In 1996, the Petitioner sought a Variance (1996-114) to the provisions of Section 3-1.1 (J) - Multi- Family to allow the dwelling to become four-family (2-three bedroom units, 1-two bedroom unit, and 1-one-bedroom unit) in what was then the Professional Residential District (PRD). There were many requirements for multi-family use in the district at the time and both the dwelling and the lot did not meet several of them. ,The Board granted the Variance with 11 conditions (see document for details). John Zullo has now petitioned for a Modification of Variance No. 1996-1,14 in order to remove Conditions No. 3 which required one of the four permitted units to be owner-occupied and Condition No. 9 which restricts the number of occupants to 10. The subject property_is a .22-acre-with_frontage.on_Main Street between Cedar. Street and the Yarmouth town line. It is located primarily in a multi-family and medical use area. According to the Assessors records, the property is improved with an 8 bedroom., 3,748 square feet of living area (5,712 gross floor area), structure constructed in 1880. The Petitioner cannot refinance his mortgage with the restriction that one unit be owner occupied. The Board is required to find that each of the following three requirements has been met in order to consider granting the variance: 1. ' owing to circumstances related to soil conditions, shape, or topography of such land or structures and especially affecting such land or structures but not affecting generally the zoning district in which it is located; 2. a literal enforcement of the provisions of the zoning ordinance would involve substantial hardship, financial or otherwise to the petitioner; and 3. desirable relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of the zoning ordinance. An application for a variance that has met all three requirements "does not confer ... any legal right to a variance." , The Board still has the discretionary power to grant or not to grant the variance. Should the Board find to grant the variance, it may wish to consider the following conditions: 1. Variance No. 2019-009 is granted to John Zullo to modify Variance 1996-114 at 54 Main Street, Hyannis. 2. In Variance No. 1996-1.14, Condition No. 3 is deleted. 3. In Variance No. 1996-114, Condition No. 9 will now read: Total occupancy of the four ,apartments shall not exceed twelve (12) occupants. 4. All other conditions in Variance No. 1996-114 remain in full force and effect. 5. The site development shall be in substantial conformance with the plan entitled "Plan of Land in Hyannis, Mass" dated October 22, 1992 by All Cape Engineering. 6. The above-described addition shall represent full build-out of the lot. No further additions or alterations shall be permitted without approval from the Board. 7. This decision shall be recorded at the Barnstable County Registry of Deeds and copies of the recorded decision shall be submitted to the Zoning Board of Appeals Office and the Building Division prior to issuance of a building permit. Hearing Summary Variance No. 2019-009, a modification of Variance No. 1996-114, was filed at the Town Clerk's office and office of the Zoning Board of Appeals on January 30, 2019. A public hearing before the Zoning Board of Appeals was duly advertised and notice sent to all abutters and interested parties in accordance with MGL. Chapter 40A. The hearing was opened on March 13, 2019 and continued s to April 24, 2019, at which time the Board found to grant the Modification Variance subject to x conditions. Board members deciding this petition were Alex Rodolakis, Paul Pinard, Jacob Dewey, E Herbert Bodensiek and Mark Hansen. Attorney Michael Murphy presented the Petition before the Board. Attorney Murphy reminded the board that his client was denied mortgage refinancing from the Bank due to the restrictions placed on the property in 1996. Attorney Murphy reviewed the supplemental memorandum sent to the a Board on April 12, 2019 which answered the Board questions from the first hearing. The supplemental memorandum included: a revised letter from Benchmark Mortgage, Section 3-2.1 of the Barnstable Zoning ordinance defining the former Professional Residential District, and 2019 ' Certificates of Registration for each of the four apartments. i Town of Barnstable Planning and Development Department Decision Modification Variance 2019-009—Zullo 3 f The Board discussed the attachments in the April 121h memorandum. One member disagreed with 1 the statement that the Petitioner's hardship was the inability to refinance a residential mortgage with one bank. The Board Chair requested public comment and no one spoke. Findings of Fact At the hearing on April 24, 2019, the Board voted and made the following findings of fact in Variance No. 2019-009, a request for a Modification of Variance No. 1996-114, at 54 Main Street, Hyannis, MA. 1. Owing to circumstances related to soil conditions, shape, or topography of such land or structures and especially affecting such land or structures but not affecting generally the zoning district in which it is located. The Board found that the lot was undersized. 2. A literal enforcement of the provisions of the zoning ordinance would involve substantial k hardship, financial or otherwise to the petitioner. The majority of the Board found that being unable to refinance a mortgage is a financial hardship. z 3. Desirable relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of the zoning ordinance. The Board found that the appearance and operation of the multi-unit structure will be unchanged. Town of Barnstable Zoning Board of Appeals Decision and Notice Appeal No. 1995 -164-Zullo Special Permit-Section 4-4 Non-Conformities Summary Withdrawn with Prejudice Applicant: Leo&John Zullo Property Address: 54 Main Street, Hyannis, MA Assessor's Map/Parcel 342/025 Area 0.23 Acres Zoning: PRD-Professional Residential District Groundwater Overlay: GP Groundwater Protection Overlay District Special Permit: Section 4-4-Non-Conformities-to change use of dwelling to 4 family dwelling. Background: The Applicants have appealed for a Special Permit to change use of a structure from a rooming house to a 4 family dwelling. The property is located at 54 East Main Street, Hyannis, MA in PRD, Professional Residential District. The area is primarily commercial in nature. According to the Assessors Records the dwelling is a rooming house of 3,411 sq.ft. containing a total of 19 rooms, 8 bedrooms and 5 bathrooms and was built approximately 1960. The previous owners of this property had a license for a lodging house between 1990 through 1993. There are no licenses issued under Zullo in 1994. A Lodging House use is different from a multi-family use. This proposed use is permitted in this district but under several conditions. Multi-family homes must meet the restrictions under Section 3-2.1 (J) a-i. Procedural Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on November 3, 1995. A public hearing before the Zoning Board of Appeals was duly advertised and notices sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened on November 29, 1995 and continued to March 06, 1996, March 27, 1996 and to May 01, 1996, at which time the applicant requested to withdraw the appeal and the Board voted to grant a withdrawal with' prejudice. On November 29, 1995, the Applicants and Board agreed to a 120 day extension of time for filing of the decision. On March 27, 1996, the Applicants and Board agreed to a 210 day extension of time for filing of the:decision. Board members hearing this appeal were Emmett Glynn, Gene Burman, . Tom DeRiemer, Elizabeth Nilsson, and Chairman Gail Nightingale. Hearing Summary: At the.opening of the hearing, John and Leo Zullo, the owners of the property, represented themselves before the Board. They bought the house on January 5, 1994. On January 3, 1994, the applicants went to the then Building Inspector expressing their desire to purchase this home and continue its use as a Rooming House. John Zullo currently resides at this property. Mr. Zullo desired to change the classification of the house from single family dwelling to multi family dwelling. At some point between 1983 to present the dwelling was converted from a single family home into a four family home which was not allowed under Zoning. In 1973, the Assessor's records listed the home as a single family dwelling. The current records indicate a Rooming House. In 1983 and 1985, two building permits were issued to the dwelling as a single family dwelling. Although, multi-family dwellings are allowed in this PRD district, this home does not fit the criteria. The kitchens were put in illegally without the proper permits to change the use. e Zoning Board of Appeals-Deci`ion"and Notice Appeal No. 1995-164-Zullo The house was originally built in 1890. Mr. Zullo has worked on the structure and has cleaning up the home. He presented a letter of support from Dr. Thrope', an abutter who testified to the improved nature of the dwelling and lot. The Board asked Mr. Zullo for proof that there is a legal, pre-existing, non conforming use. He was unable to provide the information and the Board continued the hearing to March 06 1996 to permit the applicant to secure those facts and supporting documentation. The public was requested to testify. No one spoke in opposition and no one spoke in favor of this appeal. At the March 06, 1996 continued the Board again-extended the hearing to March 27 to permit further time for the applicants. No testimony given on March 06, 1996. At the March 27, 1996 continuance the Zullo's were represented by Attorney Theodore Goguen. The Board cited that this case was left with the need to establish its legal pre-existing non conforming use. The Board noted that the 19 rooms would also have to be dated back to establish that it was legally created. The Board also requested information about the kitchens. There are plans from 1983 in the file submitted by the Building Commissioner that show two kitchens. There are presently four kitchens and the Applicant must prove that the additional two kitchens were added legally. Attorney Goguen stated that the owners, John & Leo Zullo were told when they bought the property that all the permits were in place and the.buildings were legal. The property is being renovated by the current owners and is an improvement as it stands to the neighborhood. Lt. Hubler of the Hyannis Fire Department submitted plans from 1983 showing the layout of the two floors with two kitchens. Lt. Hubler stated that he had inspected the building on a regular basis and this information is accurate until 1993 when the Zullo's purchased the building. The Board requested from the Applicants any building permit information. Mr..Zullo responded that he had not secured any building permits. The Board asked if he has applied for a building permit and Mr. Zullo responded, "No". Mr. Zullo also testified that he did not add the other two kitchens. The property is located at 54 East Main Street, Hyannis, MA and is shown on Assessor's Map as Map 342 Parcel 25. The site consists of a 9,864 sq. ft. lot and according to Assessors Records contains a three-story dwelling of 3,411 sq.ft. constructed in 1890. The property previously was an 19 rooms lodging house, but has been converted to a four unit multi-family apartment building. The Zullo brothers purchased the property in January 1994:. In August 1995, they sent a letter to .the Building Commissioner stating a change of use to four units with four kitchens had already occurred. The Zullos had been before the Zoning Board of Appeals on November 29, 1995. At that time, the applicants were before the Board as a pre-existing nonconforming use on the site. The Zullos did not present this evidence, but requested their appeal be withdrawn at the final hearing on May 1, 19.96 (Decision No. 1995- 164). The multi-family use is permitted as a Principal Permitted Use-as-of-right-in this district providing several requirements are met(see Section 3-2.1 (J) a-i,.). However, it appears that this structure and lot does not meet at least six of these provisions, including: • (a)The minimum lot area ratio of 5,000 sq. ft. per unit. At four units, this would require a 20,000 sq. ft. lot and the lot is 9,864 sq. ft. • (b) Multi-family dwellings in this district are also required to meet a 20% lot coverage requirement(Section 3-2.1 J) b)). Lot coverage is defined in the zoning ordinance as coverage by the structure. Lot coverage up to 50% is allowed pursuant to a Special Permit(Section 3-2.1 J) i)). Since the footprint of this structure is 3,411 sq. ft. and the lot is 9,864 sq. ft., the lot coverage is 35%. • (d)The required front yard setback of the greater of 50 feet or 3 times the building height The front yard setback appears from a site plan submitted with the November 1995 appeal application to be-27.9'. Between 90' and 105'would be required. • (e)The side yard setback equal to the height of the building. The height of the building is between 30' and 35'; there is a 3.7' side setback. • . (f)A perimeter 20'greenspace shall be provided. Parking spaces need to be 9'wide per the Town of Barnstable Zoning Ordinance Section 4-7.7, Minimum Parking Lot Design Standards. Six spaces should fit on the side of the lot, but these should be defined. Procedural Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on August 02, 1996. A public hearing before the Zoning Board of Appeals was duly advertised and notices sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened September 11, 1996, and continued to October 23, 1996 at which time the Board found to grant the variance with conditions. Board Members hearing this appeal on September 11 1996, were Ron Jansson, Richard Boy, Gene Burman, Elizabeth Nilsson, and Chairman Gail Nightingale. Attorney Theodore H. Goguen represented the applicants, John and Leo Zullo, who were also present. At the October 23 continuance, the Alternate Board Members, William GarrefF, was appointed to replace Gail Nightingale who was absent and Gene Burman was Acting Chairman. Hearing Summary: Upon opening of the hearing on September 11, 1996, the Board asked Attorney Goguen to address the issue of repetitive petitions. Mr. Goguen stated that under Section 16, Chapter 40A, it is not repetitive because before they were seeking a Special Permit for a non conforming use and now they are.seeking a Variance. A different type of relief is being sought under a different provision in the Zoning Ordinance. The.Board determined to requested an opinion from the Town Attorney as to whether or not this is a repetitive petition and determined to continue the appeal to October 23, 1996. At the October 23, 1196, continuance, Town Attorney Robert Smith responded to the inquiry stating, "The different form of relief(Variance verses a Special Permit) makes it a different matter." Therefore, the Zoning Board of Appeals allowed this appeal (# 1996-114) to continue. Attorney Goguen reminded the Board that the Petitioner is seeking a Variance from Section 3-2.1 (J) Multi-family dwellings in the PR Professional Residential District. The request is to allow the property to be converted into a four family house. When the Applicants purchased the property, it was being used as a nineteen (19) room lodging house. The Zullos(the applicants) did not renew the existing lodging license after they bought the house. Mr. Zullo discovered there was plumbing for four(4) kitchens but those 4 kitchens were not issued any permits. As background information, Attorney Goguen explained that in 1890 (+/-)the use was a single family dwelling. In 1960, the dwelling was changed into a nineteen (19) room"rooming house". In 1973, the dwelling was assessed as a single family. In 1983 and 1985, there were two building permits issued to the property for renovations. Those permits list the dwelling as single family. From 1990. 1993, it was used as a nineteen (19) room"rooming house". Attorney Goguen suggested the history of the dwelling is confusing. Bearing in mind all this information, the Applicants want to convert this dwelling into a four family house, in a multi-family area, where multi family use in this district is permitted -as-of-right - if the property meets the requirements of Section 3-2.1. Attorney Goguen reported that the"project"will require Variance relief from several requirements. Specifically: (1)The minimum lot area ratio in the Zoning Ordinance requires 5,000 sq. ft. per unit. At four units, this would require a 20,000 sq. ft. lot and the lot is only 9,864 sq. ft. (2) The required front yard setback of the greater of 50 feet or three times the building height which equates to 90- 100 feet. The front setback is 27.9 feet. (3) The side yard setback must be equal to the height of the building which is between 30 and 35 feet. There is only a 3.7 foot side yard setback. (4) Under the Zoning Ordinance'a perimeter 20 foot greenspace is required. Again, the side yard setback is'3.7 feet, making it impossible to provide this amount of green space. 2 Town of Barnstable-Zoning Board of A F..ais- ` Decision and Notice-Appeal No. 1996-114 Zullo Variance to the provisions of Section 3-2.1 (J)-Multi-Family Attorney Goguen indicated that the size of the lot is large enough for the necessary six(6) parking spaces. The requirement is 1.5 spaces for each of the 4 units which equals.six(6)spaces. The proposed change has been welcomed by the neighbors who have commented that they consider the work being done by the Applicants a definite improvement. At the previous hearing, a letter of support was entered into the file. The applicant currently has a permit for two units. There is a hardship due to the topography of this lot according to Attorney Goguen. The lot was developed around 1890 and there is nothing that can be done now to try to comply with current zoning. The lot is undersized and substandard. It would be a substantial hardship to"move"the house somewhere else on the lot or completely"knock it down". The project would not derogate from the spirit and intent of the Zoning Ordinance nor would it be detrimental to the area. Public Comment: No one spoke in favor or in opposition to the appeal. The Board question if there was a need for additional reviews by any of the Town Departments, including the Fire Department, the Health Department and the Building Department. Attorney Goguen replied that he would_comply with any requests from the Fire, Health and Building Departments, as required.Attorney Goguen also noted that Accessory Use in this.PRD Professional Residential District, would allows for the renting of rooms to up to 10 lodgers, as-of- right providing the dwelling is owner occupied. This use would be more impacting to the neighborhood. Findings of Fact: Based upon the testimony given during the public hearing on this appeal, the Board unanimously found the following findings of fact: 1. The Applicants are Leo&John Zullo. 2. The property in issue is located at 54 East Main Street, Hyannis, MA and shown on Assessor's Map 342, Parcel 025 in the PRD Professional Residential District. 3. The property contains little less than of an acre or .23 acres of land. 4. In the PRD Professional Residential District, multi family dwellings are allowed as a matter of right subject to the Petitioner complying with certain requirements. The Petitioner.seeks a Variance from several of the following requirements: • The minimum lot area ratio in the Zoning Ordinance requires 5,000 sq. ft. per unit and the Petitioner is seeking relief from that requirement. • The Petitioner is seeking to construct four(4) units on the site which currently only allows only one unit, legally. • Also, the Petitioner is seeking relief from the required front yard setback which requires a setback of the greater of 50 feet or 3 times the building height. The existing setback is approximately is 28 feet. • In addition, the Petitioner seeks relief from the side yard setback which must be equal to the height of the building. The building is between 30 and 35 feet. There are some situations-where there is only a 31/2 foot side yard setback. • The Zoning Ordinance requires a 20 foot greenspace. Again, the side yard setback is approximately 31/2 feet, making it impossible to provide this amount of green space. • In addition, the requirements under the Zoning Ordinance requires that the lot coverage not exceed 20% and in this case,the current lot coverage is approximately 35%. 5. The building in issue predates zoning and has been.existence for at least ninety (90)years and perhaps closer-to one hundred (100)years. And therefore, is nonconforming. .6. The Petitioner as a matter-of-right has the ability to have permitted lodging on the property for up to ten (10) persons provided that the owner(s)of the building also reside in the dwelling as per Section 3-2.1(2)(A)of the Town of Barnstable.Zoning Ordinance. 7. The proposed use of four(4) apartment units would be significantly less detrimental that what is allowed on the site as a matter-of-right. 8. The bare area to the north side of the property will be seeded and landscaped. 9. A Lodging house use is different from a multi-family use. This proposed use is permitted in this district but under several conditions. John Zullo and Leo Zullo,the owners of the property,represented themselves before the Board. They bought the house on January 5, 1994. On January 3, 1994,the applicants went to then Building Inspector Joseph DaLuz expressing their desire to purchase this home and continue its use as a Rooming House. John Zullo currently resides at this property. Mr.Zullo needs to change the classification of the house from single family dwelling to multi family dwelling. Mr.Zullo was under the impression that"someone else"had done the paperwork,but was unsure"who"and also unclear what he had to do. Ralph Crossen stated that the current Assessor's records show this home is listed as a Rooming House. In 1973, it was listed as a single family dwelling. Two building permits.were issued(1983 + 1985). It is not clear to the Building Commissioner when or how the dwelling was converted from a single family home into a four family home which was not allowed under Zoning at that time. Rooms to rent were allowed but not multi-kitchens. Although,multi-family dwellings are allowed in this PRD district,this home does not fit the criteria. The kitchens were put in illegally without the proper permits to change the use. The house was built in 1890. When Mr.Zullo purchased the home,there were a total of 36 rooms. Work was done before he bought the home. Mr.Zullo has been cleaning up the home and the area. A letter of support was read into the record from Dr.Thrope,an abutter. In 1973,there were 17 rooms total plus 4 b 1993 there were 19 total rooms and 5 baths. The home was once a licensed Rooming Hou e. Ten ten is a allowed_in this district. Mr.Zullo is seeking a Special Permit to change from one-non co mg use to another non-conforming use. The Board asked Mr. Zullo how the current use is Non conforming and how it does not conform to the Zoning. Mr.Zullo needs to show proof that there is a legal,pre-existing,non conforming use. The Board stressed to the applicants that this is their responsibility. Mr.Zullo needs to show how the building did not conform to zoning. During this appeal,Ralph Crossen received a phone call from the Hyannis Fire Department and they stated that in 1990,they inspected the building and at that time there was only one kitchen in the building.- The Board needs proof that the unit was used as an accessory use and was rented(legally)to more than ten people. Page 1 129 SECTION 5 ADMINISTRATION AND ENFORCEMENT 5-1 Enforcement, Violations and Penalties 5-1 . 1 Enforcement: This ordinance shall be enforced by the Building Commissioner of the Town of Barnstable or his designee . 5-1 .2 Violations: For any violation of this ordinance, the Building Commissioner or his designee may, where the situation requires, cause a criminal complaint to issue from the First District Court of Barnstable or may institute proceedings in Superior Court to enjoin the construction, alteration, enlargement, reconstruction or use of any building or. the use of any premises in violation hereof, or further may institute proceedings to enjoin the construction, alteration, enlargement or reconstruction of any building which would result in a use in violation hereof. 5-1 .3 Non-conflicting Remedies: The use of one of the remedies described in Section 5-1 .2 above shall not preclude the use of the other remedy for the same violation or a continuing violation. 5-1.4 Verification/When Required: The Building Commissioner or his designee may require any plans, documents or sworn statements to be filed with his office to verify the intended use of a building or premises, or to establish the existence, nature or extent of a nonconformity alleged to exist or any other matter in which evidence is required.
