Massachusetts General Law Chapter 148 section 26G, requires the Fire Chief to enforce the sprinkler protection of new buildings and new additions of 7,500 square feet or more. There are very few exceptions to this law and none apply to this project. Therefore, as the law requires, The Fire Chief is complying with M.G.L. 148 sec. 26G in requiring sprinkler protection of this new building. Any aggrieved party, not just the owner, may appeal to the State Fire Marshal or may appeal to the Automatic Sprinkler Appeals Board. RgacLcam February 22,2001 Mr. Elbert Ulshoeffer,Building Commissioner Town of Barnstable 367 Main Street Hyannis, MA 02601 Re: The Cape Codder Resort Dear Sir: We are currently working on a pool an closure addition to the Cape Codder Resort for Dan'l Webster/Hearth 'n Kettle Management Corp.of Hyannis- The addition shall be a one-story, 8,064 square foot building of masonry construction with glu-lam roof trusses, classified by the Massachusetts State Building Code as an A-3 use group and classified by the Table 602 as Type 36,construction type,, According to Table 1008.2 of the Code, an assembly area without fixed seats, unconcentrated, based of a floor area of 7,811 square feet at 15 square feet per person,would have an occupancy of 521 people. Because most of the floor area of this room is to be occupied by a swimming pool, this is probably an excessive calculation of the actual number of occupants for safety reasons alone,however, this number must be used to calculate exits. Therefore, two of the stationary door units must and will be changed to swinging egress doors,with appropriate identification and hardware- Regarding the issue of whether a sprinkler system is required for this building, I have researched the code at length and have found the following references: 789 CMR 102.0 APPLICABILITY 102.1 General: The provisions of 780 CMR shall apply to all matters affecting or relating to buildings and structures,as set forth in 780 Ch7R 101.0 and shall apply with equal force to municipal, county,state authorities of or established by the legislature and private buildings and structures, except where such buildings and structures are otherwise provided for by statute. The construction, reconstruction,alteration,repair, addition, change in use or occupancy, demolMon, removal of all buildings and structures shall comply with 780 CMR. 780 CMR 105.0 DUTIES AND POWERS OF THE BUILDING OFFICIAL 106.1 General: The inspector of buildings and local inspector(herein after building official)shall enforce all of the provisions of 780 CMR, 521 CMR(Architectural Access Board)and any other statutes, rules and regualations,or ordinances or bylaws which empower the building official. The building official shall act on any question relative to the mode or manner of construction and materials to be used in the construction, reconstruction, alteration, repair, demolition, removal, installation of equipment and their location, use, occupancy and maintenance of all buildings and structures, except as otherwise provided for by statutory requirements or as provided for in 780 CMR 109.0. M, S-1, F-1 In the Massachusetts Building Code,there is no specific reference for fire protection systems above a swimming pool. It would not serve any purpose to have sprinklers above the pool which will cover approximately 75%of the room. Needless, to say the pool deck will be of concrete and non-combustible. The exterior walls are concrete block and are non-combustible the roof trusses are heavy timber and over 14 feet above the pool deck. For these reasons and the above references from the Code, it would be unnecessary to install an automatic fire suppression system in this room. However, of much ,more use would be an automatic fire detection and signal system with manual pull stations, as required by the Code.
