Dear Ms Marshall:
I want to begin by thanking you for your concern over 521R Main Street in Hyannis. It
makes my job so much easier when I get a chance to work with someone like yourself
given this tough situation.
A review of the site with my gas inspector and your contractor, Mr. Tetrault, has revealed
several serious safety problems that must be addressed as soon as possible. Many of the
following you are already aware of.
1. Means of egress: All the exterior rear means of egress are in disrepair. Some are
worse than others, but all require major work. To begin with, most structural
members are non-pressure treated lumber with plywood over them. This situation,
when not continuously protected with paint (as these are)results in rot. I would
suggest a more detailed exam for water rot be undertaken by your contractor to
determine the extent of the repairs needed. At the very least, the second floor
exterior exit system needs to be totally replaced. Please be aware of 780 CMR
Section 800.2 which requires two means of egress be maintained during work.
This means that all second floor people will need to be out of the building while
the work is going on. I suggest you come up with a plan and let me know what it
is before the permit is issued.
2. Heat: More than half of the units are without heat. New furnaces will have to be
supplied and inspected under the Massachusetts Gas Code.
3. Hot Water: There is only one 40 gallon hot water heater for all 14 apartments.
You will need to supply a hot water supply for each unit.

4. The service drop has been damaged by an apparent accident. This situation needs
to be taken care of now.
You will need to contact the Barnstable Housing Authority in the event people are
displaced during construction. Mr. Tom Lynch, at 508-771-7222, will be the one to talk
to.
It should be noted that I have not seen the inside of any of the units. Given the exterior
problems, I would like to see all units to check for fire safety and other problems before I
am comfortable with any proposed course of action. Please make arrangements for me
and the Hyannis Fire Department to go through each unit.
Please let me know as soon as you formulate a plan that addresses all the above concerns.
All will have to be addressed, as I told you. I am grateful that you are just as concerned as
I am. Hopefully, we can clean up these violations soon.
