Massachusetts General Laws chapter 152 requires all employers to provide workers'compensation for their employees.
Pursuant to this statute, an employee is defined as"...every person in the service of another under any contract of hire,
express or implied,oral or written."
An employer is defined as"an individual,partnership,association,corporation or other legal entity,or any two or more
of the foregoing engaged in a joint enterprise,and including the legal representatives of a deceased employer,or the
receiver or trustee of an individual,partnership, association or other legal entity,employing employees. However the
owner of a dwelling house having not more than three apartments and who resides therein,or the occupant of the
dwelling house of another who employs persons to do maintenance,construction or repair work on such dwelling house
or on the grounds or building appurtenant thereto shall not because of such employment be deemed to be an employer."
MGL chapter 152, §25C(6)also states that"every state or local licensing agency shall withhold the issuance or
renewal of a license or permit to operate a business or to construct buildings in the commonwealth for any
applicant who has not produce&acceptable evidence of compliance with the insurance coverage required."
Additionally,MGL ehapter.152, §25C(7)states"Neither the commonwealth nor any of its political subdivisions shall
enter into any contract for.the performance of public work until acceptable evidence of compliance with the insurance
requirements of this chapter have been presented to the contracting authority.

Dear Mr. Perry:
I have examined the title to the real estate at 50 Jennifer Lane, Hyannis, ("Locus")
and the adjoining parcels at 32 Jennifer Lane (Parcel 121) and 58 Jennifer Lane
(comprising a portion of Parcel 168, all of Parcels 167 and 166 and a portion of Parcel
165 on Map 271), from February 1985 to the present in order to determine whether any
parcels have merged with Locus for zoning purposes. Based on my examination and the
information you have furnished, I render the following opinion:
1. Locus contains 20,838 square feet of area (.48 acre) and 140.94 feet of
frontage.
2. Locus is shown as parcel 122, Map 270, and a portion of Parcel 168, Map
271.
3. Locus is located in a RB residential zoning district and a Well Protection
Overlay District (WP).
4. ` . Locus first became nonconforming in February 1985, when the minimum
area requirement was increased from 10,000 square feet to 43,560 square
feet (1 acre).
5. At no time since February 1985 has Locus been held in common ownership
with the parcels at 32 Jennifer Lane or 58 Jennifer Lane.

6. The present owner of Locus is Melbourne K. Nickerson, also known as M.
Kempton Nickerson under two deeds, one from Oliver Chisholm, et al,
dated October 1, 2003, recorded in Book 18038, Page 124, Tab 1, and the
other from Jeffrey Pepi, dated September 24, 2005, recorded in Book
20311, Page 20. Tab 2 From July 24, 1956, until her death on January 17,
1982, title to Locus stood in the name of Eunice Chisholm, by deed from
Moses A. Grace and Ella V. Chase, dated July 24, 1956, recorded in Book
949, Page 589. Tab 3. Title to Locus passed to Oliver Chisholm, et al,
under the Estate of Eunice Chisholm, Barnstable Probate and Family Court
Docket No. 90P-1604-AD 1.
7. Title to 32 Jennifer Lane is presently in the name of Priscilla Williams
Brown under a deed from Moses A. Grace, dated November 13, 1943,
recorded in Book 608, Page 120. Tab 4.
8. Title to 58 Jennifer Lane is presently in the name of Jeffrey Pepi; under a
deed from Dorothy E. Scott, dated October 17, 2003, recorded in Book
17813, Page 95. Tab 5. The premises at 58 Jennifer Lane is comprised of
a portion of Parcel.168, all of Parcels 167 and 166 and a portion of Parcel
165 on Map 271. From November 30, 1968, until his death on in 1999, title
to 58 Jennifer Lane was in the name of John A. Scott, Jr., under a deed
from the Town of Barnstable, dated November 30, 1968, recorded in Book
1283, Page 841. Tab 6. Title to 58 Jennifer Lane passed to Dorothy E.
Scott, the surviving spouse of John A. Scott, Jr., under the Estate of John
A. Scott, Jr., Barnstable Probate and Family Court, Docket No. 99P-0909-
WF.
9. Based on the above facts, it is my opinion that Locus is a separate building
lot for zoning purposes.

NOTE: This letter is a revision to my letter to you dated August 31, 2004
concerning Lot 28. The revisions to that letter address two matters: 1) the
street addresses of Locus and abutting parcels have been changed; and 2) the
area and frontage of Locus has been increased as a result of the deed from
Jeffrey Pepi to Melbourne K. Nickerson, dated September 29, 2005, recorded
in Book 20311, Page 20. (Tab 2) However, my opinion that Locus is a separate
building lot has not changed because the deed from Pepi to Nickerson at Book
20311, Page 20 did not increase any nonconformity, but in fact made former
Lot 28 less nonconforming as to area and frontage. .
