This decision is rendered subject to Section 3(f)(1) and 3(f)(2) of the Enabling Regulations. This decision is rendered pursuant to a vote of the Regulatory Committee on April 26, 2004. PROJECT DESCRIPTION The project under consideration by the Regulatory Committee was the interior renovation of a portion of a property at 500 Main Street, Hyannis in Barnstable. It is an existing structure of approximately 39,500 total square feet which had and will continue to have multiple occupants. The site is supplied by sewer. Of the 39,500 total square feet, the applicant proposed to retrofit approximately 14,500 square feet of interior space on two stories to accommodate offices for the Massachusetts Department of Social Services. A portion of the 14,500 square feet (about 3,825 square feet) was formerly occupied until January, 2004 by a restaurant (Spiritus Pizza). JURISDICTION The proposed project is subject to review by the Commission, through the Regulatory Committee, based on Sections 3(f) and 4(b) of the Enabling Regulations (as revised September, 2002). TESTIMONY The Regulatory Committee of the Cape Cod Commission held a public hearing beginning at 9:30 AM on Monday, April 26, 2004 at the Commission's office at 3225 Main Street in Barnstable MA. Mr. Ansel opened the hearing at 10:25 AM. Mr. Platt read the hearing notice. Ms. Adams presented the Commission staff report. She;stated..that_the-staff'has ;:,-!. recommended that the project should not require further Commission review. However, the staff has requested that additional information should be required for water resources and historic preservation. Attorney Harvey Mickelson, attorney for the applicant, stated that they are requesting approval of the project. They will submit the information on water resources at a later time. Mr. Kevin Shea, Director of the Barnstable Office of Community and Economic Development, stated that he supports the proposal for reuse of the building. He explained that the-project fits well into the economic development scheme for the Hyannis downtown area. Mr. Harold Sachs, proprietor of Diamond Perfections store, stated his support for the project. Mr. Cole inquired how the rehab of a building could affect storm-water runoff. Ms. Adams responded that there may be changes to the parking lot. Mr. Mickelson stated that they believe there are no changes and no problems. Mr. Broidrick.inquired about changes to-the exterior of the-building. Ms. Adams" responded that the Commission staff is still waiting for information from the Historic Commission. The Regulatory Committee decided not to take this issue under consideration. Change of Use Decision—500 Block Project—Hyannis—4/26/04 4 Ms. Kadar moved to close the hearing at 10:45 AM. Mr. Broidrick seconded the motion and it was unanimously approved. Mr. Broidrick moved to allow the project to proceed without further DRI review. Ms. Kadar seconded the motion and it was unanimously approved. FINDINGS The Commission, through the Regulatory Committee, has considered the Change of Use application of the William Street Corp. for the proposed Department of Social Services office project to be located in the 500 Block building on Main Street in Hyannis, MA. Based upon consideration of such application, and information presented at the public hearing and submitted for the record, the Commission, through the Regulatory Committee, found that the project qualified for no further Commission review because the overall impacts of the proposed project were found to be not more detrimental than those of the immediately prior use. The design plans were submitted to VoiceStream Wireless for the purpose of construction and produced in accordance with the Massachusetts State Building Code(780 CMR 116.2.1). A field visit'conducted on 9/18/00 revealed the following: antennas had been mounted within the existing steel framed and wood sheathed tower structure,radio equipment cabinets had been placed in the existing utility room, and utility service had been installed. The following discrepancies were noted in our inspection: Two (2") inch diameter mounting pipes were used instead of the four(4") inch diameter mounting pipes specified. Based on the antenna load the two (2") diameter mounting pipes are capable of supporting the antennas. The layout of VoiceStream's telecommunications facility appears to be constructed as intended in the EK design plans dated 4/11/00,with the except noted above. Upon my arrival I had conversation with the property owner, JOHN M LINDE. LINDE said that the defendant of the warrant, JANNA GRAUER, was not on the property. I checked the building and confirmed that she was not. I then discussed with MR -LINDE the town bylaw stated in Article XX, and that he was in violation of that bylaw having more than one unregistered motor vehicle on his property at the time. At the time LINDE had 5 unregistered motor vehicles on the property. I then asked him if he would mind if I noted the VIN numbers for the unregistered motor vehicles on the premises and he said that would be fine. While taking down the VINS, Ptl Clark and I ran several checks with the Registry. One VIN came back status stolen on a Ford Mustang (see incident # 98032763 for report) . LINDE was placed under arrest for receiving a stolen motor vehicle (case 98032763) . In regards to the unregistered motor vehicles, however, it was also found that LINDE had a large amount of tools in his garage. It also appeared that LINDE was using his property as a commercial automechanic lot as evidence pointed to his dismantling and reassembling of several vehicles . Sgt Huddick arrived and he also stated that he believed LINDE to be in violation of the Home Occupations codes found in Section 4-4 . 1 of the town Supplemental provisions . All evidence at the scene suggested that LINDE was in fact operating a home occupation that was very discernible from outside the dwelling. The issue of parking has become a concern `as new, or additions to, commercial businesses develop. In terms of. your building at Main and High school Road, our department made a survey of your building and parking. The Assessors record indicates an overall building total of 37,804 square feet. There is an additional 10,720 square feet of basement space. These measurements total 48,524 square feet of usable space. of this total, 2,880 square feet is occupied by Spiritus Pizza restaurant. From the parking requirements we have the following: 45,644 square feet of retail space requires 228 parking spaces. 2,880 square feet of restaurant requires 18 parking spaces. The ordinance requires one (1) additional parking space for each individual business in the complex. We perceive that there are 275 spaces on the ground. Accordingly, you could rent or lease to no more than a total of 29 separate businesses within this complex to be in compliance with the Ordinance. This is simply to state other than the main catalog business and the restaurant you have the ability to lease to 29 enterprises. In my opinion, each vendor constitutes a separate enterprise under Section 4-2.7 of the Zoning ordinances.
