Dear Mr. Perry:
As I am sure you are aware, this office designed the reinforcing steel used in the Lazy River
and in the Wading Pool for the new Water Park at the Cape Codder Resort in Hyannis.
have been present at the construction site and/or observed progress of the work via
photographs of the work as it continued. The photos were taken by Allan Kealy of Briggs
Engineering and by John Wilson, the Site Manager. Both my On-Site observations and the
photographs reveal that the work of the pool builder Mr.Jeff LeBarge did not follow the
design drawings issued by this office. Rather, he relied on his own ideas and his "47 years of
pool building experience" to provide what he felt was necessary. It was obvious from his
work that he has little knowledge of reinforced concrete design principles. Needed
supplemental reinforcing was omitted around every major penetration of the pool walls.
Further, proper maximum spacing of the reinforcing bars was regularly exceeded.
Near the end of the project, I explained to the owner, Mr.William Catania, that reinforcing to
my specifications is necessary to provide the wall and floor strength needed to resist the
forces generated by freezing in the winter. This resulted.in a statement from him that, "Since
this is an indoor pool, it will never be subject to freezing." I have included a copy of the email
with Mr. Catania's statement to that effect. As long as the Water Park is heated, the
reinforcing, as installed, is adequate and is approved.
The pools are being constructed in a large "greenhouse" enclosure. It is my belief that the
Water Park will be closed during the winter months and may not be heated. Thus the pools
could be subject to freezing temperatures and cracking of the pool shells is a possibility.
However, failure of the Lazy River or the Children's Pool is highly unlikely to cause structural
problems with the building. Based on the willful lack of reinforcing, this office cannot take
responsibility for the strength of the pools if freezing is allowed to occur.

Thanks Bill:
I looked at the new photo and it shows a new bar running
around the opening in the steel cage. This bar will not
transfer the stresses in either the vertical bars or the
horizontal bars as it runs at 90 degrees to the wall steel. I
F! spent quite a lot of time with Jeffs son explaining what
reinforcing does and why it does it. The son told me he
understood but has to do what his father says. Can't blame
him. This means that the job that Jeff has done is
marginally adequate and that unless you keep the ground
from freezing in the winter there is a strong possibility that
the river will fail before its normal 30 to 50 year life. I'm
sorry to have to tell you this but am forced to do so as a
responsible engineer.

DECISION
Introduction
This matter came before the State Building Code Appeals Board("Board") on.
Appellant's appeal application filed pursuant to G.L. c. 143, §100 ("Application"). Appellant
sought relief from 780 CMR Table 903.2, with respect to the addition of a water park within a
courtyard of the existing Cape Codder resort facility, located at 1225 Iyannough Road,
Barnstable (Hyannis), MA ("Appeal").
Procedural History
On or about April 27, 2015, the Building Commissioner for the Town of Barnstable
issued the following decision:
I have reviewed the Code Analysis for the proposed Water Park
space that was provided by your firm, dated April 1, 2015.
I agree that the use group is A-3 and that this Use Group according
to 780 CMR 8" Edition Table 903.2 would require the installation of a[n]
Automatic Fire Sprinkler. In order for this installation not to be required
your firm must obtain a variance from the State Building Code Appeals
Board . . . .
The proposed alternatives that have been explained in the
correspondence of April 1, 2015, and other discussions seem reasonable as
alternative.
As'a result, the Appeal was filed on May 18, 2015.
The Board held a hearing on June 23, 2015. All interested parties were allowed
opportunities to present evidence. The following individuals appeared at the hearing: (for

We also considered the following evidence: (1) State Building Code Appeals Board
Appeal Application (filed May 11, 2015), including "Narrative Summary of Testimony in Favor
of Appeal" and"Key Plan" (which provides a general floor plan for he proposed water park
addition to the facility).
Findings and Discussion
The issue is whether Appellant should be allowed a variance from being required to
install an automatic fire sprinkler system in the proposed water park infill-addition to the existing
hotel, as specified by 780 CMR Table 903.2.
Appellant reiterated the facts, analysis, and proposed upgrades set forth in the Narrative
Summary, and they are incorporated herein by reference. In general, the water park addition will
be infill construction within an existing courtyard space, formed by existing buildings 100, 200,
300, 400, and an existing wave pool. (See also Key Plan). Existing buildings 500 and 600
already are equipped with automatic fire sprinkler systems. Appellant will install automatic fire
sprinkler systems for buildings 100 through 400 as part of the project.
Appellant acknowledged that the existing buildings, as identified, while having some
type of separation from each other, do not constitute separate "buildings"for purposes of the
Building Code---they constitute one "building." Appellant believed that it was practical to
construct true fire walls to separate the parts from one another.
The proposed water park will include a"lazy river"type pool, water slides, children's
play area with water fountains. The skylight roof for the water park, will be approximately 40'
in height, made up of aluminum and glass. The floor will be made up of concrete. Appellant
represented that, in discussions with the Town's Fire Department, all agreed that the water park
would be made up of mostly non-combustible materials (although water slides would be of some
type of plastic material). The water park would be operated year-round.
The Town noted that it was in favor of allowing the requested relief from the automatic
fire sprinkler system in the water park. As a condition for allowing that relief, the Town wanted
the installation of automatic fire sprinkler systems in the tenant-occupied areas presently not so
equipped. Appellant argued that, if it had proposed the installation of an automatic fire sprinkler
system in the water park, it could have done so (along with the construction of.the water park) as
of right, and would not have been required to install fire sprinkler systems in the existing
buildings. (Note that, given the nature of the entire structure---it is one "building---Appellant
also noted height and area limitations, for which it might need further Code relief. See Narrative
Summary and Application. Those other potential areas of Code relief, however, were not before
the Board because the Building Commissioner's denial letter cited only 780 CMR 903.2 with
respect to only the water park.)

We acknowledged that the installation of automatic fire sprinkler system protection in
parts of the building that are of greater fire risk than the water park was a reasonable exchange
for not being required to install fire sprinkler protection in the water park.
Conclusion
Accordingly, we considered a motion to allow a variance from 780 CMR Table 903.2,
with respect to the requirement to install automatic fire sprinkler protection within the water park
area, on condition that Appellant install automatic fire sprinkler protection in the parts of the
building identified as 100, 200, 300, and 400 on the Key Plan(noting that the Building
Commissioner will need to review the other Code sections, cited in the Application, from which
Appellant believes it will need Code relief, or some type of compliance alternative)
("Motion"). The Motion was approved by two-to-one vote (Nunnemacher opposed), and the
Appeal was GRANTED.

Narrative Summary of Testimony in Favor of Appeal
The Cape Codder, 1225 Iyannough Road,Hyannis,MA
The subjects of this appeal are the height and area limitations and automatic sprinkler requirements
of the eighth edition of 780 CMR - the Massachusetts State Building Code (Commercial Code),
including Chapter 34(the 2009 International Existing Buildings Code(IEBC)with Massachusetts
amendments). Specifically,the section of the code which is involved in this appeal filing is Section
and Table 903.2 - Where required (Automatic Sprinkler Systems)as amended by Massachusetts
amendments effective on April 11,2014. The requirements of. Section 420.2-Separation Walls;
Section 503-General Building Height and Area Limitations;Section 504-Building Height;Section
506 - Building Area Modifications; Section 706 - Fire Walls; IEBC Section 1002.1 - Height
Limitations;and IEBC Section 1002.2-Area Limitations are also pertinent to this matter,and their
content and intent is also germane to this appeal application. None of these related sections have
been modified by Massachusetts amendments.
Background:
The Cape Codder is a resort facility consisting of existing residential occupancies for transient guest
occupancy(Group R-1),restaurant and function hall space (Group A-2), an existing indoor wave
pool (Group A-3), and accessory office and administrative space (Group B). There is also an
existing outdoor swimming pool, with a small structure housing pool filter equipment(Group U).
All of the existing spaces are interconnected so that it is possible for guests at the resort facility to
access the residential, restaurant, function hall, and wave pool spaces from one another without
going outdoors. The owners of the facility are contemplating an addition which infills the courtyard
space formed by buildings 200, 300 and the existing wave pool to create an expanded water park
space(Group A-3) in the near term, and subsequently are also contemplating the later addition of
a spa space(Group A-3). Both of these new spaces would also be interconnected with the existing
facility structure. A schematic drawing is attached which shows these spaces and their existing and
proposed orientation. The schematic also shows the area per floor for each of these spaces, and
provides a brief description of the makeup of the structure of each of these spaces. Buildings 100
through 600,as designated,on the schematic are spaces containing the guest residential occupancies.
Buildings 500, 600, and the administrative,restaurant and function hall spaces are equipped with
automatic sprinklers, whereas the other existing spaces(Buildings 100 through 400 and the wave
pool)are not equipped with sprinklers.
In applying its requirements,the building code classifies all buildings according to their construction
type,and according to the occupancy or occupancies which are contained therein. The construction
classification of a building is determined by the combustible properties of its primary structure
elements,and the fire resistance(or lack thereof)of these primary structure elements,measured in
hours, according to a standard fire test, ASTM E-119. Occupancy groups are also classified
according to the purpose(s)and use(s)for which the building or portion thereof is occupied. One of
the means that building codes use to regulate construction is by applying limits to the maximum
height in feet and stories above grade,and the maximum floor area in square feet per story,for which
a particular building may be constructed(including additions thereto). These limits vary,depending
upon the construction classification of the particular building,and the occupancy classification(s)
to be contained therein.
Statement of Problems:
According to Section 502.1of the building code,the building area is defined as the area included
within surrounding exterior walls (or exterior walls and fire walls) exclusive of vent shafts and
courts. A fire wall is a specialized type of wall,defined in Sec. 702.1 as a fire-resistance rated wall

having protected openings,and which restricts the spread of fire and extends continuously from the
foundation to or through the roof,with sufficient structural stability under fire conditions to allow
collapse of construction on either side of the wall without collapse of the wall. Although the various
existing spaces were constructed in phases over time, and although portions of the existing
construction, especially at the pedestrian links between the designated spaces, do possess fire
resistive qualities,my site inspection indicated that none of these fire resistive elements possess the
type of structural independence and stability necessary to qualify as fire walls,nor is it practical to
modify any of the existing construction so as to create fire walls at these locations. As a result, it
must be concluded that,for purposes of determining and applying the height and area limitations of
the code,the existing facility constitutes a single building for building code purposes,and that single
building already exceeds by a significant amount the allowable limitations of the code for height and
area. This is further complicated by the presence of combustible materials in portions of the exterior
wall construction in(third floor)portions of the exterior walls in Buildings 500 and 600,and in the
structure elements of the wave pool. A building must satisfy all of the requirements of a higher
construction classification in order to be eligible for that designation; so the presence of these
combustible elements serves to further limit the classification(and the allowable height and area)
of the facility. The existing facility most nearly satisfies the classification requirements for Type
IRB.
Because of these factors,the construction of any additions to the facility will require relief in the
form of building code variance(s)granted by the State Building Code Appeals Board, in order for
the proposed work to proceed. The arguments in favor or proposed relief, cited below, also note
specific aspects of the proposed alternative method of compliance which will require relief in the
form of building code variance(s)granted by this Board.
Arguments in Favor of Proposed Relief:
There are no practical solutions which would place the owners in a position where any of the
proposed new work could be executed as a matter of right,nor is it practical to attempt to modify
or alter the existing structure(s)to improve their construction classifications to satisfy height and area
limits. The only solutions which allow these plans to proceed involve obtaining relief from the
building code. To that end,we are proposing the following code compliance alternatives:
1. In lieu of installing sprinklers in the expanded Water Park building, it is
proposed to install a complete sprinkler system within the existing Residential
buildings 100,200, 300 and 400. It is also proposed to install two fire department
hose connections in the Water Park addition in order to provide coverage to areas
outside the Barnstable Fire Department's 200 foot reach from apparatus responding
to a fire or other emergency. The sprinkler system proposed for Residential buildings
100, 200, 300 and 400 will be designed and installed as required by the
Massachusetts State Building Code(780 CMR)Eighth Edition. This design will be
based upon the light hazard classification as per NFPA 13-2013 edition. Each floor
of each building will be zoned separately,and will be fed from a new underground
supply to be located in Residential building 300/400. Fire department hose
connections installed in the Water Park will be located and designed as per NFPA 13
- 2013 edition and NFPA 14. The owners also wish to retain existing (unrated)
exterior wall construction, including window openings from Residential buildings
200 and 300 which will now open into the expanded Water Park space:

2. The following upgrades are proposed to be made to the existing fire alarm
system,and to be included in the new fire alarm system:
- Upgrading the Fire Alarm Control Panel (FACP) and the Lobby
Annunciator with voice evacuation capability;
-Programming the new FACP to interface with all existing devices currently
installed in the buildings;
-Installing of a microphone at the front lobby to provide voice evacuation for
the Wave Pool,existing Function Rooms,and Restaurant;
- Upgrading the fire alarm system to be fully addressable for rooms in
Residential buildings 100, 200, 300 and 400 and in the existing Wave Pool
building; and
- Installing of new initiation and notification devices throughout common
areas and guest rooms in Residential buildings 100,200,300 and 400 and in
the existing Wave Pool building.
3. Although,as has been stated,the entire facility constitutes a single building
for purposes of application of the building code, it is proposed to improve the
existing fire resistant construction at the connecting pedestrian links between L
Residential buildings numbers 100, 200, 300 and 400 and the
Administrative/Restaurant/Function Room buildings. The fire resistant construction
at these pedestrian links between Residential buildings 500 and 600 have already
been addressed under a previous project. Our concept is to offset/mitigate
noncompliance with area limitations by providing fire resistant compartmentation to
minimize the spread of fire,smoke and other products of combustion in case of fire
or other emergency. This will be accomplished by upgrading the walls at building
pedestrian links to a one or two hour fire resistance rating (as permitted by the
limitations of existing construction),by providing opening protectives having ratings
appropriate for the fire resistance of these upgraded linking walls,and by providing
automatic closing function for the opening protectives which is tied into the building
fire alarm system.
The proposed code compliance alternatives described above have been developed through extensive
consultation with the Barnstable Building and Fire Departments,and it is our understanding that both
departments are in full support of the relief that has been requested in this application. Therefore,
we respectfully request that the State Building Code Appeals Board grant the building code variances
sought by this application.

Dear Mr. Perry,
On behalf of the Cape Codder Resort and Spa, we will be submitting for a building
permit application to add on a water park space (Group A-3) in the near term, and
subsequently a later addition of a spa space (Group A-3). Both of these new spaces
would also be interconnected with the existing facility structure. A schematic drawing is
attached which shows these spaces and the existing building and spaces. The plan
also shows the proposed orientation and schematic layout.
Because of code requirements, further described within this letter, the construction of
any additions to the facility will require relief, either in the form of compliance
alternative(s) acceptable to you, or in the form of building code variance(s) granted by
the State Building Code Appeals Board, in order for the proposed work to proceed. The
forthcoming information below will outline the specific code issues and proposed
compliance alternatives.
Statement of the Problem
According to Section 502.1 of the building code, the building area is defined as the
area included within surrounding exterior walls (or exterior walls and fire walls)
exclusive of vent shafts and courts. A fire wall is a specialized type of wall, defined in
Sec. 702.1 as a fire-resistance rated wall having protected openings, which restricts the
spread of fire and extends continuously from the foundation to or through the roof, with
sufficient structural stability under fire conditions to allow collapse of construction on
either side of the wall without collapse of the wall. Although the various existing spaces
were constructed in phases over time, and although portions of the existing
construction, especially at the links between the designated spaces, do possess fire
resistive qualities, none of these fire resistive elements possess the type of structural
independence and stability necessary to qualify as fire walls, nor is it practical to modify
any of the existing construction so as to create fire walls at these locations. As a result,
it must be concluded that, for purposes of determining and applying the height and area
limitations of the code, the existing facility constitutes a single building for building code

purposes, and that single building already exceeds by a significant amount the
allowable limitations of the code for height and area. This is further complicated by the
presence of combustible materials in portions of the exterior wall construction in (third
floor) portions of the exterior walls in Buildings 500 and 600, and in the structure
elements of the wave pool. A building must satisfy all of the requirements of a higher
construction classification in order to be eligible for that designation; so the presence of
these combustible elements serves to further limit the classification (and the allowable
height and area) of the facility.
In addition to the matters which require relief from the building code, there is a
provision of the Massachusetts General Laws which will impact the proposed additions
and improvements. Chapter 148, Section 26G, formerly a local option provision of law,
was amended to become a mandatory, statewide law, effective January 1, 2010. The
law requires the installation of automatic sprinklers in non-residential properties which
exceed 7,500 gross square feet in aggregate floor area, and which are undergoing
additions or substantial alterations or renovations. The law specifies that the
aggregate floor area includes "... the sum total of all floor levels, basements, sub-
basements and additions, in the aggregate, measured from the outside walls,
irrespective of the existence of interior fire resistive walls, floors and ceilings".
Residential buildings or portions thereof, are not subject to the law. The law is
enforced by the head of the local fire department, and any relief from the provisions of
the law must be obtained from the Automatic Sprinkler Appeals Board. If relief is
obtained from the height and area limits of the building code, MGL c. 148, § 26G would
require that the existing wave pool, proposed new water park and (future) proposed spa
be equipped with automatic sprinklers. Although MGL c. 148, § 26G would not require
that existing residential Buildings 100 - 400 be equipped with automatic sprinklers, the
building code would require that the existing wave pool, proposed new water park,
(future) proposed spa, and existing Buildings 100 - 400 be equipped with automatic
sprinklers, or that relief be granted therefor.
Proposed Code Alternative Approach
There are no practical solutions which would place the owners in a position where any
of the proposed new work could be executed as a matter of right, nor is it practicable to
attempt to modify or alter the existing structure(s) to improve their construction
classifications to satisfy height and area limits. The only solutions which allow these
plans to proceed involve obtaining relief from the building code, and possibly from the
fire department through the Automatic Sprinkler Appeals Board. To that end, we are
proposing the following code alternatives:
1. In lieu of installing sprinklers in the expanded Water Park, we propose to install
a complete sprinkler system within the residential buildings 100, 200, 300 and
400. We also propose to install two fire hose connections in the Water Park
addition to cover areas outside of the fire departments 200 foot reach from a
truck.

Buildings 100, 200, 300, & 400 sprinkler system will be designed and installed
as required by the Massachusetts State Building Code, 8th edition. The design
will be based upon Light Hazard design as per NFPA 13, 2013 edition. Each
floor of each building will be zoned separately and will be fed from the new
underground supply located in Building 300/400. Fire department hose valves
will be installed in the waterpark and will be located and designed as per NFPA
13, 2013 Edition and NFPA 14.
2. The following up grades are being made to the existing and proposed fire alarm
system.
• Upgrading the Fire Alarm Control Panel and the Lobby Annunciator with voice
evacuation capability.
• Programming the new FACP to interface with all existing devices currently installed in
the building.
• Installation of a microphone at the front Lobby to allow voice evacuation function in the
Wave Pool, the Existing Function Rooms and Restaurant.
• Upgrade the Fire Alarm System to be fully addressable rooms in the 100, 200, 300, 400
Buildings and the existing Wave Pool building.
• Installation of new initiation and notification devices throughout common areas and guest
rooms in the 100, 200, 300, 400 Buildings and the existing Wave Pool Building
3. As stated, the existing facility constitutes a single building for building code
purposes, however, we propose that the links between buildings 100- 200- 300 —
and 400 and the admin./restaurant/function building to have improved fire
resistance between buildings. The links between the 500 and 600 buildings have
already been separated under a previous project. The concept is to offset or
mitigate noncompliance with area limitations by providing fire resistive compart
mentation to minimize spread of fire and smoke in event of an emergency. This
will be accomplished by upgrading the link walls to one or two hour rated,
providing protected openings with their respective fire-resistance requirements
and providing magnetic door hold openers that will be tied into the fire alarm.
