The petitioner proposed to construct an approximately 100 square foot garden shed located approximately 22.5 feet from the front property line and approximately 10 feet from the side property line. The subject property is currently improved with a 6,630 gross sq.ft (4,548 sq.ft living area), seven- bedroom, single-family dwelling built in 1885. The dwelling is nonconforming to several setbacks. It is a 2% story dwelling with a basement that appears to be accessed by a bulkhead door._ Currently the front yard setback area along Wachusett Avenue is paved for parking and screened from the street and the abutting property by a mature privet hedge. Procedural& Hearing Summary Appeal No. 2015-060 for a variance from the front and side yard setback requirements of§240-13 was filed at the Town Clerk's Office and office of the Zoning Board of Appeals on November 30, 2015. A public hearing before the Zoning Board of Appeals was duly advertised and.notice sent to all'abutters in accordance with MGL Chapter 40A. The hearing was opened January 13, 2016 at which time the Board found to grant the variance subject to conditions. Board Members deciding this appeal were Brian Florence, George Zevitas, Herbert K. Bodensiek, Matthew Levesque and. Robin Young. Ian Wamer of ACER Landscape Design represented the Petitioner before the Board. Mr. Warner. reviewed the history of the property and the recent improvements to upgrade a large parking area with hardscape and landscaping. He reviewed the site, noting the location of the septic cleanouts and existing mature trees which made it unable to locate a shed in conformance with setback requirements. He noted the nonconforming nature of many of the structures in Hyannis Port and indicated the shed construction would be in keeping with the appearance of the neighborhood. In response to questions from the Board, Mr. Warner affirmed that the shed would be screened from the street with landscaping. Public comment was requested and no one spoke. r Bk 29470 Pg283 #8845 Town of Barnstable Zoning Board of Appeals—Decision and Notice Variance No.2015-060—Celentano Findings of Fact At the hearing on January 13, 2016, the Board unanimously made the following findings of fact.for Appeal No. 2015-060, a request for a variance from the 30 foot minimum front yard and 15 minimum side yard setback requirements: 1. In Appeal No. 2015-060 Amy Celentano petitioned for a variance to the minimum setback requirements of the RF-1 District, Section 240-13(E). The petitioner seeks relief from the minimum 30 foot front yard and 15 foot side yard setback requirements to construct an approximately 100 square foot garden shed. 2. The subject property is located at 45 Longwood Avenue, Hyannis, MA as shown on Assessor's Map 287 as Parcel 054. It is in the Residence F-1 Zoning District. 3. There are circumstances related to shape or topography of such land or structure and especially affecting such land or structures but not affecting generally the zoning district in which it is located. The location of the existing dwelling, in addition to the septic system on the property limit the area a shed could be located in conformance with setback requirements. 4. A literal enforcement of the provisions of the zoning ordinance would involve substantial hardship,financial or otherwise to the petitioner. If the petitioner was required to locate the shed in conformance with setbacks, it would interfere with the location of the existing septic system cleanouts, result in potential damage to a mature tree, and/or disturb recently installed landscape improvements, resulting in a hardship. 5. Desirable relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of the zoning ordinance. The surrounding neighborhood is characterized by a variety of nonconforming structures. The proposed shed will be screened from the street with landscaping. Bodensiek, Matthew Levesque, Robin Young NAY: None Decision Based on the findings of fact, a motion was duly made and seconded to grant Appeal No..2015- 060, variances from the 30 foot minimum front and 15 foot minimum side yard setback requirements of the Residence F-1 District, subject to the following conditions: 1. Variance No. 2015-060 is granted to allow the construction of a garden shed not to exceed 100 square feet in area or footprint within the required front and rear setback areas at 45 Longwood Avenue, Hyannis. -2. *The shed shall be located in substantial compliance with the plan entitled"Celentano Residence, 45 Longwood Ave, Hyannisport, MA"drawn by ACER Landscape Design, dated November 20, 2015. 3. This decision shall-be recorded at the Barnstable County Registry of Deeds and copies of the recorded decision shall be submitted to the Zoning Board of Appeals Office and the Building Division prior to issuance of a building permit for the shed. The rights authorized by this variance must be exercised within one year, unless extended. The vote was: AYE: Brian Florence, George T. Zevitas, Herbert K. This area abutts the northeast area of 14 LaPayette Ave.., Hyannis Port, MA., 02647. When informed by the office of the Building Inspector that I could present my request and discuss the matter on July 13, 1993, I typed a report from notes and hastened to deliver it without taking time to proof-read. I had hoped to stop the work in progress which had resumed with no regard or notice to Marie O'Keil about her telephoned complaint. The project continued however. The essence of the 7/12/1993 report is clear on a whole despite the need for typing corrections. Although I left two messages- on the recording telephone 778-6040 for Mr. Dionisi, I have not heard from the owner of the Capt. Cobb House. Sudbury: Dionisi, Robt. I told them they were at the Capt. Cobb House (where..the ,buildings are attached although separately founded) and that Mr. Dionisi was the owner As they had mentioned his name. They pointed to 14_LaFayette Ave. and asked if that were the second house and if that was LaPayette. I replied that 14' LaFayette Ave. was the O'Hare Cottage. On my way back from the Post Office I saw the two men papers in hand measuring from the edge of the terrace inward to the Dionisi inn. I mentioned the matter to Marie O'Neil whom I saw shortly afterwards. Perhaps there is a connection with the above happening and the mis-repres- ented "patio"' that has been installed on the 'hest side of Mr. Dionisits buildings* The need to have the deck removed and the area restored to a proper condition appropriate to the original state and .use remains. Lumber was delivered and work started at the northwest area of the Capt. Cobb House. I inquired of the man about what was planned and whether a permit had been obtained. He said permissin had been obtained. He mentioned that -Bob Dionisi had been down over the weekend He said Caroldne Wills had been there that morning -and he had placed a yellow rope line where a replacement fence would go at some time by her, the northwest diagonal abuttor. A woman near a doorway said they were going to put in a patio. The man s.aid ,hE, worked for Bob. I asked whether a north fence was to be replaced. The man said there was no fence. I replied that I had a photo of a fence removed last summer. (Installed during Ream ownership) I phoned Mr. Dionisi, 778-6040 and left a message on the answering machine about .the replacement of two finces. 6/15/93 Tues. I phoned the Bldg. Inspec. 790-6227 to verify about the permit. The office had- not issued a permit. I phoned Dionisi, 778-6040 and left a message to the machine that I was going to object to the construction. 6/17/93 Thurs. I was told Richard Bearse of the Bldg. Inspector's Office wou nstoct the construction. between 3-4 p."m. A Stump Master truck ,was in the driveway with ladders. A man with a chain saw said he worked for Dollgoff. The man said the Bldg. Instpector had Left a card. The inspector was called back by them,and they weve told it was all right. (Telephone--book:- - Dollgoff, Arjt:hur and Shirleyt 20 Sunset Terr., W. Hyannis Port ?75-6532; uxder ;Carpenter 7?1-00211 . 3:40 p.m. I called Mr. Bearse who {6?aid the Building Councilor (Mr. Daluz) said if the structure is flat nothing could be done about it. Since I. expressed concern about drainage, he said he recomended breaking up the asphalt which covered areas. I reported the height of ,the construction, 8" boards on end, a deck not a-patio. Flooring woucld increase the height, .approx. 3% The hammering stopped at 2:15 p.m. Later I saw and elderly man talking with t-he worker. I called the. Bldg. Inspector's Office and was told there had been a complaint ten. minutes earlier from. Marie O'Neil. 7/4/93 I observed three cars and a van in the parking lot of the `tlnn' and noted that the water in the 2nd floor toilet was moving. Since the installation in recent years of a toilet in the Inn's north side and a fire hydrant nearby on Longwood Ave. , south of Wsshington Ave. the 14 LaFayette Ave. house has had periods of low water pressure in the summer when many people are in the area. Rep�ort to the Bldg. Inspector, Town of Barnstable. 14 LaFayetteCAAve 7/12/1993 (p•2) Hyannis Port, MA. 12 Mon. Approx. 11 a.m. I heard a loud bang. Since sounds from the rear of the "Inn" are heard over the unstable ground .to 14 LaFayette, I lookedeout the window to observe work had resumed at the northwest area of the "Inn". I notified Marie O'Neil who had not received notice from the Bldg. Inspectorts Office. A call to the Bldg. Inspec. informed me that Mr. Daluz said it had been approved. At 3:10 p.m. Marie O'Neil called me to say she requested information and was told that a flat structure was allowable. The structure is not flat and will: be detrimental to 14 LaFayette Ave., to older Cape Cod buildings and to the neighborhood. I have tdken photos and plan to present this complaint to the office of the Building Inspector on 7/13/93. I ahould like to 'request the removal of the raised patioiawpresentlg under construction and to be informed about any other plans for the area that are innovative or harmful to 14 LaFayette Ave. or the environment. There has been misrepresentation about a 'patio". Ants, insects, and rodents thrive under decks. In closed areas decks are dank, smelly, and termit hazardous. Wooden decks present an added fire hazard especially to buioldings in close proximity. In the course of the present work- pipes; located in a northwest corner were dug up. At one time there was a gas odor in the area in question. The gas company checked it out after a call.. Has this underground connection of the pipes removed been verified? Under Dionisi ownership of the "Inn" a worker painting the door area pulled .out -rods from the base of the 14 LaFayette chimney. Early this- spring a large cement' block left by the chimney bander beside the base of the 14 LaFayette chimneu was moved and used to wedge against a wired area to the "Innis" annex rear underground. I reported the matter to my sister Marie O!Neil. The block was removed and returned broken in half to the original chimney. position. After that I noted new scruffing on the corner northeast roof and side area. of the bulkhead in the path of movement. The area wired had been used by cats and small animals as a refuge. In the past my cat got caught under there with her leash wrapped around a rock. She was rescued with heroic effort by the Centerville MSPCA. When a new floor was put in the old building above a few years ago two skeletons were found beneath the olf flooring. The foundation was. left open. Since the O'Hare residency a window was added to the "shed" building on °the second floor and a washing machine. The sounds 'fr_om "shed , section are heard at 14 LaFayette loudly and distinctly. There was particular when a young boy in the family under Curley ownership raced up and down the inside stairs. One summer when break and entry was prevalent a youth in the early evening fell and broke the sloped-glass door panels of a previous door in this washed out area. The occurence was during the Curley ownership. A leaking roof in the northwest corner was neglected in recent years until a call was made. n A few summers ago it was difficult to reach the Dionisis when a front door on the porch was opened setting off an alarm. In the recent past plastic trash barrols with warped covers allowed standing water for periods of time contributing to mosquito numbers« Grease from the terrace grill has been dumped behind the stone wall and southwest hedge, as well as fish bones. Under the "make Whole policy" the Inn has; caused serious erosion to the eastern rear of the 14 LaFayette Ave. house. In my view the pulling away of the chimne'i was caused by water erosion after the Rem; erected a fence in the western area of the present scene. A metal locker was placed directly behind the fence. This was badly rusted when removed last summer. Water runoff and drainage was diverted, to the South between the two buildings rather than continuing towards the ocean across Longwood Ave. Mr. Drinkwater brought the chimney to Delina O'Hare's attention when reviewing another matter. The work was done with the chimney banded, extended, and potted. Since then however the bolts continue to slip. The rear 'property eroded from a door jamb level to a dangerous washed-out condition. Sometime after the purchase of 14 LaFayette Ave. by 'the O'Hares. from Mrs. Pearl McMullin, Vgachusett Ave. a monthly bill was sent by the "Inn Is" owner who had the propert previous to Mrs. McMullin. He sent a bill to 14 LaFayette Ave. for 47540, per .month maintaining 14 LaFayette Ave. was .using his cesspool. . A second cesspool was installed by ,Clough and Higgins in the northwest area of LaFayette with ,a leech bed. added at a later time. . The detters�_;o€ old plans for building foundations and cesspools and ,,­The a possible well should be researched. At the time of purchase by the O'Hares of 14 LaFayette Ave. the Capt. Cobb House or "Inn"' had grassed landscaping suitable to the buildings and location. Water pressure, building movement, bugs, fire and drainage requirements need evaluation. ., The structure underway is not flat, but a raised deck.
