Background & Relief Requested In Appeal 2012-054, Global Companies LLC proposed to construct an approximately 50 ft x 53 ft canopy over existing fuel pump islands in front of a gas and service station. The canopy was proposed to be set back +/-9 ft from the property line along Rte. 132, where the minimum front yard setback requirement is 100 feet. The canopy was proposed to be 15.5 ft. high. Recessed LED lighting was proposed to illuminate the pumps.The canopy addition was proposed in conjunction with various other improvements to the site, including replacement of the islands and fuel pumps. The number of.pumps was not proposed to increase. The Applicant also proposed to install new landscaping within the island at the corner of Rte. 132 and Old Strawberry Hill Road. The subject property is a .88 acre parcel with frontage on Rte 132 and Old Strawberry Hill Road. The property is bounded on the east by a private driveway labeled Captain Cook Lane, which serves an adjacent residential condominium development. The property is developed with a 1,88.0 sq.ft gas and service station., built in 1968. The station consists of four fuel pumps, a two-bay service station, and a small convenience retail area. The first pump island is set back approximately 20 feet from the property line along Rte. 132. The.use is preexisting non- conforming in the Wellhead Protection Overlay District. Procedural & Hearing Summary Variance No. 2012-054 for the construction of a 50' x 53' gas station canopy located 9 feet from the front property line was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on October 12, 2012. A public hearing before'the Zoning Board of Appeals was:duly advertised and notice sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened November 14, 2012 at which time the Board found to grant the Variance subject to conditions. Board Members deciding this appeal were Board Chair Laura F. Shufelt, William.H. Newton, Craig G. Larson, Alex M. Rodolakis, and George T. Zevitas. :Anthony Furchtl, P.E. of Ayoub Engineering, Inc. represented the Applicant before the Board. A representative from Global Companies was also present. Mr. Furchtl provided a summary of where lot was located and the existing conditions, stating the station has been in the location for Town of Barnstable Zoning Board of Appeals—Decision and Notice Variance No.2012-054—Global Companies LLC over 40 years. He outlined the proposal for the canopy and said it would improve customer service and ameliorate lighting conditions for customers and surrounding property owners. He discussed the setbacks,and also wetlands present on the property, and explained how they reduced the building envelope to an almost unusable area. He discussed how the canopy would_ not increase the impervious area and outlined plans to improve landscaping on the.site. The Board questioned the relief granted in 1991 and the Applicant clarified that the permits were. sought by a prior property owners. The Board clarified the nonconforming status of the use and structures. In response to questions from the Board, the Applicant stated the height of the canopy was an industry standard. The Board and Applicant clarified the front setbacks and discussed the need for a barrier between the street and the pumps. The Applicant agreed to install bollards along the front landscape area as an added safety measure. Public comment was requested and no one spoke in favor or in opposition to the request. Findings of Fact At the hearing of November 14, 2012, the Board unanimously made the following findings of fact for Appeal No. 2012-054, a request for a variance to construct a 50' x 53' canopy within the required 100 ft front yard setback at 1449 lyannough Road, Hyannis: 1. In Appeal 2012-054, Global Companies LLC applied for a variance from Section 240-21.E, the minimum front yard setback requirement in the Business District. The Applicant is proposing to construct a canopy over existing fuel service islands within the required 100 foot setback from Route 132. The 50' x 53' canopy is proposed in conjunction with upgrades and site improvements to the existing gas and service station. 2. The subject property is located.at 1449 lyannough Road (Rte 132), Hyannis, MA as shown on Assessor's Map 274 as Parcel 020. It is in the B Business District. The use is preexisting nonconforming in the Wellhead Protection Overlay District. 3. The canopy addition is proposed in conjunction with various other improvements to the site, including replacement of the islands and fuel pumps. The number of pumps is not proposed to increase. There exist circumstances related.to soil conditions, shape, or topography of such land or structures and especially affecting such'land or structures, but not affecting generally the zoning district in which it is located. The setback requirements and the presence of wetlands restrict the buildable area of the lot 5. A literal enforcement of the provisions of the zoning ordinance would involve substantial hardship, financial or otherwise to the petitioner. 6. The desirable relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of the zoning ordinance. The canopy will benefit both customers and surrounding property owners by improving the appearance of the station and lighting conditions. The vote to accept the findings was: AYE: Laura F. Corporation,. applied to the Board for a Special Permit , pursuant to Section 3-3 .6(3) of the Barnstable Zoning Ordinance to allow an existing service and gasoline station to be razed and rebuild an existing service and gasoline station with modern equipment and structures on this site. This appeal is related to petition # 1991-49 for Variance. The Board and the .applicant determined to discuss petition 1991-48 simultaneously with petition # 1991-49. The applicant's site is shown on assessor's map/Parcel number 174/20 , and is located at southeastern intersection._. of Old Strawberry Hill Road/Route 132, Hyannis/Centerville, MA and is zoned HB Highway Business District. The applicant requested that the Zoning Board of Appeals grant a Special Permit for rebuilding of an existing , gas/service station under Section 3-3 . 6(3) of the Zoning Ordinance. According to the information submitted by the applicant, the lot currently contains an existing station with service bays and control panels for two parallel islands and ingress/egress to Route 132 and Old Strawberry. Hill . Road. The applicant proposes to raze and rebuild an existing service and gasoline station with modern equipment and structures on this site. The petitioner's request was heard by .Board members : Gail Nightingale, Luke Lally, Elizabeth Nilsson, Gene Burman and Chairman Dexter Bliss . Summary of Evidence: The applicant was represented by Attorney Michael Stusse and also present to assist in this appeal were Mr. Carroll , Mr. Guliano of Mobil Oil Corporation, Mr. Alex Traki.mas of Gales Associates and the operator of the station, Mr. Falvey. Attorney Stusse submitted a memo and a site plan to the board.. He discussed the background of the property under consideration and stated that a site plan was approved .on August 7, . 1991 after several rdviews by the Site Plan Review Committee and the Mass Department of Public Works . Currently the site is developed with an existing station _with service. bays .and control panels for two parallel islands and is ingress and egress from Route 132 .and Old Strawberry Hill Road. The applicant proposes to raze the existing building and replace with a modern building referred to as "Pegasus-type structure" and change the configuration of the gas pump islands. One of the curb cuts along Route. 132 will closed and be replaced with one full access curb cut on Route 132 and another along Strawberry Hill Road. The proposed building will be setback 100 feet from Route 132. The proposed pump islands will be perpendicular to Route 132 with a canopy and will . be setback 20 feet from Route 132. Attorney Stusse stated that the lot coverage will . be less than the existing, and landscaping will be improved to the rear where .an existing wooded area separate the station and abutting Strawberry Hill Condo's parking area. Landscaping -will also be improved along the western side of the site. The Board questioned the applicant concerning the site .plan, its proposed planting area and the building configuration and use and relationship of the .site to Route 132 layout. Attorney Stusse further stated that the site, with proposed changes., will be in greater compliance with the requirements of the Zoning Ordinance than is at present. The pump islands will be approximately 20 feet further setback from the sideline of Route 132. The existing building which is setback 65 feet from Route 132, the proposed building will be+ 110 feet from the sideline of Route 132 and approximate 40% of the site will be vegetated and landscaped. One curb cut, along Route 132 will be eliminated and the site will . conform to the requirements of the Massachusetts Department of Public Works (DPW) and the Town of Barnstable' DPW. Mr Stusse discussed the criteria of relief from Bulk Regulations of the Zoning Ordinance. He stated that given the shape of the .Iot, . only a small portion. of the lot. may be developed.. He discussed that hardship exist due to shape, topography and soil conditions on the lot that qualifies for relief. The Board questioned the use of the small wooden building in the corner which is indicated as remaining on the site. Attorney Stusse responded that the building will remain until the Department of Environmental Protection (DEP) allow it to be removed. The building, contains an air stripping device. Mr. Stusse noted that the petitioner has installed fiberglass, double hulled tanks with sensor devices, to monitor either groundwater infiltration into the hull or gasoline leaking into the hull . The Board questioned the percentage use of the present building . Mr. Stusse responded that there are two service bays and a separate room for sales and storage of snack items such as tonic, cigarettes, potato chips - prepackaged snacks , etc. The reconfiguration is for three perpendicular islands , a building containing two .bays entered from the side and a sales area of 525 square feet. The building will also contain two rest rooms and storage space around the sales area for ci.garettes' .and automotive s.upplies . Attorney Stusse stated that the Town traffic engineer has determined that the proposed perpendicular pump islands versus parallel would greatly improve the traffic circulation .on site. The proposal would not add more traffic on Route 132 than existing but the number of pumps will allow better service to customers. The applicant will widen Route 132 to provide shoulder along north side of Route 132 in front of the site for vehicles to go around without stopping behind cars making left turns into the gas station. About $ 100,0.00 of road improvements will be done to alleviate traffic impact on Route. 132. The petitioner will be required to appear before the Conservation Commission as they are within 100 feet of the wetlands. The Board questioned the distance from the layout of the road. to the first physical structure of first pump. Attorney Stusse stated that the first pump is 40 feet from the sideline of the of Route 132. The right corner of the building from Strawberry Hill Road is 24' as compared to . required 60 ' setback from Old Strawberry Hill Road of the Zoning Ordinance. No one spoke i.n favor of the petition as presented. Mr. Gargan appeared to represent Mr. McDonough, an abutter , and owner of the Rainbow Motel spoke against the petition and questioned Attorney Stusse if he had been in touch with the DEP regarding this change. Mr. Gargan discussed a gasoline spill of 86, 000 gallons in 1989 which he attributes to the Mobil Station. Mr. Gargan stated that the spill went down to the Rainbow Motel and Shallow Pond. Mr. Gargan feels that before any work is done, that DEP should be contacted. Mr. Gargan also questioned the proposed underground tanks . Attorney Stusse stated .that the tanks are in place and will remain SO. Attorney Stusse discussed that the DEP under MGL Chapter 21E is monitoring the site, Attorney Stusse stated that the DEP does. not have to approve this site and that the applicant is here. only to address the zoning issues . Mr. McDonough addressed the Board and discussed the Comprehensive Zoning Article (Groundwater Protection Overlay District Provisions) of 1988 that prohibited an increase of hazardous material in an area of contribution or recharge, which this falls into. Mr. McDonough discussed the lack of the petitioner filing with the Conservation Commission in the past. Mr. McDonough expressed his concerns regarding a drain on the Strawberry Hill side. of the station which has never been cleaned and allows oil from the station to wash down onto his property and into Shallow Pond. Mr. McDonough .discussed his. inability to sell . his property and he submitted a letter to the Board dated February 19, 1989 which he requested be entered into the record. The Board discussed that the spill factor is not something that is r-eally before the Board, but is important and the Board focus this evening is on the Zoning aspects of this app l i cat ion. Mr Stusse stated that, with respect to the drainage easement question raised by Mr. McDonough, he submitted a copy of the easement , into the record. Mobil Oil granted an easement to the inhabitants of the Town of Barnstable in May, 1979 to maintain drainage from Route 132 to the pond, but, Mobil Oil Corporation never agreed to maintain the system. At the meeting of October 10, 1991 , the Board decided to take the matter under advisement and to ,perform a site visit to- assist the determination of facts related to this request. Finding of Facts : At the . November 21 , 1991 meeting, the Board made the following finding of facts as .related to petition # 1991-48: . 1 . That the applicant has gone through process of site plan review and has contributed in the form of eliminating one curb cut along Route 132 and widening of Route .132. 2. That the use is non-conforming in the neighborhood, and M if the petitioner was not allowed to continue the use and . renovation, would create extreme hardship given the allowed uses in the area. 3. That the applicant would increase the green area as compared to present. Ayes : Nilsson, Bliss , Burman Nays Nightingale Decision: Based upon the evidence presented and finding of facts, at a meeting held on November 21 , . 1991 , by a .mo.tion duly made and seconded, the Board voted to grant the Special Permit with the following restrictions : 1 . The drainage trench that runs parallel to Old Strawberry Hill Road with a .metal grate over it, whi.ch' is now the apparent responsibility of the Town. of Barnstable, and the easement, be assumed by the Mobil Corporation. It would be the duty of Mobil Corporation to clean and maintain that area so that there will not be continuous water and other waste overflow down into the Strawberry Hill area and into Mr. . 'McDonough's property. . 2 . All deliveries be made from the Route 132 entrance. 3 . No outside display or sale of food items . 4. The sign shall comply with the Town Sign Code. 5. The petitioner comply with conditions of the Site Plan Review, Board of Health and Conservation Commission. 6. All the construction should be done as per plan submitted and prepared for Mobil Oil Corporation, dated 6/ 14/91 , 1449 Route 132, Hyannis , MA, site plan :M 1191 , received by the Building Department, Town of Barnstable on 8/9/91 . Mobil .Oil Corporation Summary of Relief Sought: At a regularly scheduled hearing of the Zoning Board of Appeals, held on October 10, 1991 and continued to November 21 , 1991 notice of which was duly published in the Barnstable Patriot and forwarded to all interested parties pursuant to MGL ,Chapter 40A, the applicant, Mobil Oil Corporation , .applied to the Board for a Variance, pursuant to Section 3-5'.2 (6) (B) . Groundwater Protection Overlay Districts and Section 3-3 . 6 (5) Bulk Regulations, of the Barnstable Zoning Ordinance to allow an existing service and gasoline station to be razed and rebuild an existing service and gasoline station with modern equipment and structures on this site. This appeal is related to petition # 1991-48 for a Special Permit. The Board and the applicant determined to discuss petition # 1991-49 simultaneously with petition # 1991-48. The applicant's site is shown on assessor's map/Parcel number 174/20 , and is located at southeastern intersection of Old Strawberry .Hill Road/Route 132, Hyannis/Centerville , MA and is .zoned HB Highway Business District . The applicant requested .that the Zoning 'Board of Appeals grant a Variance for rebuilding of an existing gas/service station under Sections 3-5.2(6) (B) and 3-3 .6(5) of the . Zoning Ordinance. According to the information submitted by the applicant, the lot currently contains an existing station with service bays and control panels for two parallel islands and ingress/egress to Route 132 and Old Strawberry Hill Road. The applicant proposes to raze and rebuild an ex.isting service and gasoline station .with modern equipment and structures on this site. The petitioner' s request was heard by Board members: Gail Nightingale, Luke Lally, Elizabeth Nilsson, Gene Burman and Cha i-rman Dexter Bliss. Summary of Evidence: The applicant was represented by Attorney Michael Stusse and also present to assist in this appeal were Mr . Carroll , Mr . Guliano of Mobil Oil Corporation, Mr. Alex Trakimas of Gales O Associates and the operator of the station, Mr. Falvey. Attorney Stusse .submitted a memo and a site plan to the board. He discussed the background of the property under- consideration and stated that ar- site plan was approved on August 7, 1991 after several reviews by the Site Plan Review Committee and the Mass Department of Public Works . Currently the site is developed with an existing station with service bays and control panels for -two parallel islands and is ingress and egress from Route 132 and Old Strawberry Hill Road. The applicant proposes to raze the existing building and replace with a modern building referred to as "Pegasus-type structure" and change the configuration of the gas pump -islands. One of the curb .cuts along Route 132 will closed and be replaced with one full access curb cut on Route 132 and another along Strawberry. Hill Road. . The proposed building will be setback 100 feet. from Route 132. The proposed pump islands will be perpendicular to Route 132 with a canopy and will be setback 20 feet from Route 132. Attorney Stusse stated that the lot coverage will be less than the existing, and .landscaping will be improved to -the rear where an existing wooded area separate the station and abutting Strawberry Hill Condo's parking area. Landscaping will also be improved along the western side of the site. The Board questioned the applicant concerning the site plan, its proposed planting area .and the building configuration and use and relationship of the site to Route 132 layout. Attorney Stusse further stated that the site, with proposed changes, will be in greater compliance with the requirements of the Zoning Ordinance than is at present. The pump islands will be approximately 20 feet further setback from the sideline of Route 132 . The existing building which is setback 6.5 feet .fr.om Route 132 , the proposed building will be 110 feet from the sideline of Route 132 and approximate 40% of the site will be vegetated and landscaped. One curb cut along Route 132 will be eliminated and the site will conform to the requirements of the Massachusetts Department of Public Works (DPW) and the Town of Barnstable' DPW. Mr Stusse discussed the criteria of relief from Bulk Regulations of the Zoning Ordinance. He stated that given the shape of the lot, only a small portion of the lot may be developed.. He discussed that hardship exist due to shape, topography and soil conditions on the lot that qualifies for relief. The Board questioned the use of the small wooden building in the corner which is indicated as remaining on the site. Attorney Stusse responded that the building will remain . until the Department of Environmental Protection (DEP) allow it .to be removed. The building contains an air stripping device. Mr. Stusse noted that the petitioner has installed fiberglass , double hulled tanks with sensor devices , to monitor either groundwater infiltration into the hull or gasoline leaking into the hull . The Board questioned the percentage use of the present building. Mr . Stusse responded that there are two service bays and a separate room for sales and storage of snack items such as tonic:, cigarettes, potato chips - prepackaged snacks , etc. The reconfiguration is for three perpendicular islands , a building containing two bays entered from the side and a sales area of 525 square feet. The building will also contain two rest rooms and storage space around the sales area for cigarettes and automotive supplies. Attorney Stusse stated that the Town traffic engineer has: determined that the proposed perpendicular pump islands versus parallel would greatly improve the traffic circulation on site. The proposal would not add more traffic on Route 132 than existing but the number of pumps will allow better service to customers . The applicant will widen Route 132 to provide shoulder along north side of Route 132 in front of the site for vehicles to go around without stopping behind cars making left turns into the gas station. About $ 100 , 000 of road improvements will be done to alleviate traffic impact on Route 132. The petitioner will be required to appear before the Conservation Commission as they are within 100 feet .of the wetlands . The Board questioned the distance from the layout of the road to the first physical. strgcture of first pump. Attorney Stusse stated that the first pump is 40 feet from the sideline of the of Route 132. The right corner of the . building from. Strawberry Hill Road is 24' as compared to required 60' setback from Old Strawberry Hill Road of the Zoning Ordinance. No one spoke in favor of the petition as presented. Mr. Gargan appeared to represent Mr. McDonough, an abutter , and owner of the Rainbow Motel spoke against the petition and quest.ioned Attorney Stusse. if he had been in touch with the DEP regarding this change. Mr. Gargan discussed a gasoline spill of 86, 000 gallons in 1989. which he attributes to the Mobil Station. Mr. Gargan stated that the spill went down to the Rainbow Motel and Shallow Pond. Mr. Gargan feels that .before any work is done, that DEP should be contacted. Mr. Gargan also questioned the proposed underground tanks . Attorney Stusse stated that the tanks are in place and will remain so. Attorney Stusse discussed that the DEP under MGL Chapter 21E is monitoring the mite. Attorney Stusse stated that the DEP does not have to approve this site and that the applicant is here only to address the - zoning issues . Mr. McDonough addressed the Board and discussed the Comprehensive Zoning Article (Groundwater Protection Overlay District Provisions) of 1988 that prohibited an increase of hazardous material in an area of contribution or recharge, which this falls into. Mr. McDonough discussed the lack of the petitioner filing with the Conservation Commission in the past. Mr. McDonough expressed his concerns regarding a drain on the Strawberry Hill side of the station which has never been cleaned and allows oil from the station to wash down onto his property and into Shallow Pond. Mr. McDonough discussed his inability to sell his property and. he submitted a .letter to the Board dated February 1.9, 1989 which he requested be entered into the record. The Board discussed that the spill factor is not something than is really before the Board, but is important and the Board focus this evening is on the Zoning aspec.ts. of this application. Mr Stusse stated that, with respect to the drainage easement question raised by Mr.. .McDonough, he submitted a copy of the easement, into the record. Mobil Oil granted an easement to the inhabitants of the Town of Barnstable in. May, 1979 to .maintain drainage from Route 132 to the pond, but, Mobil Oil Corporation never agreed to maintain the system. At the meeting of October 10, 1991 , the Board decided to take the matter under advisement and to 'perform a site visit to- assist the determination of facts related to this request. Finding of Facts : At the November 21 , 1991 meeting, the .Board made the following finding of facts as related to petition ## 1991-48: 1 . That the zoning district and its setback as relate to this specific lot would indeed create a hardship and .by granting a setback variance would not affect the area and denial of the setback variance would create a hardship to the petitioner in that he would not be able to build, virtually any structure or a structure less than the Board has discussed for the operation of gas station business , on this lot. 2 . That setback does relate to the land. . -Y. 3. That it would .be substantial financial hardship to the applicant if he could not utilize the lot for a use that had been in existence and .would be continuation of the same use. i , 4. That the Board has found in its decision of Appeal # 1991-48, that the use would not be substantially more detrimental to the neighborhood. Groundwater Protection . Overlay Districts and Section 3-3 . 6 (5) Bulk Regulations,. of the Barnstable Zoning Ordinance to allow an existing service and gasoline station to be razed and rebuild an existing service and gasoline station with modern equipment and structures on this site. This appeal is related to petition ## 1991-48 for a Special Permit . The Board and the applicant determined to discuss petition # 1991-49 simultaneously with petition # 1991-48. The applicant's site is shown on assessor' sCmap/P�rrce;l number_174120�, and is located at southeastern intersection of O l d Strawberry H i t l'Road/route ��- H�% �/Gentery i 1 1,'e , MA and is zoned HB Highway Business District. The applicant requested that the Zoning Board of Appeals grant a Variance for rebuilding of an existing gas/service station under Sections 3-5.2(6) (B) and 3-3.6(5) of the Zoning Ordinance. According to the information submitted by the applicant, the lot currently contains an existing station with service bays and control panels for two parallel islands and ingress/egress to Route 132 and Old Strawberry Hill Road. The applicant proposes to raze and rebuild an existing service and gasoline station with modern equipment and structures on this site. The petitioner' s request was heard by Board .membe.rs : Gail Nightingale, Luke Lally, Elizabeth Nilsson, Gene Burman and Chairman Dexter Bliss . Summary of Evidence: The applicant was represented by Attorney Michael Stusse and also present to assist in this appeal were Mr . Carroll , Mr . Guliano of Mobil Oil Corporation, Mr. Alex Trakimas of Gales Associates and the operator of the station , Mr. Falvey. Attorney Stusse submitted a memo and a site plan to the board. He discussed the background of the property under- consideration and stated that ar` site plan was approved on August 7 , 1991 after several reviews by the Site Plan Review Committee and the Mass Department of Public Works . Currently the site is developed with an existing station with service bays and control panels for two parallel islands and is ingress and egress from Route 132 and Old Strawberry Hill Road. The applicant proposes to rate the existing building and replace with a modern building referred -to as "Pegasus-type structure" and change the configuration of the gas pump islands . One of the curb cuts along Route 132 will closed and be replaced with one full access curb cut. on Route 132 and another along Strawberry Hill Road. The proposed building will be setback 100 feet from Route 132. The proposed pump islands will be perpendicular to Route 132 with a canopy and will be setback 20 feet from Route 132. Attorney Stusse stated that the lot coverage will be less than the existing, and landscaping will be improved to the rear. where an existing wooded area separate the station and abutting Strawberry Hill Condo's parking area. Landscaping will also be improved along the western side of the site. The Board questioned the applicant concerning the site plan, its proposed planting area and the building configuration and use and relationship of the site to Route 132 layout. Attorney Stusse further stated that the site, with proposed changes, will be in greater compliance with the requirements of the Zoning Ordinance than is at present. The pump islands will be approximately 20 feet further setback from the sideline of Route 132 . The existing building which is setback 65 feet from Route 132, the proposed building will be 110 feet from the sideline. of Route 132 and approximate 40% of the site will be vegetated and landscaped. One curb cut along Route 132 will be eliminated and the site will conform to the requirements of the Massachusetts Department of Public Works (DPW) and the Town of Barnstable' DPW. Mr Stusse discussed the criteria of relief from Bulk Regulations of the Zoning Ordinance. He stated that given the shape of the lot, only a small portion of the lot may be developed. He discussed that hardship exist due to shape, topography and soil conditions on the lot that qualifies for .relief. The Board questioned the use of the small wooden building in the corner which is indicated as remaining on the site. Attorney Stusse responded that the building will remain until the Department of Environmental Protection (DEP) allow it to be removed. The building contains an air stripping device. Mr . Stusse noted that the petitioner has installed fiberglass , double Hulled tanks with sensor devices , to monitor either groundwater infiltration into the hull or gasoline leaking into the hull . The Board questioned the percentage use of the present building. Mr . Stusse responded that there are two service bays and a separate room for sales and storage of snack items such as tonic, cigarettes , potato chips - prepackaged snacks , etc. - The reconfiguration is for three perpendicular islands , a building containing two bays entered from the side and a sales area of 525 .square feet. The building will also contain two rest rooms and storage space around the sales area for cigarettes and automotive supplies . Attorney Stusse stated that the Town traffic engineer has determined that the proposed perpendicular pump islands versus parallel would greatly improve the traffic circulation on site. The proposal would not add more traffic on Route 132 than existing but the number of pumps will allow better service to customers . The applicant will widen Route 132 to provide shoulder along north side of Route 132 in front of the site for vehicles to go around without stopping behind cars making left turns into the gas station. About $ 100 , 000 of road improvements will be done to alleviate traffic impact on Route 132. The petitioner will be required to appear before the Conservation Commission as they are within 100 feet .of the wetlands. The Board questioned the distance from the layout of the road to the first physical strgcture of first .pump. Attorney Stusse stated that the first pump is 40 feet from . the sideline of the of Route 132. The right corner of -the building from Strawberry Hill Road is 24' as compared to required 60' . setback from Old Strawberry Hill Road of the Zoning Ordinance. No one spoke in favor of the petition as presented. Mr. Gargan appeared to represent Mr. McDonough, an abutter, and owner of the Rainbow Motel spoke against the petition and questioned Attorney Stusse if he had been in touch with the DEP regarding this change. Mr. Gargan discussed a gasoline spill of 86, 000 gallons in 1989 which he attributes to the Mobil Station. Mr . Gargan stated that the spill went down to the Rainbow Motel and Shallow Pond. Mr. Gargan Feels that before any work is done, that DEP should be contacted. Mr . Gargan also questioned the proposed underground tanks . Attorney Stusse stated that the tanks are in place and will remain so. Attorney Stusse discussed that the DEP under MGL Chapter 21E is monitoring the 5ite.. Attorney Stusse stated that the DEP does not have to approve this site and that the applicant is here only to address the zoning issues . Mr. McDonough addressed the Board and discussed the Comprehensive Zoning Article (Groundwater Protection Overlay District Provisions ) of 1988 that prohibited an increase of hazardous material in an area of contribution or recharge, which this falls into. Mr. McDonough discussed the lack of the petitioner filing with the Conservation Commission in the past. Mr. McDonough expressed his concerns regarding a drain on the Strawberry Hill side of the station which has never been cleaned and allows oil from the station to wash down onto his property and into Shallow Pond. Mr. McDonough discussed his inability to sell his property and he submitted a letter to the Board dated February 19, 1989 which he requested be entered into the record. The Board discussed that the spill factor is not something that is really before the Board, but is important and the Board focus this evening is on the Zoning aspects of this application. Mr Stusse stated that, with respect to the drainage easement question raised by Mr. McDonough, he submitted a copy of the, easement, into the record. Mobil Oil granted an easement to the inhabitants of the Town of Barnstable in May, 1979 to maintain drainage from Route 132. to the pond, but, Mobil Oil Corporation never agreed to maintain the system. At the meeting of October 10 , 1991 , the Board decided to take the matter under advisement and to perform a site visit to- assist the determination of facts related to this request. Finding of Facts : At the November 21 , 1991 meeting, the Board made the following finding of facts as related to petition # 1991 -48: 1 . That the zoning district and its setback as relate to this specific lot would indeed create a hardship and by granting a setback variance would not affect the area and denial of the setback variance would create a hardship to the petitioner in that he would not be able to build, virtually any structure or a structure less than the Board has discussed for the operation of gas station business, on this lot. 2. That setback does relate to the land. 3 . That it would be substantial financial hardship to the applicant if he could not utilize the lot for a use that had been in existence and .would be continuation of the same use. 4. That the Board has found in its decision of Appeal # 1991-48, that the use would not be substantially more detrimental to the neighborhood. The vote on the finding of facts was as follow: Ayes : Nilsson; Bliss , Burman, Lally and Nightingale (who voted i n favor except for f i nd i ng .## 4) .
