Procedural Provisions: Section 5-3.2 (3) Variances: Background: This decision concerns the petition submitted by Charles H. Sr. and Tessie L. Gordon, who appealed to the Zoning Board of Appeals for a Variance to the Bulk Regulations, side lot line to permit an existing structure to be legal. . According to materials submitted the home is infringing of the side yard The zoning district requires a 10 disclosed distance. h q setback area by an undisclosed g foot setback and the applicant has requested a 10 foot variance. It appears pp qu the infringement occurred some time in 1985 with the addition of a 241x 26, one-story garage and with the placement of a shed. to the rear of the dwelling. The applicant is appealing to the Board for a Variance for the side yard setback to allow the structures to remain as they exist. Procedural Summary: The application was filed in the office of the Town Clerk and at the Zoning Board of Appeals office on January 25, 1993. A public hearing, duly noticed under M.G.L. Chapter 40-A, was opened on February 11, 1993, and continued to the hearing of April 08, at which time it was closed and a decision rendered by the Board. The petition was heard by Board Members; Gail Nightingale, Dexter Bliss, Elizabeth Nilsson, Eugene Burman and chairman Richard Boy. The applicants Charles H. Sr. and Tessie L. Gordon represented the petition before the Board and explained that the garage structure had been built into the side yard setback required for the district. The attached structure was also located upon an old way known as Phillips Road, that once existed over the lot but that was not in use today. It is the intent of the petitioner to refinance his home and this matter needs to be addressed in order to accomplish that. The petitioner was requested to submit several item during the course of the public hearing to establish who may have rights in the way or establish ownership. Decision and Notice Appeal No. 1993-12 Given the unusual situation, with a structure located in what may be a way, the Board felt that they needed further information before making a decision. The Town Attorney, Public Works Department and Planning Department were requested to comment on the status of the way. The applicant was also requested to provide information on the locus. The applicant submitted the following: A Mortgage Inspection Plan prepared by Colonial Land Surveying Company indicating the one-story dwelling with a portion extending into what is called an unimproved road. That plan did not clearly illustrate the degree to which the structure infringed upon the side set back or upon the roadway. The Plan was clearly labeled *must not be used for variance or building plan purposes.'• An older Certified Plot Plan dated 3/5/73 was submitted illustrating the dwelling before the addition. It documents that the building sat 35 feet from the property line and was in conformance to zoning. A copy of the Building Inspectors application for a building permit to construct the garage, dated April 03, 1984, which describes the addition as being 24,by 24, and attached to the dwelling with a 10 foot setback. The applicant in his testimony noted that he did decide after the permit during construction to insert a Breezeway between the was issued and g Y garage and dwelling. A petition was submitted with the signatures of 12 persons, addressed Megan Road and Mitchell's Way, the locus of this appeal that supported the variance. A 1946 subdivision plan of land for Veda F. Mitchell, identify the way and labeling it "Phillips Road. A 1972 subdivision of the land by Barnstable "Hyannis Willows" Survey Consultants, Inc. which identifies the center line of the roadway and labeled it a "traveled way" and identified as a private way, but gives no dimensioned to the way. A 1973 Certificate of Title to the locus of this appeal. The response from the Town Attorney Robert Smith suggested that there is no evidence that Phillips Road is an "ancient way". There also is no evidence that Way has been abandoned. The Department of Public Works indicated it had no interest in the way. The Planning Department gave a brief history of the way as documented on plans and expressed concern for individuals that may have an interest in this undefined and unimproved way. The Board discussed the property in question and whether the Board can grant any rights to the petitioner outside of the property bounds. All or some of the property is registered Land Court land and the petitioner does not have any rights in and to that particular land "Phillips Road". one can not obtain adverse possession to registered land. The Deed and Certificate of Title were reviewed by the Board. The description did not indicate the land was bounded by Phillips Road nor that the ownership r Decision and Notice Appeal No. 1993-12 of the lot in question extended to the middle of that way. The deed and certificate are silent on the existence of Phillips way. The Board discussed the fact that they do not know the status of the land in issue - registered land or unregistered land,. and where the way is located. The burden on the applicant is to show that he has an interest (ownership) of that land known as Phillips Road, and the degree of variance needed to resolve the issue at hand. Neither of these questions have been resolved for the Board. The Public was requested to speak. Eugenia Fortes spoke in opposition to the granting of the relief citing that the applicant knowingly built the garage structure and added other implements to the way. She said that she had alerted him to the fact that he was closing a traveled way and did not have the rights to do so. Finding of Facts On April 08, 1993, based upon the evidence presented and the testimony given at the hearings of this appeal, the Zoning Board of Appeals unanimously finds as follows: 1. The evidence presented to the Board has not been sufficient for the Board to determine whether or not the way in question has been abandoned. 2. The Board has not been presented definite evidence as- to the degree of variance that is being requested. 3. The Board is unable to grant a variance into a way that others may have an interest in. 4. The petitioner in adding onto his structure an addition larger than that requested and permitted in the 1973 Building Permit issued, has created his own hardship. Conclusion: Accordingly, based upon the findings, a motion was duly made and seconded that, Appeal No. 1993-12 be denied based upon the lack of grounds upon which to grant a Variance. The vote was as follows: Aye: Gail Nightingale, Dexter Bliss, Elizabeth Nilsson, Eugene Burman and Chairman Richard Boy Nay: None Order: Appeal No 1993-12 is denied a variance from Bulk Regulations, Minimum Side Yard setback Required. It appears that the encroaching portions of your structures lie on your side of the roadway and does not cross the center line. Clearly, the Town of Barnstable was on notice of this encroachment in 1993 when you proceeded before the Board of Appeals seeking a variance. The provisions of Massachusetts General Laws Chapter 40A, §7 preclude any enforcement action to recover a fine or to compel the removal of any part of the structures in violation of the zoning by-law, now that more than ten years have passed since the alleged violation occurred.
