The property is located in an 0-2 Zoning District which allows office use and retail use as of right. My purpose in writing to you is to request a determination that Blaine can legally occupy 7,200 square feet of space at this location without the need to obtain zoning relief from the Zoning Board of Appeals. Blaine Hair Academy seeks to replicate is trade school business that has been operated on Center Street in Hyannis for many years. The school's main operating months consist of late September to late April of each year. The school's classroom activities drop approximately fifty (50%) percent in May and part of June, and then ninety (90%).percent thereafter until the main academic year recommences in late September. During part of June,.July, August and most of September, the school's operation is almost entirely an office use. The space is occupied by one (1) person typically doing -clerical work or interviews of prospective teachers. All tolled, office use represents over fifty (50%)percent of the year-round operation of Blaine Hair Academy. When the School is in its academic year, classes are held morning, afternoon and evening spreading out the need for parking. As previously stated, the business needs by far the least number of parking spaces'during the busiest traffic months of the year. The subject property has the benefit of an additional thirty(30)~parking spaces through a Special'Permit with the Town on Town-owned land. N With respect to Massachusetts General Laws Chapter 40A Section 3,you have inquired about the educational aspect of the operation, specifically seeking what licenses are held by Blaine. Blaine is accredited by the National Accrediting Commission of Cosmetology Arts & Sciences. The School is registered with the Commonwealth of Massachusetts, Division of Professional licensure. The School is also eligible to participate in the State's financial aid programs through the Massachusetts Board of . Higher Education. Blaine is a member of the Massachusetts Rehabilitation Commission and the United States Department of Education. Each of its teachers are independently certified to teach as well. I have enclosed copies of the relevant documentation for your= - review. Representatives of Blaine Hair Academy are available to speak with you by - telephone if you have additional questions or concerns. `Blaine has been under the impression that their occupancy of the subject property is allowable and has spent over $80,000.00 in architectural and engineering fees in reliance upon information obtained from the Town of Barnstable over the last ten (10) months.
