As we discussed, I am providing this information to you with regards to these lots in order that you may determine the buiildability of these lots. Please be advised that the lots in question are Lot Nos. 33,35, 38,40 and 42—all on Lillian Drive as shown on a copy of the subdivision map that I have attached to this correspondence for yo it review. After our meeting this morning;I did, in fac±, drive over to the property and found that Lillian Drive dead ends currently at the boundary of Lots 45 and 42. My client has assured me that he has submitted the preliminary plan to the Town of Barnstable Engineering Department some time ago and it is intended that the Lillian Drive will be extended as it is shown on the attached map at the time these lots are built upon. _ The lots were checker boarded by deeds recorded in December of 1986 subsequent to the adoption by the town of the one acre zoning. However,pursuant to Article 4, Section 4.2 (2 which allows for common lot protection these lots fit within that exception especially because the subdivision which these lots are located within was approved by the Town of Barnstable back in 1961. Cole of 9 Elaine Road, Hyannis, MA. The Coles are buyers under a purchase and sale agreement for the above-referenced lots . They recently went to the Building Department to inquire as to the zoning status of the lots and were told by Kathy Maloney of your office that the lots were "not buildable . " Although I realize that the Town cannot render an opinion on the lots' "buildability" as it is not a function of the Building Department, the issue is whether the lots have been previously reviewed by Town Officials and deemed to be conforming lots . While I am not trying to impugn Ms . Maloney, the Town records concerning these two lots, as well as several surrounding lots on Lillian Drive, have been the subject of much recent correspondence . The Town has represented that the lots in question, being Lot 34 on the Graig-Port Subdivision and located on Assessor' s Map 248 as Lot 199 with an address of 9 Elaine Road, and Lot 35 on the Graig-Port Subdivision and located on Assessor' s Map 249 as Lot 200 with an address of 49 Lillian Drive, are grandfathered, conforming lots . See letters attached as Exhibit "1 . " Mr. Elbert Ulshoeffer, Jr. December 14 , 2000 Page 2 Since Elaine Road was constructed many years ago and Lillian Drive was recently constructed, and permits issued for Lots 33 , 38, 40, 42, on Lillian Drive which abut Lots 34 & 35, I wanted to confirm the Town' s former representations that Lots 34 & 35 are conform- nq'-l-,ots by-virtue of the provisions §4 .-4 2-: --The Town has been provided with copies of the deeds by Attorney Rapp which are in your files . After reviewing those deeds, the former zoning agent indicated that the lots were indeed conforming. I have provided a copy of the deeds and an opinion from Attorney Michael Princi indicating the status of the lots . Accordingly, as a result of the inconsistency in what my clients were told by a representative of the Building Department and the attached correspondence from the Town indicating the lots are conforming, I would ask for a letter clarifying the status of the lots under §4 .4 . 2 . As the attached deeds and correspondence clearly indicate, Clots 34 & _35 _have -not been in common ownership with 2 adjoining hots since 1986, have a minimum of 7, 500 sq. ft . in area and 75 feet of frontage requirement for the zoning district in which they are located, were recorded or endorsed on a Plan that conformed to zoning when legally created, and conformed to applicable zoning requirements as of January 1, 1976 . Accordingly, Lots 34 & 35 satisfy the provisions of and are entitled to the protection afforded by §4 .4 . 2 , entitled "Common Lot Protection" of the Town of Barnstable Zoning Bylaws . I would ask that you provide me with a letter indicating that the lots are conforming. This will clear up the confusion which seems to have arisen out of the Town' s inconsistent representations regarding the lots and will allow us to move forward on the purchase of the lots . I realize you cannot and will not issue an opinion on the "buildability" of the lots, however, as the lots have frontage on existing ways, are grandfathered, have already received septic permits, and all of the lots surrounding Lots 34 and 35 have Mr. Elbert Ulshoeffer, Jr. December 14, 2000 Page 3 received building permits, there are no other issues which would effect the construction of two bedroom houses on the lots . As we discussed,I am providing this information to you with regards to these lots in order that you may determine the bui7dability of these lots. Please be advised that the lots in question are Lot Nos. 33, 35, 38,40 and 42—all on Lillian Drive as shown on a copy of the subdivision map that I have attached to this correspondence for your review. After our meeting this morning,I did,in fact,drive over to the property and found that Lillian Drive dead ends currently at the boundary of Lots 45 and 42. My client has assured me that he has submitted the preliminary plan to the'Town of Barnstable Engineering Department some time ago and it is intended that the Lillian Drive will be extended as it is shown on the attached map at the time these lots are built upon. The lots were checker boarded by deeds recorded in December of 1986 subsequent to the adoption by the town of the one acre zoning.
