As quoted from the "law", an employee is defined as every person in the service of another under any contract of hire, express or implied, oral or written. An employer is defined as an individual,partnership, association, corporation or other legal entity, or any two or more of the foregoing engaged in a joint enterprise, and including the legal representatives of a deceased employer, or the receiver or trustee of an individual,partnership, association or other legal entity, employing employees. However the owner of a dwelling house having not more than three apartments and who resides therein, or the occupant of the dwelling house of another who employs persons to do maintenance, construction or repair work on such dwelling house or on the grounds or building appurtenant thereto shall not because of such employment be deemed to be an employer. MGL chapter 152 section 25 also states that every state or local licensing agency shall withhold the issuance or renewal of a license or permit to operate a business or to construct.buildings in the commonwealth for any applicant who has not produced acceptable evidence of compliance with the insurance coverage required. The facts regarding the lot are as follows: 1. Lot 30 was originally created on a subdivision plan of land recorded with the Barnstable County Registry of Deeds on January 24, 1949 in Plan Book 85, Page 105. 2. When Lot 30 was created in 1949 the zoning in this district was Residence A with no minimum requirements. In 1956, by Article 42 of the Town Meeting that year, the zoning district was changed to Residence B-1 with a minimum square footage requirement of 10,000 square feet. Lot 30 met the square footage requirement at the time of this zoning change. The zoning in this district was changed by Article 99 passed at the Town Meeting held on March F 6, 1969. That Article changed the zoning to Residence B and retained the 10,000 square feet minimum. In 1985, zoning was changed again by Article 1 at the Town Meeting held in said year. Article 1 changed the minimum square footage requirement for Residence B district from 10,000 square feet to one acre. Lot 30 did not meet the minimum required square footage established in 1985. I one acre. Lot 30 did not meet the minimum required square footage established in 1985. 3. In 1985 Lot 30 was owned by John A. Byrne and Marilyn Anne Byrne. The Byrnes continue to own Lot 30 today (see Deed in Book 1450, Page 933 attached). 4. I have examined the title to the abutting properties at the Barnstable County Registry of Deeds. I could not find a deed for any of these lots conveying title into John A. Byrne and/or Marilyn Anne Byrne. Based on the foregoing, it is my opinion that under Section 4 —4.2 5) of the Town of Barnstable Zoning Ordinance Lot 30 as shown on the Plan recorded in Plan Book 85, Page 105 has been held in ownership separate from all abutting lots since 1985. The lot is, for zoning purposes, a buildable, non-conforming lot exempted from the minimum lot size provisions of the Barnstable Zoning Ordinance.
