The facts regarding the lot are as follows: 1. Lots 24C, 24D, and 28C were originally created on a subdivision plan of land dated November, 1959 and recorded with the Barnstable County Registry of Deeds in Plan Book 155, Page 43. 2. When Lots 24C, 24D, and 28C were created in November 1959 the zoning in this district was Residence B-1 with a minimum square footage requirement of 10,000 square feet. Each of these Lots made the square footage requirement at the time of its creation. The zoning in this district was changed by Article 99 passed at the Town Meeting held on March 6, 1969. That Article changed the zoning to Residence B and retained the 10,000 square feet minimum. In 1985, zoning was changed again by Article 1 at the Town Meeting held in said year. Article 1 changed the minimum square footage requirement for Residence B district from 10,000 square feet to one acre. None of the subject lots met the minimum required square footage established in 1985. The three Lots combined do not meet the minimum square footage requirement established in 1985. 3. In 1983 the three lots were owned in common by Janet M. Peznola(see Deed in Book 6388, Page 35 attached). Ms. Peznola conveyed all three lots to John J. Lyons, Jr. by Deed dated June 15, 1988 and recorded in the Barnstable County Registry of Deeds in Book 6388, Page 36. 4. John J. Lyons, Jr. conveyed Lots 24C, 24D, and 28C to Christopher J. Lyons and Jean J. Delisle by a Deed dated January 16, 2003 and recorded in Book 16324, Page 210. 5. Christopher J. Lyons and Jean J. Delisle conveyed their interest in all three lots to the current owner of the property, Channel Point Realty Inc., by a Deed dated March 14, 2003 and recorded in Book 16745, Page 288. Channel Point Realty Inc. presently holds all three lots in common. 6. I have examined the title to the abutting properties at the Barnstable County Registry of Deeds. I could not find a deed for any of these lots conveying title into Janet M. Peznola, John J. Lyons, Jr., Christopher J. Lyons, Jean J. Delisle, or Channel Point Realty Inc. Based on the foregoing, it is my opinion that under Section 4—4.2 5) of the Town of Barnstable Zoning Ordinance Lots 24C, 24D, and 28C as shown on the Plan recorded in Plan Book155, Page 43 are merged into one lot which has been held in ownership separate from all abutting lots since 1985. The one lot resulting from the merger of the three lots is a buildable, non-conforming lot exempted from the minimum lot size provisions of the Barnstable Zoning Ordinance. I have enclosed herewith a copy of the summary sheets and deeds setting forth a summary of the title to Lots 24C, 24D, and 28C as well as the title to all of the abutting lots for your review.
