The following is a summary of my research. However,based upon my research, it is my opinion that Lot 35 is a grandfathered, buildable lot for zoning purposes because it meets the requirements of Section 4- 4.2 2). The facts regarding Lot 35 on Lillian Drive in Hyannis are as follows: l. The lot was established on a plan dated September 1961. The plan was recorded at the Barnstable County Registry of Deeds in Plan Book 165, Page 41. Lot 35 has 12,195 square feet. At the time Lot 35 was established the minimum lot size requirement in this area was 10,000 square feet. 2. On April 11, 1969 by a deed recorded in Book 1434, Page 650, Rolkin Realty Trust conveyed Lot 35 along with abutting lots 34 and 38 (and several other lots not relevant to this opinion) to Cape Cod Building Supplies Inc. On February 28, 1985 by Article 1 of the Barnstable Town Meeting, the minimum lot size in the zoning district in which Lot 35 lies was increased from 10,000 square feet to one acre. Up until this zoning change in 1985, Lot 35 had been a conforming lot. 4. On December 29, 1986 by a deed recorded in Book 5483, Page 226 Cape Cod Building Supplies, Inc. conveyed Lot 35 to Katherine M. Frucci et ali. At the time of this conveyance, Lot 35 was owned in common with not more than two adjoining lots. This conveyance put Lot 35 into ownership separate from all contiguous lots within the time-frame allowed under Section 4-4.2 2) of the zoning ordinance. 5. On January 30, 2001 by deed recorded in Book 13529, Page 127, Katherine M. Frucci et ali conveyed Lot 35 to Albert J. Belmmonte, Jr. and Allison J. Belmonte. 6. By deed dated December 31, 2003 and recorded March 26, 2004 in Book 18365, Page 140, Albert J. Belmonte, Jr. and Allison J. Belmonte conveyed Lot 35 to Teresa M. Cole, Trustee of the Teresa M. Cole Realty Trust. Teresa M. Cole, Trustee of the Teresa M. Cole Realty Trust is the current owner of Lot 35. 7. The sole beneficiary of the Teresa M. Cole Realty Trust is Kimyon R. Cole. A copy of the Schedule of Beneficiaries for the Teresa M. Cole Trust is enclosed herewith for your review. 8. As can be seen from the attached rundown schedules and deeds copied from the Barnstable County Registry of Deeds, abutting lot 36 is owned by Kimyon R. Cole and Teresa M. Cole, Trustees of the Cole Family Trust. Page one of the Cole Family Trust is enclosed herewith for your review. Page one of the Trust indicates the initial primary beneficiaries of the Cole Family Trust are K. Robert Cole and Teresa M. Cole. 9. On March 4, 2003, an instrument titled (Certificate of Trustee Under M.G. L. CH. 184, SEC. 35, dated March 2, 2004), was recorded in Book 18282, Page 101. This instrument provides that the Cole Family Trust was formed on September 5, 2002 and has not been amended revoked or terminated. Based upon my review of the records of the Barnstable County Registry of Deeds and a review of the various trust documents, it is my opinion that Lot 35 located at 49 Lillian Drive, Hyannis, Massachusetts is a buildable lot because it meets the requirements of Section 4-4.2 2) Common Lot Protection in that: a. It is a lot zoned for single family residential use that was held in common ownership with not more than two adjoining lots; b. Lot 35 has in excess of 7500 square feet in area and in excess of 75 feet of frontage; c. Lot 35 was created by a definitive subdivision plan which was recorded in the Barnstable County Registry of Deeds and conformed to the zoning requirements at the time of its creation; d. Lot 35 conformed to the applicable the zoning requirements as of January 1, 1976; e. Lot 35 was conveyed into separate ownership by a deed dated December 29, 1986 and recorded in the Barnstable County Registry of Deeds in Book 5483, Page 226. This conveyance of Lot 35 into ownership separate from all adjoining lots was within five years of the effective date of the zoning change, which made Lot 35 a non-conforming lot. Lot 35 has been held in separate ownership since December 29, 1986. Based upon the records of the Barnstable County Registry of Deeds and my review of appropriate trust documents, it is my opinion that Lot 35 is a grandfathered buildable lot for zoning purposes.
