Floodproofing of residential buildings is not permitted under the NFIP unless FEMA has granted the community an exception for residential floodproofed basements. The community must adopt standards for design and construction of floodproofed basements before FEMA will grant a basement exception. For both floodproofed non-residential buildings and residential floodproofed basements in communities that have been granted an exception by FEMA, a floodproofing certificate is required. Purpose of the Elevation Certificate The Elevation Certificate is an important administrative tool of the National Flood Insurance Program (NFIP). It is to be used to provide elevation information necessary to ensure compliance with community floodplain management ordinances, to determine the proper insurance premium rate, and to support a request for a Letter of Map Amendment (LOMA) or Letter of Map Revision based on fill(LOMR-F). The definition of the term"setback" within the Barnstable Zoning Ordinance, Section 240-128, Definitions, includes the following sentence: "Where a lot abuts on more than one street, front yard setbacks shall apply from all streets." The word"street" is not defined in the Zoning Ordinance, although it is defined in the Subdivision regulations. Specifically, the Subdivision Regulations set forth in Chapter 801 of the Barnstable Town Code define four categories of streets, including Major, Secondary, Minor A and Minor B Streets,2 all of which ' The proposed dwelling,shown on the enclosed site plan in the location approved by the Conservation Commission at its hearing earlier this week, is set back eighteen(18')feet from this sideline. As can be seen from these definitions, streets in Barnstable are defined as providing access to business, industrial or residential subdivisions, or in the case of minor streets, access to residential lots. The Subdivision Regulations also define "Roadway" as "that portion of a way which is designed and prepared for vehicular travel." See, Barnstable Subdivision Regulations, Section 801-3. The twenty (20') wide right of way extending along the Easterly sideline of Locus, from Harbor Bluffs Road to the private beach located to the South of Locus, is not a"street" or "roadway" as those terms are defined in Barnstable. It appears on the Land Court plan attached here as Exhibit B, as a 20' wide "Way" leading to a"Bathing Beach". On the Land Court Plan, it is distinct in both size and,in its identifying nomenclature from the other"roads" and"lanes" on the plan. Unlike those other"roads" and "lanes", it does not lead to any residential.lots, but rather to a private bathing beach. As such, it does not serve as a"street"within the meaning of that term, as defined in Barnstable. Moreover, this 20' wide right of way is not paved or constructed to any extent, and thus does not meet the definition of a"roadway" either. It serves merely as a footpath to the beach. See, the aerial photograph taken from the Town's GIS Mapping website, attached here as Exhibit C; see also, Exhibit A. In fact, it couldn't ever be paved or hardened because it is located almost entirely within the 100' setback to the Coastal Dune on site. See, the site plan attached at Exhibit A. Section 704 of the Barnstable Wetlands Protection Regulations governs activities within the 100' Buffer Zone, and Section 704-3 requires that a fifty-foot undisturbed buffer zone shall be retained between the landward-most wetland resource areas and the limit of proposed site disturbance. In any event, there would never be any need to pave this way, as it does not provide access to any developed land,just the private beach. Thus, it has always served as a pedestrian footpath, and not a paved roadway or street. In light of the foregoing, it is clear that the setback from the Easterly sideline is a"side yard" setback of ten (10') feet, and not a"front yard" setback of twenty (20') feet. If you could kindly confirm our interpretation of this issue prior to our deadline for filing the zoning application on September 19th, I would greatly appreciate it. The Applicant proposed to demolish an existing two-story, 3,470 gross floor area, two (2) bedroom, single-family dwelling and construct a two-story, 5,906 gross floor area, five (5) bedroom, single-family dwelling which will not meet the required twenty (20) foot front yard setback requirement in the zoning district in which it is located. The subject property is located at 75 Harbor Bluffs Road, Hyannis, MA as shown on Assessor's Map 325 as Parcel 124. It is located in the Residence B (RB) Zoning District. The subject lot is .46 acres and developed with a 3,470 gross square foot, two-bedroom dwelling constructed in 1935. The lot has frontage on Harbor Bluffs Road and overlooks Lewis Bay. Undersized lots appear typical for the area. Property is served by town sewer. The existing dwelling has a front setback of 5.6 feet where 20 feet is the minimum required. The lot is 20,000 square feet where one acre is required. Under Section 240-91 (H)(3)(a) Special Permit is required for demolition and rebuilding because the proposed dwelling does not meet the setback criteria in H(1)(a). Procedural & Hearing Summary Special Permit Application No. 2019-060 for the demolition of an existing dwelling and construction of a two-story, five (5) bedroom, single-family dwelling which will not meet the required twenty (20) foot front yard setback requirement was filed at the Town Clerk's office and office of the Zoning Board of Appeals on September 20, 2019. A public hearing before the Zoning Board of Appeals was duly advertised and notice sent to all abutters and. interested parties in accordance with MGL Chapter 40A. The hearing was opened on October 30, 2019 at which time the Board found to grant the Special Permit in a 4-1 vote subject to conditions. Board Members deciding this appeal were: Alex Rodolakis, Herbert Bodensiek, Bob Twiss, Todd Walantis and Jacob Dewey. . Nutter, McClennen & Fish LLP Attorney Sarah Turano-Flores presented the application before the Board. Also present were the Applicant, Cecilia Stone, Sean Reilly from Coastal Engineering, and Architect Lynn Hopkins. Attorney Turano-Flores reviewed the application and stated the project has received approvals from Conservation Commission and Barnstable Historic Commission. She stated the dwelling is nonconforming due to setbacks and the proposed project will improve the encroachment. Attorney Turano-Flores reviewed the criteria for the grant of the Special Permit and -. �_� stated•.the project complies. She also stated the project includes the planting of native vegetation to i Town of Barnstable Zoning Board of Appeals-Decision and Notice Special Permit No. 2019-060-Stone improve the site and the environment. There was a discussion about the flood zone and how it impacted the siting of the proposed dwelling. The Board Chair read the letter of support from Margo Pisacano dated October 30, 2010 (2019). The Board questioned the height of the proposed dwelling and the impact on the neighborhood and the proposed number of parking spaces. Ms. Hopkins stated the height to the plate is 30 feet but to the ridge is 39 feet. She also stated that due to the proximity of the flood zone, all the mechanicals must be located within the attic. The Chair requested public comment and no one spoke. Findings of Fact At the hearing on October 30, 2019, the Board made the following findings of fact in Special Permit Application No. 2019-060, a request to demolish an existing single-family dwelling and construct a single-family dwelling: 1. The application falls within a category specifically excepted in. the ordinance for a grant of a special permit. Section 240-91(H)(3) allows for the complete demolition and rebuilding of a residence on a nonconforming lot where the proposed setbacks are equal to or greater than the yard setbacks of the existing building. 2. Site Plan Review is not required for single-family residential dwellings. 3. After an evaluation of all the evidence presented, the proposal fulfills the spirit and intent of the Zoning Ordinance and would not represent a substantial detriment to the public good or the neighborhood affected. 4. The proposed yard setbacks must be equal to or greater than the yard setbacks of the existing building. The proposed setbacks will be more conforming with the requirements of the Residence B Zoning District. 5. The proposed lot coverage shall not exceed 20% or the existing lot coverage, whichever is greater. The proposed lot coverage is 20%. 6. The floor area ratio shall not exceed 0.30 or the existing floor area ratio of the structure being demolished, whichever is greater. The proposed FAR is .30 or 30%. 7. The building height, in feet, shall not exceed 30 feet to the highest plate and shall contain no more than 2 '/2 stories. The proposed height is 30 feet to the top of the plate (30 feet maximum to the plate) and the proposed dwelling is 2 1/2 stories. 8. The proposed new dwelling would not be substantially more detrimental to the neighborhood than the existing dwelling.
